joining us now to talk about th legal case going forward, judge jeanine pirro, host of "justice, with judge jeanine. he has a defense team now. we understand that some of the top public defenders in this area are going to be representing him.e >> you know what? that makes sense. when you have a public defender, you have someone who knows the. system. he knows the law. he knows the judge. he knows the prosecutors. how the courts work. and i think it's a smart move, although we don't know what's happen in the future. but he will be represented by the public defender.s >> but there is so much evidence and so many witnesses. i don't see anything but a conviction coming out of this case. >> well, there are severalwi hurdles before you get to that point. number one, is he competent to stand trial? there will be an argument that he c is not competent enough to understand the nature of the charges or assist in his defense. and then number two, there is as rumor going around and i'm sureh a lot of people think it, that he will proffer an insanity defense. as we both know, insanity doesn't work

judge jeanine pirro, host of "justice," joins us live from aurora, colorado.legal hurdle that prosecutors must get over is competency. does the defendant or suspect understand the charges against him? can he assist in his own defense? i don't know. that may not be as easy as it sounds. what do you think? >> well, you know, as someone who has prosecuted a lot of murder cases and sat on them as well, the issue of competency, and you say it very clearly, is two fold. can he assist in his own defense? does he understand the nature of the charges? i think a guy who says right away, i want to talk to my lawyer, may understand the implications and the nature of what he's facing. that is not going to be -- but it is the first hurdle, but not the most difficult. i suspect based upon rumor and what's being said around here in aurora is that the insanity defense, which is an affirmative defense once professorred will be the real issue. i was at a press conference with the chief, the mayor, the governor, and the precise issue really is whether or not the deliberative and

judge jeanine pirro, so it's a court appearance for the suspect tomorrow morning, probably a pretty perfunctoryally we thought it was an arraignment. in arizona where it happens-- >> colorado. >> colorado, the way it happens they have an advisement hearing and that basically means that the defendant and miss attorney advise that they're under investigation or that the defendant is under investigation and then within 72 hours, the d.a. has to file an information of some sort and that kicks in a probable cause hearing, and then the system begins, it's a little different in colorado, than it is in other states. >> so, are we going to be hearing the entry after plea or do we know that yet? >> i thought that we'll even hear an entry of a plea plea, it's not an adversarial hearing, it's an advisory hearing. that's what they call it. it's an opportunity for them to be advised of what's being investigated and for most people they might need that, and in this case it's quite clear that i don't think that james holmes or his attorney needs to know what he's being investigated for, but, we understand that
