i'm janelle wang. >> we begin with new details in that limo fire on the san mateo bridge. investigators say it was a tragic accident. no criminal charges will be filed. chris, there were some critical new information that we discovered today. >> reporter: well, hi, there. what they're saying is that it was a failure in the suspension system that allowed the bottom of the drive shaft to hit creating enough friction that the fire started in the flammable material that the women were sitting on in those seats. the coroner says they died of smoke inhalation that they likely died nearly instantly. among the frantic 911 calls on may 4, the night of the deadly limousine fire were the voices of survivors and that of orville ricky brown, the driver of the limousine who told the dispatcher he didn't know how many people were trapped inside. >> i don't know, ma'am. i don't know. i don't know. >> i understand. you don't know. that's okay. we have people on the way. >> reporter: though there have been questions about whether that driver was on the phone during the fire, they said he

i'm janelle wang in for jessica aguirre. a developing story -- a man has been arrested in the shooting death of a 19-year-old san jose state student. she was shot saturday night sitting in a car in san jose. police say they don't know if she was the intended victim for an innocent by stander. nbc bay area's correspondent joins us with more on the investigation. george? >> reporter: detectives just out here on san salvador between 2nd and 3rd, gathering evidence for their investigation. they made an arrest, 23-year-old johnny lazano. not saying what his involvement is. he was at the scene saturday morning. the victim's family told me 19-year-old kimberly was out with her friend friday night going into saturday morning. they were celebrating their last night together as her friend was going to san diego to go back to school. police say when the car they were in drove up near the intersection of san salvador/2nd when shots were fired. and one of the bullets went into the car and struck chico and she died at the hospital. invest

. >> i'm janelle wang in for marla tellez. >>> the city of richmond is taking action against chevron. this morning, constituent filed a lawsuit against the company over last year's massive refinery fire. nbc bay area's jodi hernandez was there when the complaint was filed. she joins us live in richmond with more. jodi? >> reporter: well, it's official, attorneys representing the city of richmond filed this lawsuit against chevron this morning saying this case is a prime example of a corporation putting profits before public safety. now, we were there this morning as attorneys filed the 39-page complaint with the contra costa county superior court. that complaint alleges that chevron had knowledge of the dangerous condition of the pipe that caused last year's refinery fire, yet never bothered to fix it. now, it points out that chevron's richmond refinery has had 14 separate incidents in which toxins were released into the air since 1989. the suit says the city and the people of richmond have suffered tremendous harm from the fire and its aftermath and lawyers say it is time for chevron
