jeff toobin's back. legal analyst and former federal prosecutor sunny hostin as well. mean, jeff, the argument made by rice that basically he's getting punished twice. originally he was told to have a two-game suspension and then this new thing and that's unfair. >> article 46 appears to say that if you're punished by the team, you can't be punished by the league. if you're punished by the league, you can't be punished by the team. however, the one thing i really want to caution everybody, this is really complicated. you have the intersection of the union agreement, the players contract, the nfl's own rules, and these things take a long time. i'm not in any position to predict with certainty how this will be resolved. but once this appeal starts the lawyers take over. and this could get complicated and the resolution is uncertain. >> it's interesting now miguel saying that roger goodell saying i was kind of misled. that's not what we heard from the coach of the team in that press conference where he said no, nothing ray rice said was any different -- everything that's c

joining me, jeff toobin. >> and this just keeps coming, arizona cardinals, jonathan dwyer, a second stringack, important part of their team coming over from the pittsburgh steelers. and these allegations came from two separate incidents in july involving the woman who was the mother of his child. and after the incidents she actually left the state and left him with the child. so the investigation has taken a while as they have tried to get out of state medical records and court documents, things like that. but they actually pulled him out of practice today to question him and he is being arrested and booked pretty much as we speak. >> and the vikings decision to deactivate peterson was really interesting. it was not even out of fans or the public's response, it was when sponsors -- >> or a sense of moral responsibility. i mean, got forbid that anybody employ that around here. >> but it seemed as though when one sponsor spoke out, that is when the decision was reversed. >> and the sponsors were acting because the consumers were upset. it is all a domino situation. they scribble something ou

back with me, jeffrey toobin, anthony gray, and attorney for michael brown's family. jeff video is important? >> very important. trials have become a much more high tech end prize in recent years. what you can see coming together here is a -- a reconstruction that, that that prosecutors, if this case goes to trial of all of the different witnesses. you could, you could create a graphic. of where the witnesses were standing. and look at what they saw and where they saw it. pull it all together. so far the narratives are basically very consistent. virtually all the witnesses who could see and have come forward that we know of. say michael brown was shot while his hand were in the air. if that's true. if all of the witnesses say, that michael brown was shot with his hand in the air. this could be a very damaging case against officer wilson. >> anthony, obviously an attorney for the brown family. working with benjamin crump. what do you make of the video? >> the same thing. the significance of this video is huge. i want-up to think about this. just how major it is in my mind.

. >> jeff toobin, throwing cold water on maybe some motives here. >> cold water, yes. the jihad spirit is out there in the world. individuals can do terrible things by themselves in the name of it. when i started following this story, i thought of the brothers in boston who at this point we don't think were connected to any larger terrorist group but they apparently -- >> they were inspired by events overseas. >> right. and in almost a similar words talked about afghanistan and iraq and violence against muslims. and if they are guilty and certainly the evidence against them looks very strong, it was an independent terrorist act. this too could be an independent terrorist act. evil people find motive where they want but it certainly doesn't suggest al qaeda as a group was involved. >> so far as far as charges go, murder. >> right. >> right. murder. basic run of the mill urban murder. >> could they based on what we know of other examples, at what point would it get ratcheted up to domestic terror? >> there would have to be connections to someone else. some other person i

"outfront" now jeff toobin and our legal fellow at the heritage foundation.his man serving more time than murderers do, than rapists do. how can that be fair? >> i don't think it is fair. i don't think many people thing it is fair. under the old sentencing scheme in his state, he was a three-striker. the prosecutor who sounds fair to me, said he's a career criminal but he served his time. under that old sentencing scheme, there were 14 bricks of marijuana during this drug transaction, you get life without parole. >> so you're saying that's the law? it sounds like you're saying he should be able to go free now. but you don't have a problem with someone spending the time he spent in jail for possessing pot? >> i actually do. i think for the most part drug laws especially with respect to marijuana are fair in this country. i know jeff probably disagrees with me. this case is an outlier. one tenth of 1% of state prisoners are in for marijuana. they had on average 115 pounds of marijuana, 156,000 marijuana cigarettes in their possession. they weren't really using

how you go from unconscious to one, to no injuries. >> thank you, jeff toobin joining us, and espn analyst louis riddick, rachel, this certainly seems to raise big questions about the credibility of the nfl, certainly roger goodell. >> yes, hugely damaging. look, it has gone from bad to worse. it was bad last night when roger goodell went on television and said it would have been quote, illegal, for the nfl to get the video. there are all sorts of ways the nfl could have gotten the video including from ray rice's lawyer who the casino said was telling anybody freely they had the video. it gets so much worse, miguel was talking about what was a clear electronic chain that the reporter witnessed. meaning there is a stamp on that voice mail describing the phone number at the nfl offices that the voice mail came from. the time and the voice mail where it said i have seen the video, and you're right, it is terrible. so clearly, somebody had seen the video. this is a huge problem, and not just for the public. with y we now have nfl players coming out against this because roger goodell is flat ou

i want to bring in senior legal analyst jeff toobin and larry sabato. it's great to see you. have to say, i'm surprised. i'm stunned. i saw the case outlined and it seemed like a concrete case but you never know what's going to happen when it comes to a jury. months and months of shocking, soul-baring testimony on the courtroom. jeff, are you surprised at all? >> no. jake, here's a lesson for you. in case you are governor of a state some day or any of our viewers who might become a governor some day. if some stranger, someone you don't know who wants to do business with the state suddenly gives you $170,000 in gifts, that's not because he likes you. that's because he wants something. and it was so obvious in this case that this sleazy businessman with his ridiculous product, the tick tack man as he was known by the governor's sane was trying to get benefits from the state, some of which he got. the jury didn't take long. this was not a hard case but it was a sleazy and repull sib one. >> i'm surprised whenever somebody powerful gets convicted. maybe that's the cynic in me. la

you may have heard jeff toobin say that on our air over the past 24 hours. that's why it's a fallacy that domestic violence victims press charges. they're not the ones pressing charges, the police are pressing charges. they are witnesses in those cases and sometimes they do, like this, choose not to testify. the government still has an obligation to go forward because it is a larger problem and that is what happened here. it's complicated. there's shades of gray, all kinds of pressure from all kinds of people with domestic violence victims to have them feel like they have to have some solidarity with their abuser. they have a child together. she loves him. it 1 complicated. but it's still not her fault. >> it is complicated, it is not her fault. we do understand the pain in seeing this video again and again. but wade, without this video at this point, the ravens would not have cut him, the nfl would not have suspended him for the season at least, we were talking just two games before yesterday. do you feel like the nfl still has more questions to answer here
