jay paterno. the son of the late joe paterno. t a lot of emotions about your father who just recently died. let me just start by asking you this. the thing that stands out to everybody who's talking about this today. the report says four of the most powerful people at penn state, including your dad, failed to froth against a child sexual predator. that's the words in the report. and failed to exhibit a striking lack of empathy for sandusky's victims. what's your reaction to that? >> well, i think -- people have to realize this report is not a legal document. this report is a -- it's a report where the burden of proof is much lower than it would be if this was a legal case or legal document. so they've drawn some conclusions here. there are really no new facts in this situation. they've just drawn different conclusions that people have. i think as this case continues to go on, which it will because there's still some cases pending and there's sworn testimony people can look at. i think they'll have a different view of what the rea

but i also want to play for you jay paterno who spoke with "the today show." listen to what he said this morning. >> any suggestion about the culture of football at penn state, you have to look at the facts of the situation. we graduated our student athletes in football at a higher rate than the students in general at penn state. there was a commitment to academic and athletic excellence in that order. >> kendall, what's your reaction? >> i think it's appropriate to some extent to talk about the many fine young people that had nothing to do with this. but today is not a day to try to spin the unspinable or to try to minimize the unspeakable. this is a day of remorse, acknowledgment and drastic reform. and i think the message has to go beyond the campus of penn state. could something like this where one of the best investigations you can imagine is talked about repeated concealment happen with respect to some academic literature department? if this had been a history department, would there be this kind of cover up in the face of at least two very graphic and d

paterno, the legendary coach. his statue has been removed from the campus. his family says the penalties you announce defame his reputation. and his son, jayn that the findings -- erin burnett, that the findings of an independent investigation claiming a cover-up should not be a legal indictment. listen to this. >> i think everybody in this situation whether it's penn state, whether it's my family, and certainly, most of all, the victims, deserve to have the truth company out and not necessarily make decisions based on what louis freeh himself called reasonable conclusions. >> do you think you should have waited for all the court cases to end before announcing your decision? >> obviously not. again, we're not -- we're not involved in the court cases. nor is the paterno family or anyone else. those are the activities of the criminal investigation system. we and the university both found the freeh report information incredibly compelling. they interviewed more than 460 individuals, examined more than 3 million documents and e-mails. they provided an examination that was more exhaustive than anything any of us have ever seen in the university
