jason miller. ryan chapman. aleta fisher. julie roberts. >> good evening. my name is jason miller, i'm from the law offices and we represent the vast majority of the charter schools in the state of california. proud to be here today represented new schools of san francisco. usually i'm here talking about sensitive matters, this is a procedural matter. new school of san francisco has not submitted a material revision. they submitted a renewal to the charter petition. therefore, the consideration of the charter revision is not applicable. material revision is eight tram of art that requires a charter school is proposing additional sites. in this case, there are no additional sites being proposed. to the extent that this was a big u.s. in law recently, it has been clarified in case on pending legislation in the senate right now. commissioner chapman will speak in a moment, to how the school is and always has been a k-12 school, one is building up and adding a grade per year. so, therefore, even if these additions are not considered part of the normal expansion

i am jason miller here from the long firm and i am proud to support renewal a k-12 charter school. at september 10th meeting i addressed the fact the single petition is renewal. new school submitted one charter without any factual support it is determined there are two petitions. i am displayed to be two separate items renewal of k-5 and material revision never requested. it would be outside the district jurisdiction had it been given because the school's current authorizer is the state board. new school is and always has been k-12. it is miss characterization of the language of the charter to suggest otherwise. in 2014, this board sited a k-12 program to deny the charter. new school as authorized is steadily adding a grade level each year. grade one was in year one. grade six will be in year six. staff reports suggest the state board upon hearing the appeal in 2015 changed new school to can-5. the state board had no such authority. the appeal by the local board to deny the charter petition must be made with de novo review. in 2014 it was a petition for k-12. we are concerned any a
