janine de la vega is joining us live now. you're at the store where the incident happened early yesterday morning. >> reporter: it was a frightening encounter that the clerk had with a robbery suspect. i went inside and spoke to the clerk. she says she is filling in because her coworker was too shaken up to come back to work. the encounter was all caught on surveillance camera which police are already revealing. two of the officers pulled up early sunday morning and saw a suspect point a girl at a clerk and shot. they feared for their life and fired at the suspect killing him. a loaded gun was found near the body. police have not said how many shots were fired but neighbors at a nearby apartment complex say they heard several. >> maybe that was the only thing they could do. very dangerous to work in those. >> reporter: the clerk that was in the store was not hurt. this is the the city's second officer involved shooting. last month an auto burglary suspect tried to mow down an officer during a traffic stop which prompted offic

ktvu fox 2's janine de la vega is in the neighborhood where it happened. but first let's go to brian flores at san jose police headquarters where the flag is at half staff. good afternoon, brian. >> reporter: good afternoon to you. i think san jose's mayor said it best when he said this is san jose's darkest day. we continue to be here at headquarters this morning the flags are remain at half staff in honor of 38-year-old michael johnson. the outpouring of support and grief was seen. this is video of the officers throughout the south bay coming to police headquarters, offering condolences and prayers. we saw officers from campbell, santa clara county sheriff,s, many of them wearing the black band across their badges. but this has been a very tough day for the san jose police department. michael johnson, the first officer to die in the line of duty in 14 years here. from the police chief to other law enforcement, we caught up with a couple of probation officers closely with san jose police and this was tough for them as well. these -- >> these guys do a job

janine let me start with you.you're a senior fellow for defense policy at the council on foreign relations. you're a former pilot and air force officer. when you were deputy assistant secretary in the obama administration huber charged with reviewing strategic plans and military plans. as recently as august you wrote america has no policy to stop isis. you used to believe that? and can you give us some sense of what is happening on the ground today? is our policy working, and are we making progress against isis? >> well, thank you for presiding and for the overview. i think you pretty much hit the outline of what's happening pretty much correct. i think what's happening now is there is a recognition that there is no short-term there is no purely military and there is no purely united states approach to this. that's going to solve it that's going to win going to defeat isis. so what we have is we have a policy to defeat isis, but we have actions that have been sort of slow. so we may have missed some windows actual

what is going on janine?er: dave, i have spoken with several people who used to live in the jungle who are now staying at the temporary cold weather shelter here at the lucardo center. tonight is the last night that the emergency beds here are going o be available. a lot of people have no idea where they are going to go next. advocates say that is just a small portion of the homeless people who are wondering the streets. they are holding a news conference at noon today at the former sign of the jungle at story and center road to talk about it. nearly 300 people were living in makeshift tents city workers cleaned up the encampment saying living conditions were dangerous. since then the homeless members have been moving from place to place. during another recent cleanup, organizers tell us that homeless woman was injured while cal tran was bulldozing their tents. >> there is a hot will of people that need -- there is a lot of people that need help. they need to have more -- even where they used to have the shel

good morning, janine. >> reporter: good morning, tori. police tell me it will be hours before they open up this section of center road near up backer. this is where the shooting happened. they are still gathering evidence at the scene. people who live in the condo complex where that all went down, they are not being allowed inside their homes. they stood and watched a slow procession of patrol cars traveling down center road about an hour ago. here is a picture of johnson who was a 14-year veteran with the department. he was among the officers who came to the condo complex on center road just before 7:00 yesterday evening because police received a call that there was a man with a gun threatening to kill himself. when officers arrived, the suspect opened fire. >> the officer's family has been notified with the assistance of our chief officers and chap chaplain. we're dealing with issues to help them through this process, unfortunately. >> reporter: san jose police's s.w.a.t. team known as the merge unit ended up evacuating residents. after

janine de la vega spoke with the homeless and city leaders about getting relief for the estimated 6,000 homeless people living in the city. >> reporter: overnight in san jose, temperatures were in the mid-40s. being able to sleep indoors at this temporary cold weather shelter has been a huge help for the homeless but tonight is the last night the beads are available -- beds are available. >> they pretty much said good luck. we hope you can find a place to go. they said be safe. >> i have no idea where i'm gonna go. >> reporter: it's been four months since the jungle was broken down by city crews. nearly 300 people were living there and now they've scattered to new neighborhoods. advocates are asking elected officials for a legal campground with bathrooms and a place to throw out garbage. but city leaders don't want it to turn into another jungle. this summer the mayor says he will launch a series of initiatives. >> one to convert hotel rooms into apartments, safe parking providing spaces where people can park their cars and r vs and live in a place where there's sewer and electrical hoo

janine de la vega has more. >> reporter: during the day it's common to see kids in this neighborhood playing. at night, neighbors i say it's common to see these. >> i've seen bats, they fly around the area. he you can hear them ticking. >> reporter: to stumble across bats is unusual but last friday, a father and his daughter were walking their dog when they spotted a bat in this grass area at niles element -- niles e rather -- elementary school. the dog picked it up. it was still alive. the bat tested positive for rabies. the dog had been vaccinated but will be quarantined. no children were hurt. the bat was not found during school hours. rabies affects the brain and nervous system. in this case, the dog that grabbed it was vaccinated but it's still being quarantined for 30 days. county vector control workers will be going door to door in this neighborhood handing out this flier telling people about the rabies alert. they want to make sure that children know not to touch an animal that may be infected. >> my husband and i took a moment to talk to our daughter who is a second grader h

janine de la vega is joining us from san jose to talk about what the mayor wants to do with that extra money. janine. >> reporter: today the mayor is meeting with the city council to talk about the budget and this year there is actually a small surplus. $8.6million. when the city has surveyed people in the past, the same issue came up. people want money spent on public safety. sam liccardo says his top priority is boosting police department staffing. he wants to restore the legal fight that has been happening between the police union and measure b. pension reforms. liccardo wants to send seth aside funding for over time for patrol officers but he also wants to add 26 new community service officers. besides that, he's also interested in buying body worn cameras for police. other plans include providing money for affordable housing that would help the homeless and keeping libraries open six days a week. there is also funding in the proposed budget for fire works for a fourth of july celebration and under the plan san jose roads would also get attention. a recent report shows they are in

janine. >> reporter: we are here at center and lewis road. police officers still have this neighborhood blocked off. about five minutes ago the coroner came and removed the body of officer michael johnson. i just want to step back here so you can see what the scene looks like. neighbors, residents in that area are still evacuated at this hour. now let's go to some video that we shot in the last five minutes or so. you can see there are dozens of patrol cars. those police officers are escorting the body of michael johnson. now this all started at 7:00 last night when police received a call from a woman saying that there was a man with a gun. he was despondent, he was threatening to kill himself. when officers arrived at the scene, the man fired at him. at least one of the bullets hit officer michael johnson killing him. offices did shoot back and then the san jose police department swat team known as a merge unit under surrounded this condo complex. they never ended up making contact with a suspect when they finally entered in the early mornin
