i want to bring in jeff toobin who i'm sure has access to this. jeff, let's run through this.uilty -- looks like first -- is it every count but the two counts in which the jury is hung, guilty? what are you reading? >> you know, i don't have the verdict. i just saw that he was convicted of some counts. so you better go ahead and read what you have. i just saw that he was convicted of something. i don't know how many counts. >> here's the something. from what i understand, looking at this, count one through 20, guilty with the exception of counts 11, hung, that is attempted extortion, and count 16, hung, attempted extortion. every other count, guilty. what do you make of that? >> well, this is a complete, complete victory for the united states attorney's office. and it took a long time. it took two trials. but rod blagojevich is going to go to prison for a long time. federal court, they don't mess around in terms of sentencing in white-collar crime. given the seriousness of these charges, given the abuse of such a high office, he is looking, i would say, at at least five years

. >> jeff toobin now, to sort throw out all of the grandiose language here, what we're talking abouteral rules of civil procedure. at least, that's what the court said today. it has nothing really to do with gender discrimination. >> right. i mean, the issue here was do these million women who were the plaintiff class, do they have enough in common, are their situations similar enough to each other so that they can bring the case as one case? and the court says no. and i think, you know, this is characteristic of the roberts court, which has been very suspicious, very hostile to large civil litigations where corporations have to devenfend themselves, particularly when the accusation is not so much that person aqua a bigot, but the allegation is that statistically, women were disadvantaged. that is something this court has been very hostile to, and that's why they lost here. >> eleanor holmes norton, the bureau of labor statistics reports the average female worker earned something like 80 cents for every $1 earned by her male counterpart. so, at what point do you actually think we'll

joe johns went down to north carolina for edwards' court hearing today and joins us with jeffrey toobin. jefftalk about the words that edwards used. why were you saying that's so important? >> because this is what's called a specific intent crime. this is a crime that you're only guilty of if you intend to violate the law. the classic example of a nonspecific intent crime is speeding. if you are speeding, the cop doesn't care if you didn't intend to speed, you're guilty. but in this, you have to intend to violate the campaign laws by getting this money to rielle hunter through these two very rich people. and he's saying look, i knew they were giving her the money, but i wasn't thinking about campaign finance laws, i was thinking about protecting my wife from this embarrassing information. this was not about campaign finance laws, so i didn't intend to violate the law. that's what he's saying in the statement. >> that's why the intention is so important? >> correct. >> if anyone says he's very wealthy, i've heard rumors and stories about it, but why couldn't he have just given her money direct

our senior legal analyst jeff toobin on the phone from new york. , the decision has been made and not every parent very happy about this. >> well, be you know, this has been a very tough issue for the supreme court. it was a very divided court at oral argument but by a 7-2 vote today the supreme court said that california's attempt to limit the sale of violent video games is unconstitutional. they said it's a violation of the first amendment. it underlines that this supreme court liberals and conservatives alike have a broad notion of freedom of speech protects and they are hesitant to approve any sort of restriction even one like this which on the surface has a lot of appeal. >> and two, we've done a number of the stories on cnn about research that exists about the influence of this violent video games on the kids. how did that weigh at all? how is that brought into the decision? >> well, it did weigh in, and the court said that when you are dealing with restrictions on speech, when the court looks at a case like that, they need proof that this is

i want to bring in jeff toobin, senior cnn legal analyst. heard dana mention all the attempts in the past. the senate rejected the bill in 2009. in addition to the last three attempts, jeffrey toobin, what would be different this time around? >>. >> the state is different, the country is different. the polls have changed on this issue. in the early and mid-90s, the polls said two to one americans were against same sex marriage. nationally, same sex marriage now ekes out a slight majority, but in new york state, there is a substantial majority in favor of same sex marriage. politicians ultimately respond to the will of the voters and the voters have changed. now, that doesn't mean same sex marriage is going to change. as someone who's followed the new york legislature for many years, it's a mysterious place, and strange things happen. clearly, public opinion is what's driving the difference. >> as dana played out. there are concerns on one side about the language and possible unintended consequences. specifically concerns of the bill that wou

candy crowley joins me now with jessica yellin and jeffrey toobin. jeff, obviously the point of a grand jury is to keep things secret. on the other hand, the indications that this case is coming to a head tomorrow are coming from a source that cnn feels comfortable relying on. how strong is the case against john edwards and what are they looking at? >> this is a paradoxical situation. here he is, his wife is dying, he has this affair. they construct this ridiculous story that andrew young, the aide, is the father. and they get all this money together to give to rielle hunter. that's a very ugly, unappealing story. what is unclear is whether it's a crime. because this is potentially a violation of the federal election act, and the federal election laws are rarely used in criminal prosecutions. and whether this money was a campaign contribution or simply a ruse to take -- to deceive his wife, having nothing to do with this campaign, that's the factual and legal question that if there's a trial, will be probably the central issue in the case. >> so he could

toobin. thanks for joining us, jeff. >> hi, sanjay. >> so jeff, we've talked about this before, but what happened in this hearing here? did the judges sound like they would support the law or throw it out like the judge in the first trial? >> well, you know, this one was a little hard to tell. just to put this all in a little perspective, there have been a lot of these cases all over the country, kicking around the federal courts. so far, three district court judges have upheld the law, said it's constitutional, two district court judges have said it's unconstitutional, including the one in florida. >> right. >> and these cases are starting to move through the appeals process. this summer there are four federal appeal courts hearing these appeals. one was heard about a month ago. the one was this week in atlanta. the first one that was heard, sounded like the judges were pretty sympathetic to the constitutionality of the law. this one i think it was more ambiguous. but it's always hard to read from judges questions how they're ultimately going to vote in the case. i don't think we can say anythin

let's bring in our senior legal analyst, jeffrey toobin. jeffnine supreme court justices agreed that the size of the case was simply too big under current class action rules, but they split 5-4 on whether or not walmart had a policy of discriminating against women. were you surprised by these rules? >> you know, i was in the courtroom for the day this case was argued, and there was not one justice asking questions who displayed much sympathy for this case going forward. too big. this case was too big. there was not enough in common among all these plaintiffs, and so it's not a surprise that even the liberal justices agreed that the case had to be thrown out. >> do you expect much smaller class action lawsuits to go forward as kate just said, maybe dozens of women or a few hundred women? >> well, certainly that's possible, but the economics of the lawsuit are very important here. i mean, it's very expensive for plaintiff lawyers to gather the information necessary for these lawsuits, and one reason this case was so big is that the payoff potentia
