let's bring in jeff brown. explain what the court said about this inmate and this intellectual disability. what does that really mean? >> we used to call that somebody mentally retarded. what happened they had a case of 2014 which basically did away with the law in florida and said that the florida test whether someone is intellectually disabled was too rigid. in the us supreme court said you can't have a fine line like that. you may have people that have iqs a 75 more but with other factors are intellectually disabled. after that case came about, florida had to look at this particular case and decided whether or not the judge should a given a hearing. in this case, the judge did not allow him to go forward because his iq, at least at the time that he was under 18, was higher than 70. this case says the florida supreme court is acknowledging th case is retroactive and they are saying that he now needs to have a hearing with the judge to determine whether or not he is actually intellectually disabled. >>mark: it
