leon: jeff goldberg joins us live. jeff: evidences from the prosecution showed schmuhl doing surveillance on this home before the attack. schmuhl's attorneys claim their client was too intoxicated on prescription drugs to know what happened in the attack. that is what schmuhl sarred today. >> the police chase and the arrest that followed the attack was dramatic and intense. but andrew schmuhl testified today he doesn't remember any of it saying any detail of the attack itself. which happened at the home of leo fisher and less than two weeks before that fisher fired andrew's wife alicia from her lawyer job at a firm in arlington. when questions by the prosecutor about the incident schmuhl repeatedly replied, "i don't recall. i don't remember." schmuhl testified that in the months leading up to the crime he was miserable with the chronic back pain. he says impaired his memory. but they showed picture of him doing roofing work with his father to imply he was healthy. they questioned on every portion of the crime and the pl

jeff goldberg has the conclusion to a case that has gone on for nearly three hours and may not stretch beyond next week now. jeff: they confirmed that adam torres is set to be released from jail on year in jail but he has served more than ten months with good behavior. the hearing didn't last too long in fairfax county. adam torres was given the opportunity to make a statement but he didn't stay anything. he has expressed remorse for the shooting in previous court hearings. we did hear from john geer's mother ann who read frustration with the plea deal. john geer was shot and killed by torres, then a fairfax police officer in a standoff at geer's townhome in springfield in august of 2013. geer was unarm and had his arm hanging in doorway at the time that the one shot was fired. before trial in april attorneys reached a deal for a guilty plea of involuntary manslaughter and a 12 months jail sentence. >> i would lime -- like him to have gone to the penitentiary for some years so everyone can learn a lesson that the police are prosecution. >> adam torres is moving on with his life. that i

jeff goldberg has reaction to this. : this historic 4-4 ruling from the high court being delivered with only a nine-word written statement that reads -- "the judgment is affirmed by an equally divided court." this decision co enormous disappointment for the millions of undocumented immigrants who would have benefited had the decision gone another way. those opposing the ruling making their voices heard all morning today at the supreme court. the case brought by the attorney general of texas, a republican, who represented 26 states opposing president obama executive action to allow estimated 5 million undocumented immigrants who are parents of legal permanent residents to be spared from deportation and gain work permits known as the dapa program. the lower appeals court struck down the president's plan in the 4-4 ruling upholds the appeal. meaning, the executive order cannot go forward. many of those impacted say they will continue the fight by voting in november by the candidate who supports the president's plan. hillary
