striking down texas laws which would have impoelgsed further restrictions on abortion clinics and, jeff toobin and jonathan turley are with me in studio as well. jeff, this really shows how much justice anthony kennedy is really the story of the supreme court in the session. >> anthony kennedy has been the swing justice, the pivot on which this court turns for two decades. it is really a remarkable story. we saw it earlier this week, last week, when he wrote the opinion upholding texas, the university of texas' affirmative action program. and here in an even bigger landmark decision, the most important abortion rights case, abortion rights victory since 1992. they struck down these restrictions in texas that made it virtually impossible for many clinics to operate. which will almost certainly lead to the striking down of restrictions in other states as well. so it's a very important victory. >> that ruling and that raleigh were not enough, there's been another supreme court ruling that we want to bring you the news about, this one involving the criminal conviction of former virginia governor r

. >> let me bring in jeff toobin.n a legal standpoint donald trump kind of has been relitigating this case in the statement today that he put out. this judge though has actually ruled in donald trump's favor several times in the case of this lawsuit. the very fact that this lawsuit is not moving forward until after november is because the judge ruled that way. >> and in fact the party with the best chance of appeal in this case is the plaintiffs, not the defendants, because in the key ruling in the case, not the scheduling which certainly went donald trump's way, he ruled that the plaintiffs in this case are not entitled to complete refunds if they win. each plaintiff is going to have to argue what percentage of the fee that they paid to trump university that was a ripoff. so it's going to be a person by person determination of how much, if any, these plaintiffs lost. that basically kills the whole idea of a class action. and it's not even clear that the plaintiffs can proceed under that theory. so, i mean, this is a

toobin, and senior washington correspondent jeff zeleny. gloria, what are you hearing about what happened behind the scenes? >> i think the timing of this was a surprise to everybody except trump's family but this had been talked about in inner trump circles for quite some time. i think there are a couple of things going on here, one of which was corey lewandowski's management style, which is brusque and difficult for a lot of people to deal with. the other was friction between corey lewandowski and paul manafort on the campaign. and the third part i think was that his children, ivanka in particular being very emphatic about it as well as her husband jerod kir shall ner, went to donald trump and said this isn't working. this isn't working. i think the family was really behind it, trying to point things out to trump that perhaps he hadn't seen. i think in the end he listened to them, but it was a campaign that was falling behind

i want to bring in jeffrey toobin and dana bash. jeff, first to you. let's go back to the big decision on abortion. 5-3. this is it. we expected it could be 4-4. then it would have difficult for abortion rights activists in that state. it means what for the rest of the country? >> ashley, we have spent a lot of time appropriately talking about justice scalia, one thing that today and this last week's decision reminds us, this is still anthony kennedy's court. where he goes, that's where the majority goes. four liberals can't do anything by themselves. they had anthony kennedy with them today. this is a decision of immense significance. it is not just texas. it is louisiana, mississippi, wisconsin. many states have passed increasingly restrictive rules on abortion clinics in recent years. what justice brier's opinion says, unless you, the state, can prove that these restrictions really do benefit women's health and not just pretext to make it harder for clinics to stay open, these restrictions are going to be struck down. there are lots of challenges co
