jeff toobin, the judge just threw out that last-ditch effort by the defense to try to knock down the number of counts here and said, nope it's one year in jail for every count. she gets three years credit. really that is about a year, right? then pays $1,000 for each count. but here is what was interesting. the issue of appeal. i bet some attorneys are saying, are you kidding me? how much better can it get? why appeal? >> yeah. this was a surprise. most people convicted of misdemeanors do not get prison time in florida or anywhere else. this judge was clearly appalled at the nature and kept of the lies that casey anthony told to the police and just hearing them again in court, we are all reminded of just how sinister and awful these comments were to the police, and the judge did the max. he gave her the longest possible sentence he could give, which is four years. four one-year sentences to be served consecutively. now, there's a bit of legal confusion or complication, i should say. because it's not as simple as a four-year sentence. because she has served for nearly three years, i b

jeff toobin, i want to ask you, clearly the prosecutors are not happy with this because they were soo you think was missing in this that just -- that the jury couldn't find -- came up with their decision? >> well, the pattern with jurors explaining their verdicts is that they almost never say that the conduct of the lawyers mattered one way or the other. i am almost certain you will hear that today. i don't think the lawyers matter that much. we who are following the cases pay attention to the lawyers, but the jurors always talk about the evidence. in this case the overwhelming piece of evidence that the defense had in its favor was no cause of death and no time of death. there was never even a theory of when or how or even -- why casey anthony killed her daughter. there is certainly a lot of evidence that she behaved terribly. that she lied about all sorts of things. but in terms of murder, much less first-degree murder, intentional murder, there really was a big gap in the evidence. i certainly expect that when these jurors come to explain their verdict, the failure to prove a time

i spoke a short while ago with our senior legal analyst jeffrey toobin. jeff, thanks for joining us on this. casey anthony will get out of jail next week and go free after her not guilty verdict. can you explain to us how the judge came to, all right she has to spend another week in jail? >> what happened was she was acquitted of the serious charges, but convicted of four misdemeanors, which involved lying to the police. the judge gave her the maximum, but misdemeanors only come with a maximum of one years each. so he sentenced her to four years in prison to be served consecutive, but she's already been in prison for almost three years, and florida, like most states gives prisoners credit if they behave well in prison, as casey anthony apparently did. with those credits, she essentially has already served the equivalent of four years, so by next year she will have completed her sentence with the time she served. >> by next week? >> i'm sorry. by next week, yes. >> so he didn't really have any discretion, this was a mathematical? >> he certainly had discretion
