[applause] >> well, well known author, jeffrey toobin is joining us here in new york city at book expo america to talk about his new upcoming book, "the oath: the obama white house v. the supreme court." mr. toobin, went to concentrate on the versus prior. is there -- [inaudible] >> you bet there is. this is a moment where we have a liberal democratic resident and a conservative dominated the supreme court and issue after ratio, you see a real conflict. the >> what are some examples of the conflict? >> the most dramatic we have already seen is the case where the court struck down the miss from corporate giving campaigns, but in a broader sense, set in motion a process of tea regulating american campaigns. and in a remarkably vivid demonstration of the conflict, many people were a member of the 2010th save the union address, what the president attacked the spring court to their face and samuel alito and beyond and shook his head and said not true. and the supreme court often just an abstraction. what i loved was that was not abstract. it was concrete and he saw the conflict. of course t

he is sentenced to 20 years to life and fast forward 32 years later, jeffrey toobin is sitting at thein new york to talk to me about this parole. thank you, jeff. my first question has to do with a quote. i have to read it for you. i couldn't believe it. in 2000, a member of the correctional association of new york apparently was talking to an a.p. reporter and said this, and i'm going to quote. "if jesus christ returned to earth for the sole purpose of decreeing ta it would be appropriate to the release mark chapman, the parole board wouldn't be willing to take the political heat they would get by doing it." is that what this comes to? >> well, i think that's part of it. but you know, there are some crimes where life in prison means life in prison. and i don't think anybody would mourn if mark david chapman spent the rest of his life in prison. he has not reformed in the way that some people have. and given the magnitude of this crime, given the level of premeditation, given the horror of it all, it is not surprising that he's going to -- that he's been locked up all this time and he

the guy with the answer is our senior legal analyst jeffrey toobin. thing i thought when they put forth this motion to get rid of judge lester is they mighting going for a stand your ground hearing because it is the judge and the judge alone that decides if this goes to trial or you walk out a free guy. that may not not case here. >> that's right. the defense in this case is weighing whether to have a stand your ground hearing which is does the law that we have discussed so often which says that you can stand your ground or respond if you feel like you're threatened, does that apply, or maybe they'll go to the judger and say this was self-defense, end of story, ignore the stand your glound law altogether. the defense said different things publicly and don't have to make a decision yet. that's a possibility as well. >> the strange part is zimmerman's attorney intimated last week without question they were going forward to try to prevail in the stand your ground hearing. then this week he is suggests, you know, maybe not so. maybe we'll go with the stan

he sat down with our jeffrey toobin and "the new yorker."ve been really, really wanting to know what this guy had to say. you spent several hours with him. >> i did. >> over a couple of days. >> i did. >> a lot of heart-to-heart conversation. everyone's wondering why he hasn't been charged along with other leaders at penn state. did you get an answer? >> i went into this gnu like a lot of people. i was so horrified by the jerry sandusky scandal. i wanted to see all these people thrown to the wolves. but spanier has a story. spanier says, look, sandusky was horrible, but i did not know. and there are two incidents at the heart of the freeh report. the 1998 incident and the 2001. and we went through those in considerable detail. and he says, in 1998, i was copied on a couple of e-mails. i did not know. and by the way, those were, in fact, reported to the police, that incident. and the police declined to press charges. the 2001 incident, he's in a much more vulnerable position and it's a more complicated situation. >> let's talk about the freeh

more about the legal implications of governor jan brewer's order is cnn senior legal analyst, jeffrey toobine obama white house versus the supreme court" which is coming out next month. jeff, good to see you again. i guess we should start with the basics here among other things denying state driver's licenses and public benefits. obviously a lot of our viewers are going to be asking, can the state of arizona actually do that? >> you know, joe, i wish i could give you a categorical answer. but as the supreme court illustrated, just earlier this year this is a very fraught and complicated subject. you recall they struck down three of the four provisions of the famous bill 1080. and they split over -- different justices saw it different ways. i suspect you'd have different judges seeing this differently. just put this in a little perspective. what president obama did was he said for this group of young people who had been brought to this country illegally when they were children and had good records ever since, they got deferred action. they can stay in the country. what governor brewer said is
