let's go straight to jean casarez outside the courthouse. jean, tell us what you know. >> reporter: well, john, there were five counts altogether, but the jury could not find on all counts, because there was a road map and there were some charges of lesser offenses, but here's how it comes down. count 1, which was predatory sexual assault, a very serious felony where you are a predator, it is maximum life in prison, not guilty. count 2, criminal sexual act in the first degree, guilty. and that's in regard to one of the accusers in 2006 saying she was sexually assaulted violently by harvey weinstein in his new york city apartment right here in soho. count 3, predatory sexual assault, not guilty, the other most serious felony. count 4, rape in the first degree, not guilty. count 5, rape in the third degree, guilty. and that is for jessica mann who alleges in 2013 she was violently raped in a hotel room here in new york city. so the two most recent accusers that had individual charges that went to the jury, the jury believed them. not to the poi

let's jump over to jean casarez, she's been following this from the beginning. , what are you hearing? >> reporter: well, kate, it has been 26 1/2 hours of deliberations. this jury has labored for the most of last week, they had to come back today and now we have just gotten a note that there is a verdict in this case. you might remember on friday, they sent a note around noon saying and it was sort of speculative, but if we are hung, on counts one or three, can we be unanimous on the other counts. well, one and/or three that they were toying with, whether they would be hung, are the most serious counts of all, predatory sexual assault, which the maximum penalty it life in prison. and this is when someone, if convicted, they are designated a predator. the other counts, criminal sexual act in the first degree, rape in the first degree, and rape in the third degree. now, what the judge had said was that there would be about 30 minutes before the verdict is read, because everyone, the parties have to stay in the vicinity of the courthouse, people going into the cour

cnn's jean casarez walks us through where we stand now. >> reporter: the jury has been dismissed.ack on monday at 9:30 in the morning. they did send a note out before the end of friday's deliberations that shows that they are working very hard at the very least. now there are six accusers in this case. but three of the accusers, females that all say they have been assaulted and/or raped by harvey weinstein, are the ones that have counts that are going actually to the jury. and the verdict form and the five counts involved are predatory sexual assault, criminal sexual act in the first degree, rape in the first degree, and rape in the third degree. and the note that the jury sent on friday afternoon says if we find count one and three hung, meaning they cannot reach a unanimous verdict, and that is the most serious count of all -- predatory sexual assault -- can we find two, four, and five, can we not nab mouman mouse. they didn't -- unanimous. they didn't say which way. to find someone guilty you have to be unanimous. those are the counts of criminal sexual act in the first degree

jean casarez covered the trial for us and looking extensively at one of weinstein's attorneys and speakinge verdict. what do you have, jean? >> we will show you more in a moment, but this is a trial that began in january with the jury selection and ran four weeks of testimony, and then it came to the closing arguments and in this deliberation that went on for 26 1/2 hours. the jury did come back with that verdict. there were five counts, and the two most critical counts were predatory sexual assault, meaning that someone is a predator, and not guilty the jury said on both of those. criminal sexual act in the first degree is a serious felony emulating from a very violent assault in 2006 in new york city, guilty. rape in the first degree not guilty, but rape in the third degree, they found him guilty stemming from rape in a new york city hotel room in 2013. the defense team that i watched so closely in trial was very, very strong. they did not victim bash when they had those cross-examinations, but they were strong when they needed to be strong to show what they thought was the reasonable do

. >> let's go to our jean casarez. jennifer rogers our legal analyst is also here with us. me begin with you. is there any sign that they could be close to a decision? and talk about what these questions that they have handed in actually mean? >> poppy, you never know about a jury, right? this is the third day of deliberations. we can tell from the notes and the questions they seem to be methodically going through the counts. they sent out five notes so far. they've deliberated for 12 hours. and yesterday the notes were very interesting because there was one on mimi haley. she's one of the main accusers in this case because two of the charges, predatory sexual assault, criminal sexual act in the first degree, they are from the facts she has alleged that she was raped, sexually assaulted by harvey weinstein in 2006. now the dates they were really interested in on hearing the direct examination and cross-examination were dates of july 10th and july 26th. the 10th is when she alleges that very violent assault in harvey weinstein's apartment in soho. on the 26th is when she admi

we're talking about this, the jury, seven men, five women hearing this out deliberating day four, jean casarezhas the news for us. jean, what are you hearing? >> reporter: well, we're hearing that the jury is coming back into the courtroom, and what will happen next because the jury said can we be hung on counts one and three, obviously they cannot reach a unanimous verdict at this point according to their note, and the judge will give them what is standard, which is the charge to say continue to deliberating because we want, the court wants a unanimous verdict on each and every count. with court ending at 3:00 today, there may not be a final verdict or non-verdict in this case today. they may have to come back on monday. the judge is also going to have to struinstruct them that they cannot find guilt on rape in the first degree and rape in the third degree because one is the lesser included of the other, the elements of rape in the third degree are found within rape in the first degree. so he'll have to instruct that, give them guidance, and then send them back for the duration until court is

let's go back to jean casarez. she's outside of the courthouse here in new york city. veral questions that they've sent in on actress annabella sciorra. can you explain why those questions about her are so crucial? >> she's very important. she's within the predatory sexual assault charge. her own charge as an individual is out of the statute of limitations. it was 1993-94 but a nuance in new york law allows her to help bolster the prosecution's case for one of the fresher accusers. 2006-2013 to lend for a conviction on that he is a predator which is potentially a felony. but annbella sciorra. 1993-94, she was a very blooming actress. already appeared in a weinstein film. she was at a dinner that night for miramax and harvey weinstein asked if he could take her home. he'd done that before. nothing happened. his driver dropped her off with harvey in the car at her apartment, a very ritzy apartment. she went up to the 17th floor where her apartments were and about 30 minutes later there was a knock on the door. she answered the door and it was harvey. he pushed his way in
