janai norman joining us live working to find out whether the hearing is tied to the supreme court ruling. >> reporter: the hearing for okafor is scheduled for 1:30 pm this afternoon closely following the case that landed him on death row along with nearly 400 other toward inmates. the recent supreme court ruling could prove to be okafor's saving grace. we were there in november when a judge called him the organizer, recruiter and trigger man who killed 19-year- old alex saldivar and try to kill 2 others. prosecutors say it was to prevent them from testifying against him and home invasion trial. at that sentencing hearing, eyewitness news this was orange county's first case of a carefully planned murder of a witness and said that is why the death penalty exists. we know now because the supreme court found florida's death penalty system unconstitutional, the 390 current death row inmates will likely not face death. and that could be a disappointment to families like zaldivar's whose father found solace in his son's killer sentenced to death. >> we will watch this to see what happens at the

channel 9's janai norman has been there on warm -- morning. you spoke with police about where the investigation stands. what did they tell you? >> reporter: the conversation centered on this area where the crime happened. the beach is just on the other side of these hotels that line atlantic avenue right where that woman was attacked. no one saw what happened and at this point police do not have any suspects. >> he came around the corner. >> reporter: the victim is recovering from the concussion she suffered almost exactly 24 hours ago. it was around 12:45 tuesday in broad daylight when she was attacked. this afternoon we are learning in the last 3 hours, i read through the police report describing the suspect as dark skinned in his 20s with curly hair styled in a short afro, 60 tall, a scar on the less -- left side of his face wearing a gold necklace he hit her so hard she fell to the ground. >> unusual crime for the area. i cannot remember any street crimes that have happened in the area before.>> reporter: during the conversation, sergeant.

janai norman has been gathering information since then and we are learning more about the man who died. >> reporter: martie, his name is john preston and neighbors here who knew him were distraught this morning. we know he lived in this white brick home and he spent a lot of time in the shed out back but it is unclear what caused the deadly fire about 10 hours ago. the state fire marshal is in fire started around 2:00 this morning. we learned someone driving through the conway area neighborhood spotted smoke in the air and called 911. on firefighters got to the home, they say the people inside did not even know there was a fire out back. >> i woke the family up and they said that was potentially someone in the shed. >> reporter: battalion chief described it shed as more of a workshop about 1000 ft.2 with lots of woodworking tools. he says it was fully engulfed in flames and when cruz got the fire knocked down they found preston's body. >> the wife said he normally is out there late at night doing stuff in the shed. we are not sure what happened or the cause of the fire. >> reporter: we
