also senior legal analyst, jeffrey toobin, fran townsend, john king, juliet is here. also jeff beatty. fran townsend, from your perspective, what stands out, what questions do we need now answered in the coming days? >> reporter: well, it's motivation, and the president -- the president himself said that in the white house briefing room. we want to know in the coming days what motivated these two men who had spent most of their lives in the united states. we know some about the suspect. we know that they had some relationship, if you will, or belief in an extreme form of islam. and i think that's why you heard, anderson, the president say that we shouldn't sort of assume bad motives to an entire group. i know from talking to a number of sources across the federal government they're concerned about hate crimes. and they don't want to see that happen. so this is -- they're trying to keep the american public focused on the actions of these two people. one's dead, one's in custody. we will get to the bottom of what the motivation is. to stay focused on the fact that the actions of

jeff toobin, thanks, juliet as well. with so much attention focused on the bombers, we of course want to focus on the victims. the funeral for krystle campbell is underway right now. 29-year-old killed watching the marathon with a friend near the finish line. the mass at st. joseph's church in medford, massachusetts. her family asked cameras not be allowed inside. there you see her being brought to the service. campbell went to the marathon almost every single year. she's been called hard working, a popular restaurant manager, more than willing to get her hands dirty and support her staff. her grandmother says she was always smiling and big help to her when she recovered from a medical procedure. hundreds of people showed up for campbell's wake which happened yesterday with the line stretching around the block. so many people wanted to pay their respects. she died just a few weeks shy of her 30th birthday. >> dozens of people wounded in the bombings are still in the hospital one week after the attacks. we are just learni

. >> gloria, as jeff toobin pointed out earlier in the 8:00 hour, even if the father does come, he has no right to meet with his son, and if he did, law enforcement could very easily eavesdrop on that, listen to that, and anything that was discussed could be information they can use. there's no privileged conversation between a father and son. you also have information about the kinds of questions investigators are now asking about the brothers and their families. what are you hearing? >> right. and first of all, they're asking questions about the russians, we don't know, for example, anderson whether they were monitoring tamerlan when he went back to russia. we don't know the answers to those questions. we have to find out what was in their files. they're looking into the parents, the asylum. why were they looking to go back to a country they said they were prosecuted? they obviously want to talk to the wife about what she knew. they're asking questions about income, where he got his money, was he subsidized. did he do it as investigators are looking at, did he sell drugs? there are a

jeff toobin, i want to bring you in just quickly on something that professor dershowitz just brought up and foregoing possibility of death investigation by continuing the investigation right now while there is no miranda, isn't it just a simple if he does not invoke on his own a desire for an attorney and offers up information effectively even offers up some kind of a confession, can't that be used? >> well, not if -- again, this depends on the scope of this public safety exception and whether the courts agree to it. there have been -- the supreme court has a case from 1984 which says that under certain narrow circumstances where there is in effect a ticking time bomb, it's okay to ask questions without miranda. but the limits of that are -- have never been precisely defined. the obama administration said 48 hours, but that's simply their interpretation. now, this hole miranda issue though i think we can overstate its importance. all miranda does is restrict whether those statements can be used against tsarnaev himself in a court case. they can still use all this other evidence that

i want to bring in paul callen, jeff toobin, and i want to bring mike sullivan back, acting director of the atf. thanks to all of you. can you explain, jeff, what's happening? i want to get the exact phrasing right of my understanding. that the high value designation group is the group that is now going to be able to question the suspect under the public safety exception to the miranda rights. they don't have to read the miranda rights. can you just explain that to me, what that means? >> okay. let's just start by addressing the question of is he in any physical condition to answer questions under any circumstances? his health is obviously in grave peril. so this all may be moot because he may not be capable of answering any questions with or without miranda. but assuming he is in don answer questions, the federal government has established a policy that says in certain very limited circumstances, for certain brief periods of time, there is a public safety exception to the usual requirement that suspects have to get miranda warnings. this arises in the so-called ticking bomb circumsta

jeff toobin is standing by, senior legal analyst. jeffrey, from a legal standpoint, assuming this person needs medical attention, what happens now? as the wheels of justice begin to move? >> the first thing that will happen is that the u.s. attorney's office will prepare a complaint, which will be an affidavit by an fbi agent which will lay out the basics of the case against him. he will then be arraigned. he will get a defense attorney and he will have an arraignment. in normal circumstances, someone arrested on a friday night would probably not be arraigned until monday morning. just because of the extraordinary circumstances here, he might be arraigned tomorrow if he's in medical shape to be arraigned. at the arraignment, two things will happen. there will be a discussion of bail. he will not get out on bail, obviously. but they will set what's called a preliminary hearing 30 days forward. the preliminary hearing will not happen. what will happen is in those 30 days, in the next 30 days, he will be indicted by a grand jury with th
