laura jarrett, we're looking ahead to the former fbi director's testimony but as you just heard the whitesidering to invoke executive privilege to block him from testifying. is that even possible and how would it work? >> wolf, there's two big problems with trying to invoke executive privilege here. number one is james comey is a private citizen. he does not work for the president anymore, and so the president would essentially have to send in a lawyer to court to get this done, to order comey officially not to testify, a pretty big and unprecedented move and courts have routinely found that if there's any sort of xhl or governmental misconduct then the privilege doesn't apply. the second issue here is that there are real questions about whether the president even waived executive privilege by repeatedly talking about his conversations with comey, effectively opening the door to an entire line inquiry here. >> mark preston, from a political perspective, what outcome would be worse for the president, director comey delivering some damaging testify before congress or perpetuating the appear
