joining us now is jay sekulow, chief counsel for the american center for law and justice.e you here. >> thanks for having me. >> thiis a monumental if i may say, monumental legal action to go after the internal revenue service. you're going to have jacob lou, steven miller, holly paas and other unknown irs officials. how did you determine them? >> the reason we listed those individuals, we based on the information that we had during the process of examination hen these groups we trying to get tax exempt we knew who we wer dealing with. steve miller said he had no idea, he coul't remember anybody's name i had the agt's names, the letters from lois lerner. we named the complaint. those who h knowledge of or actual engagement in the unlawful acts of the irs. we have listed ten or more unknowns. until we do the discovery we're not goingo know how deep or high up it went. we're going to be amending that complaint in the next week or ten days,dding another 25 organizations and additional counts in the co some areas that we have's since learned that we're concerned about. it is a

with me is the chief counsel for the american center for law and justice jay sekulow who is representinggroups that are suing the irs. he joins us you from nashville. jay, tell us about your lawsuit. >> well, it was filed this past week. there is as you mentioned, judge, 25 plaintiffs. about to be amended early next week and well up to over 35 plaintiffs. a variety of groups. some tea party, some just conservative organizations. lawsuit focuses on three things. number one, ten groups that still do not have exempt status. have not heard from the irs in some cases for over a year. we want those to be given exempt status. we want a datory judgment. and an affirmative manda story injunction again continuing acts. >> judge jeanine: i want to stop you there. not all of the audience is lawyers. what you want to do is get some judge to say you were wrong, don't do it again. every time they get caught they lie about it anyway. and now we are finding out it is beyond cincinnati. what good does a judge saying no, no, no. >> you get an injunction which tells them they have to stop. there is penaltie

so we'll get into that with jay sekulow who represents some of those groups in coming legal action. f counsel of the american center for law and justice. jay, welcome back. good to have you here this morning. first of all, i want to get your reaction? what goes through your mind when you listen to that? >> an agency completely out of control, incapable of self-governance. i suspect at this point, probably, incapable of self-correction. i mean, martha, you look at, if you were a business, and i had a client that could not produce, they also could not produce the $50 million expended, 10% of the receipts, which is $5 million. if i had a client that could not justify through reit receipts $5 million of expenditures they don't get the deduction. this agency is not only out of control, they're violating what everybody else in america has to go through in order to document its business expenditures. that is number one. number two, you could not justify those expenditures as what is called ordinary and necessary business expense. clearly it was not. number three, you've got two individuals

. >> jay sekulow, chief counsel, american center for law and justice. knee deep in this story. jay, good morning to you. >> hi, bill. bill: i don't know if the apology helped a lot of folks on the panel yesterday or not. to the point, are there more groups ready to go public or not? >> they are. we're getting inundated. we could file an amendment to the complaint and probably add at least another dozen. bill, we're getting e-mails and calls from groups all over the country. about 470 or so of these groups are targeted. now that it is becoming public and people realize they are not alone. they were part of this dragnet that the irs adopted they're coming forward. we're looking right now at amending the complaint. there could be dozens of people added to it. dozens of organization. they may be adding couple other claims, causes of action, unlawful disclosures. because that report is coming forward too. bill: what would that mean, disclosures? >> if the government discloses taxpayer information it violates the internal revenue code. that is another cause o
