congressman jason chaffetz, thanks for being with us this evening. look, it's been a wild week. the production of documents that many are calling a smoking gun regarding benghazi. tell us what happened this week. >> well, we heard testimony from a general who was very candid about being in the room with the lack of response there from the military, the security profile that was in place. the fact that they actually did send documentation back to the state department saying that they believe it was al qaeda that was responsible for the attack attacks, ansar al sharia. this is just outrageous. it's just not the american way, and we're not going to stand for it. as chairman issa said, we're not just playing a gym. you have to comply with a dually issued subpoena. >> congressman, here's the problem. i know you're not playing a game. i was a prosecutor, i was a judge. you subpoena information, you don't get it, and then all of a sudden, 20 months later, somebody else has to have a court case. there are three branches of government that i don't have to tell you, and you have on the co

jason chaffetz, congressman out of utah on the house judiciary committee with me now. good morning to you. will it happen today? >> yeah, late this afternoon. lois lerner, for somebody who says she wanted to remain silent certainly did an awful lot of talking. we know she went and spoke to the other branch government, again, as many of pointed out on our side of the aisle, she waived her fifth amendment rights. when she made the statements that you just played on the air, we have a right to question her about those statements. bill: if you hold her in contempt, referred to the department of justice, right? eric holder could do nothing? >> we have a variety of other tools and i'm not at liberty to talk about those but believe me, we have thought that through. we're not just pogue to let go of this you can't just have this executive branch say that they will continue to do nothing. if we hold her in contempt of congress, there's a very serious charge. these things are not optional in this country. bill: if you have other tools, are you still in contact with her attorneys

joining me is jason p chaffetz of utah who serves on one of the committees investigating benghazi.ken critic of hillary clinton and the white house on benghazi. she is clearly coming out swinging in this chapter, saying what happened in benghazi has been used as a political tool and she writes that that minimizes the sacrifice of those who lost hir lives. what's your response? >> we're not minimizing the sacrifice at all. we're trying to highlight the fact that these four people were killed. we have to learn from that that it never, ever happens again. if you want to talk about politics there's a reason why on friday afternoon they release this. the only reason we're talking about benghazi today is because politically she wants to try to spin it her way put it behind her so get on to bigger and better things. >> she seems to suggest she might fight an appearance on a house committee, this new committee. she said, quote, those who insist on politicizing the tragedy will have to do so without me. earlier today darrell issa released a statement saying he has released secretary of stat

today on "meet the press," utah congressman jason chaffetz said there are unanswered questions. >> when have the lead security say the taliban was inside the state department are we supposed to sit back? >> sometimes it sounds like a benghazi probe and sometimes it seems like a hillary clinton probe. do they feel they have something? how big of an issue are will it be and will republicans make it if she decides to run? >> it's a huge issue. alex pointed out this week in a post someone tweets about benghazi every 12 seconds. there is still a high level of interest in the issue. now that we have the e-mail tr from the obama administration saying let's make sure to focus on the video so we can protect the president's image two months before the election and not focus on the failure of the foreign policy, that's why the select committee is so important. hillary clinton ak knowledged that event. benghazi is one of the biggest representatives of the state. this will be a big factor in 2016. >> i don't know if we can call it love but chris christie got a lot of it at the the correspondents' di
