ktvu reporter janine de la vega is in san jose where investigators don't have much to go on. janine. >> reporter: brian, we're here on the east side in a neighborhood just off of monterey highway. this is a mix of homes, apartment complexes, and a church there you see there on the corner. this is where the attack happened. we spoke with a man who works at that church said knowing this happened he didn't get much sleep last night. they received a 911 call at 8:30 last night there had been a stabbing at south side drive and hope street. when they arrived officers found a latino male in his late 30s or early 40s suffering from stab wounds. after speaking with witnesses the victim had been approached by 4-5 young men between the ages of 18-20 years old. there was some sort of scuffle between them. the victim was stabbed several times in his upper torso. >> the number of witnesses we have so far on this, have not told us anything that would help us pinpoint whether or not this was gang related. that is something we just don't know yet. >> homicide detectives spent the night lookin

janine, what did they tell you?> reporter: a police spokesperson told me he's checking in with detectives right now to see if they got any tips overnight. now, they are taking that attempted kidnapping that happened here on dale court very serious. they say the man was pulling on the child's legs so hard, that her shoes fell off. this all happened around 5:40 yesterday afternoon. this was near south white and aborn. a mother said she was playing in the front yard playing with her siblings and the man made a comment that she didn't like and she tried to pull her away. >> it's very turning. it's a brazen act on her part. without locating him, we don't know what his mental state was but obviously the mother felt the need to pull the child away from her. >> reporter: the mother was able to hang onto her daughter and run into the house. the man was last seen walking away on paven drive. police canvassed the area looking for the man but they came up empty-handed. the man is described as being latino, between 20 to 30 year

ktvu channel 2 reporter janine de la vega is live in santa clara to update us on the situation there and why getting the flu vaccine seems to be getting more difficult. janine. >> reporter: rita, i spoke with a have doctor í from the public health department he tells me they are seeing more people being treated for respiratory viruses rather than the flu. he still wants to people to be protected. at kizer santa clara the staff saw an increase in the number of patients in their emergency room being treated for the flu and respiratory illness. people were given masks inside to keep the sickness from spreading. the flu has hit hard with new york being the latest state to declare a public notice. in santa clara county the numbers show that 1% had a severe case and had been hospitalized but health officials say with people traveling influenza could become wide spread here. >> the key things are get your flu shot. make sure you don't go to work if you are sick. people like to go to work when they are sick. but they are spreading the germs and wash your hands, cover your cough. >> reporter:

janine de la vega is in san jose now to tell us what the girl's mother says happened. >> reporter: good morning. this happened on dayo court in east san jose. now i just spoke to one of the neighbors. he didn't really know too much about it was completely surprised and disturbed this happened. police received a 911 call from a woman at around 5:40 yesterday afternoon saying a strange man approached her and her two-year-old daughter. she said her toddler and siblings were playing in the front and the manmade a comment about her two-year-old that made her uncomfortable. she picked up her daughter and told officers that is when the man grabbed the toddlers legs and tried to pull her away. they struggled but the mother was able to hold on to her daughter. the man was last seen walking away on paven drive. >> scary. we all have little kids here.  i have an eight-month-old. and all the kids play in this cul-de-sac. it's strange. >> reporter: now the suspect is described as being latino between 20 to 30 years old. he had a red baseball cap on. he was wearing blue jeans and

you are looking good on 280, and let's go out to janine de la vega, she is on the scene of a big-rig crash which make people use a different route. jeanine? >> reporter: we are here in the northbound lanes of highway 101 -- [ technical difficulties, stand by ] >> reporter: we are told traffic is backed up for miles because of a big-rig which crashed and spilled fuel and it all happened just before 3:00 a.m., they crashed into 40 feet of guardrail and a light pole. there is a lot of swifted -- twisted light and metal. it leaked 30 gallons of fuel onto the freeway. no other vehicles were involved but traffic is inching along in the northbound lanes. chp is working with caltrans to clean up this mess. >> fortunately this happened before 3:00 a.m. so there was not a lot of traffic on the roadway and he did only receive minor injuries and no other vehicles were hit as well. >> reporter: now the driver of the big-rig told cnbc shall -- now the driver of the big-rig was not under the influence. he did pass the sobriety test. it is waiting to be towed and caltrans workers are cleaning up and

