i agree with jeff and gloria it makes the issue, puts the issue of the supreme court front and center and shows why the congress should move, still move on the nomination of merit garland that president obama put forward. more importantly shows that if you're a voter who wants to send the country back 100 years in terms of judicial progress, if you want no women's right to choose, if you want no gay marriage, if you want unlimited campaign, corporate campaign contributions, you want to appoint judges donald trump says he will appoint and send the country back 100 years, the choice is clear. you can vote for trump but the stakes are very high. >> kayleigh, doesn't it make a good argument for trump who can say look, if you vote for hillary clinton, you vote for president obama's immigration policy which the court struck down. >> it makes a strong argument for donald trump. he can expand beyond immigration and get to the constitution. a lot of americans are frustrated with this president's view of executive power. he, himself, the president said 22 times i do not have the power by basically denying deportations to change the law. he said in that univision town hall, i can

garland has been nominated. this court is divided on a knife's edge between the democrats and the republicans and the presidential election will determine who controls the court. >> jeffny is with us as well. the political fallout from this in the election and in general could be significant. >> it will be significant. jeffrey is absolutely correct. had scalia still been on the bench, this certainly would have been a 4-4 decision. i was looking back at what he said when it was argued. he said i don't think it's a good thing to -- it's clear where he would have been on this. republicans on capitol hill are still a little bit uneasy about this presidential election overall. obviously with donald trump as the nominee. but look for a possibility for merrick garland to get one more round of possible consideration. there are still many republicans who think they ahe is the best will get. this will highlight the importance of the court in the presidential contest. we've not had any reaction from the campaign specifically, but look for that to come. that's why this is the most critical issue here in this campaign. >> because you will hear the republican presumptive nominee, d
