jeffrey, unpack that argument. >> the 1st part of that argument was a red herring. digital private school that you have to suppress speech? maybe it wasn't quite as obvious then, but it's as obvious as it gets now, that's a nonstarter. this was a public school phenomenon, because it forces the state that is forbidden from restricting speech, and the state has the most interest in would be public schools not private schools. as for the private school, i found it interesting with mister johnston's argument is the narrowness of it. he emphasizes again and again that this is pure speech, it doesn't involve any other activities, there's no jumping up and down, there's no protesting, no marching, there is no indication that it's interfering with any other aspect of school life, school discipline, and that's what he hung his head on throughout the entirety of the argument. is that the school had no evidence that this was a problem. but implicit in that, is that if there were evidence of a problem, if there were evidence of something a little bit more, then maybe you could