ktvu channel 2 morning news' janine de la vega is in san jose to tell us how homeless is helping outith this very special census. >> reporter: good morning, you can see volunteers from the community as well as homeless people have been recruited by the shelterer and are coming in here to this office this morning and they will be sitting down there and listening to a presentation and they will be trained on what it look for -- what to look for when doing this homeless count this is a video of some of the homeless who will act as guides and they will help identify where some of the homeless are living. this is done every two years and last time it was done, over 7,000 were counted living in the county. officials are trying to figure out if that number has grown and this will help the city qualify for over $10 million in federal grant money. it will help assess to plan for resources in the futur and we spoke to one homeless man who wants to help. >> directly or indirectly i will be helping myself i don't plan to be homeless for now but as of now i could be helping one of my friends so..

federal funding, janine?dave, we've been trailing a team of volunteers you can see them right here as they are looking at their map, figuring out where they are gonna go next. they've taken us here to a spot near coyote creek. there is an encarmment below -- encampment below. earlier this morning, volunteers met to get matched up with a homeless guide to go through training how to do a homeless count. the teams go through cars and walk the streets and search areas where the homeless hang out. more than 7,000 homeless people were counted in the county. local officials want to see if that number has grown. now, this will help the city and the county qualify for over $10 million in federal grant money. it will help leaders assess the efficiency of current programs to help the homeless and to plan for resources in the future. we spoke to one homeless man and he shared why he decided it was important to volunteer. >> it's definitely cold outside. if we had the money, the funding, to keep keep people off the street

ktvu's janine de la vega just arrived on the scene. janine? >> reporter: we're here at 85.u can see a tow truck is pulling out this mobile dog spa, grooming van. it's called just for paws. it has gone and completely crashed into this smoke shop here located into this strip mall i just spoke with police a short time ago and they tell me that this accident all happened at 6:30 this morning. and apparently what happened is somebody who works for the just for paws mobile spa company left this unit basically unattended, was warming it up either in a parking lot or their driveway. when they came out, they found it was stolen. next thing you know, a couple of hours later, police say that they get a call from somebody passing by saying that this van has just crashed into the smoke shop called up in smoke and they saw four young men running away from the van. we don't know if anybody was hurt. as far as we know, the four suspects have not been caught. just a lot of damage left over here in this smoke shop. we just got here so we haven't been able to speak to the owner of the smoke s

janine de la vega is on the scene with an update and the cleanup. how is it going now, janine? >> reporter: well, all northbound lanes of highway 101 are now open. we're just south of fair oaks. these lanes just opened up in the last 25 minutes. you can see that traffic is flowing pretty good. i'm told the backup lasts almost until the san jose airport. now, this happened just before 3:00 a.m. the driver of this big rig drifted off the shoulder and crashed into about 40 feet of guardrail and a light pole. in the process, the right side of his fuel tank was punctured and spilled 20 to 30 gallons of fuel on the highway and the shoulder. the chp had set up some roadblocks to closes off the lanes leading up to the fair oaks exit. the driver had minor cuts to his face. but he said he's glad no other vehicles were involved. >> i make a move to the right. so quick, like that. i lost my control over there, the shoulder there on the side. that's what happened. i look. very bad. >> reporter: the driver told me that in his 30 years of driving a big rig, he's never had an accident happen.

janine de la vega is on the scene and tells us what police are saying this morning, jeanine? >>> we are here in front of an apartment complex. now police have left the scene already and what you can see is the shattered glass from the window that was broken in the stabbing. a man who lives in this apartment complex on the drive was in his car when another car pulled up. he broke the victim's window and started to stab him. the 21-year-old was stabbed twice he was rushed to the hospital and is said to have non-life threatening injuries. officers spend time talking to those they found and police say they believe this stabbing is gang related and so far no arrested have been made. right here back to where the broken glass is, we are seeing a case of beer and broken alcohol bottles but we are not sure if all of that is related in this stabbing but we do have a call into police and we will have more information if it becomes available. reporting live janine de la vega ktvu channel 2 morning news. >> in the meantime san jose police are investigating the first homicide of 2013, why

