jason carroll is in tulsa this morning. so, jason, do race and revenge play a part in this? >> reporter: well, i think that's one of the components that police will be looking at, specifically they will be looking at a facebook page from jake england. he's the 19-year-old that you mentioned. just a little bit of history here with england. two years ago, carol, his father was killed by an african-american man and, apparently, england really never got over that. he wrote about it on his facebook page. he used a racial slur. he said at one point, quote, it might just be the time to call it quits. he also made reference for people to get ready for another funeral. so these are just some of the things that investigators will be looking at in terms of whether or not they decide to charge these two suspects with hate crimes. i actually this morning had an opportunity to speak with the police chief and i spoke to him about what sort of criteria is used in deciding whether or not hate crime charges are brought. >> it has to be against a protected class and it has to be derogatory or

jason carroll was in the courtroom, so, jason, tell what happened. >> when jerry sandusky's attorney looking for justice. simply all of the major issues that were supposed to be addressed today are basically now are going to be put on hold so that the judge can take it under advisement. let me backtrack and explain the reason why, there are ten alleged accusers that jerry sandusky and his team are dealing with. joseph amendola said 7 of the 10 accusers the ed has been insufficient. he hasn't received enough information of where these attacks occurred. for that reason, he filed a motion with those 7 accusers, they should be thrown out. again, there were ten. the other three it was not specific enough. in that situation, those charges with the three should be thrown out as well. the prosecution has been saying all along that this is ongoing investigation. they're in the process of gathering information. turning it over. in accordance with the law, they turned over numerous amounts of information to the defense. so, the judge took a look at this and sat for moment, given what i'm hearin

jason carroll, he is live in bellefonte, pennsylvania, with the story. son, first of all, why did sandusky's defense team ask that these charges be dropped in the first place? >> reporter: well, it's a good question, suzanne. the reason for that is because they simply say not enough evidence has been presented to them at least in order to be able to build a defense. again, you've got ten alleged victims here. joe amendola, jersey sandusky's attorney, says the information they have been provided is not specific enough in terms of times, dates, locations of where some of these allegations of abuse took place, and so they said because of that we've not been able to build a defense, so they filed these motions to dismiss these charges. on the flip side of that, suzanne, you've got the commonwealth, the prosecution, which has been saying all along that we still have an ongoing grand jury investigation that's taking place and we are turning over evidence as we get it. so the judge took a look at both sides, decided to step back and say i'm going to wait until y

. >> jason carroll, thank you for that. >>> later on, the tulsa mayor, dewey bartlett will join us live. >>> a grand jury is expected to convene this week in florida, and may take up the case of trayvon martin. they're meeting as soon as tomorrow. meanwhile, protests calling for the arrest of george zimmerman. prosecutors and defense attorneys are strategizing and trying to answer some key questions. martin savidge is live in sanford. how likely is it that the grand jury will examine this case? >> reporter: we're outside of the sanford police department, just to change venue for you. it's unclear how much the grand jury would play. the special prosecutor in this case, has said in cases like this that she has overseen, she has never used a grand jury. there's no reason to think she may break that string of handling the cases, in this particular case. it's unclear whether a grand jury is needed. if that is true, we may hear at any time what kind of investigation what kind of outcome she may have. many in this community are on pins and needles. it's either going to charge, clear or send it

cnn's jason carroll is following developments for us live in tulsa this morning.us about the possibility of hate crimes charges at this hour? >> reporter: well, there are a couple of things, christine. when you look at whether or not someone is charged with hate crimes, certain criteria have to be met. the crime has to be admitted against a protected class, derogatory or threatening statements have to be used. sometimes investigators will look at past writings from a particular suspect. in this case, they will be looking very closely at jake england and his facebook postings. you'll remember it was two years ago his father was killed by an african-american man and england never got over that. he wrote about that on his facebook page and he used a racial slur. he also said, quote, he said it might just be the time to call it quits. he also made some sort of reference to get ready for more funerals. this was right before the shootings happened. the shootings happened on friday. some of these writings started on thursday. investigators will be looking very closely at

jason carroll takes a look more at the investigation including possible hate crime prosecutions. >> they the courtroom. they tai peered via video conference in jail. they are both being held on more that are $9 million bail each. they are charged with first degree murder as well as shooting with the intent to kill. the question among many here in the african-american community here in tell is a is whether or not they will be charged with the a hate crime. police at this point will be looking ve ining closely as eng facebook page as part of evidence while they're making their case. england never got over the death of his father, shot by an african-american man. england used a racial slur on his facebook page and said get ready to have more funerals. so these are some of the things that police will be looking for as they put together their case and try to determine whether or not these suspects will be charged with agate crime. in the eyes of one local city councilman, it is very clear to him. you have white males in a predominant predominantly black community shoot at five black people. a