ktvu's janine de la vega was the first reporter on the scene and just spoke to the manager and has new information about what he saw onp the -- saw on surveillance video. >> reporter: good afternoon, tori. the cannabis club just opened a short time ago. they are cleaning up. they removed some of the furniture. i just got an update from the security and he says security cameras that did capture an image of someone breaking a window on the side of the building where the fire started. cleanup crews spent the morning sweeping up broken glass and debris left from a fire that started inside the health center. the fire began at 4:20 near this window located in the conference loom. the window was broken and a suspicious odor was in the air. >> it does smell like gasoline. i don't know what else it may be. >> reporter: the manager rushed here after the security company that monitors the company called it say motion detecters sensed something and the cameras smelled smoke. >> because of the broken window and several other possibilities, arson is a possibility. >> we have the odor of gasoline and

ktvu's janine de la vega joins us from san jose to explain the response. >> reporter: this is one of restaurants in the area that has expanded its sidewalks and added outdoor seating. i'm the only one out here because it's a little bit chilly out here. but one city council man says there is should be more areas like this. this afternoon, the city council will vote whether to begin a pilot program that would allow residents to replace parking spots adjacent to their business with more sidewalk place for their benches, tables, planters and artwork. under the program, five businesses would be allowed to expand the sidewalk. the program will attract more to use downtown making it more vibrant. >> we recognize that by allowing curb cafes to exist, we'll be narrowing streets and eliminating parking in some spaces. but restaurant owners believe it's worth the sacrifice. >> reporter: the renovations made for the three existing cafes were paid for by the city several yearsback but under this pilot program, the business would be responsible for paying for the work needed to transform the parki

ktvu's janine de la vega joins us live from san jose with the story. janine?e're here near 101 just past the 880 interchange. within the last hour, traffic hasp improved. we're seeing a lot more brake lights up. it looks like it may be starting again. if a driver coming from morgan hill could avoid traveling in rush hour, they could commute faster and speed up other drivers heading north. researchers from uc berkeley tracked more than 350,000 drivers using cell phone and gps devices and found if 1% of drivers would cancel their trips, traffic would drop by 14%. that means 8 minutes would be saved per hour. traffic ends up congesting quickly once the road's capacity is increased which is why researchers say one small change could make an impact. some drivers are skeptical. >> i don't think there will be a easy fix. i don't think there's a reverse commute anymore because there's people commuting from down here to where i live and then there's people commuting from where i live to down here. it's a hot mess. >> reporter: researchers say the study's findses are si

janine. >> reporter: yeah, tori.s the father who was stabbed that police told me they are still waiting to talk to the father and the son who were both pat the hospital to find out what happened here at the crown colony condo complex. this happened on the third floor of the condo belonging to the dad. police say they received a 911 call from the father who is in his mid to late 30s saying he had been stabbed. whenever officers arrived, they found he was suffering from stan wounds, one in his stomach. his son was with him and had a laceration to his head and other trauma. investigators say the two appeared to be fighting over something. they were rushed to sf general and are suffering moisture injuries. the security guard was surprised about all of the commotion because no serious crime has happened here before. >> it's a little scary. i walk around here the middle of the night and to know there's people with that capacity is a little frightening. but you know, i still think that -- i mean, the place is relatively saf

ktvu janine de la vega is in san jose where police suspect someone set a house on fire. janine. >> reporter: we're here in willow glen. this neighborhood is a safe neighborhood. looks like an upper middle class neighborhood. two and a half hours ago police and firefighters were called here to this house because it appears that somebody set the door of the house on fire. i don't know if you can tell there it's a little dark but the door is discolored. that is because it has been blackened from the fire. firefighters were called here for a report of a house on fire. when they arrived they found the front door in flames. it was quickly extinguished and the three people inside were unharmed. they determined somebody threw a flammable liquid on the door and then they it will it on fire. >> they were kind of shaken up over the ordeal. this is something that is not normal and they don't know why it happened to them. and they were sleeping at the time. they woke up to a small commotion like a bang on the door and they smelled smoke and saw the fire. they called 911. >> reporter:
