i want to bring in jeffrey toobin on this issue. i'd like to always look for the defense in certain issues. he certainly did lay it out. he said there are 85 million appointments made every year within the veterans administration. he also said that this is a compounding problem because we've been at war for a decade and many of our existing veterans are also aging and therefore needing more care. ultimately, is this any defense, given what drew has been able to very clearly lay out, is there anything that could be considered criminal here? are there any laws that are broken? is there any recourse for those people who have been so badly affecteded? >> well, you have to draw a distirngs distinction here between an overwhelmed bureaucracy which simply can't treat everyone who needs treatment, which is a big problem, but it's not a criminal problem. that is not something the criminal law is designed to address. if on the other hand, you have individuals who have falsified documents, who have put incorrect information, intentionally, int

he's also joined alongside cnn legal analyst jeffrey toobin, live with me in new york.ple are stopping and watching the tv screen because any time you hear, maybe we should bring back the firing squad, it seems really barbaric. most people would say there's a reason we did away with it in the first place. why would you think it's good to bring it back? >> well, ashleigh in utah, our last execution was in 2010 which was a firing squad. so it's something we've used here in utah in the past. it's been upheld by the supreme court as a means to do this. with the problems we're having currently with the drug cocktail and lethal injection and the access to it, it makes sense to have a backup. that's what this will be, just a backup. we'll try lethal injection. if we're challenged in court, if something doesn't work, we can move over to the firing squad and have that as an option just in case. >> isn't it just as bad? i mean, it is not fail safe either. we have definitive proof. i think there was a case in 1987 where it took almost a half hour for a condemned man to die after b

jeffrey toobin.hat they started and why i felt i heard this before, it was before scotus again. >> 2004, made it unconstitutional to execute someone who at the time was mentally retarded, now it's intellectually disabled. florida said, i see in the opinion it says intellectual disabled is about an i.q. of 70. they took that and formed a statute in florida that said if you are above 70, with your i.q., you can be executed. eligible for the death penalty. below 70, another story. well, now we have freddie lee hall. i.q., 71. he had several i.q. tests. 71 to 80 were the i.q. tests they were considering. but the sentencing judge said in florida, i look at this and you say he's intellectually disabled. i see he was able to beat, murder, rob someone, i think you have professional overkill here. the judge thought they were playing with the system and determined he wasn't intellectually disabled. >> let me give voice to that someone he killed, before he went off and killed a law enforcement officer. it was c

. >> that is an explosive charge, let's dig deeper with our senior legal analyst, jeffrey toobin. and if this report is true that the team president, andy rosser, donald sterling asked him to delete the recording from the smartphone, if you will. how serious is the charge? could there be some legal recourse? >> well, i don't think it would actually lead to a criminal case against donald sterling. this was not after all a government investigation that was being obstructed. but it is yet another ground for the nba to take the franchise away. and it would make -- and if it is true it would make any effort to get the courts to intervene and stop the forced sale of the clippers that much more difficult. so it is very bad news to donald sterling. but it is not news that i think p puts him in any sort of criminal jeopardy. >> because trying to destroy evidence or lying, don, as you know they are very serious charge are -- charges that are levelled against donald sterling and his wife, shelly. >> the more i read about it, it is a mess, a soap opera. and you're right, anybody involved in t

let's bring in jeffrey toobin, rachel nichols, host of cnn's "unguarded."to be our boss at cnn when he ran time warner, our parent company. he's now going to be running the l.a. clippers. what did he say? >> he was approached by the nba monday, officially accepted the job with them yesterday and it was announced today. his main job is to steady the ship, c ship, just calm everybody down, provide rudder to get them back to work and used a "star wars" term with me there, said there's going to be disturbances in the force from time to time. as this situation with ownership shakes out. but he said he will remind the people in the organization through those moments that their job is to handle the basketball and the business side, that the ownership issues will be handled, that, quote, turbulence, as he put it, will be handled by the nba. he also joked with me about his experience playing basketball at the university of hawaii. he said, you know, it helps. he says i love basketball, it helps to have this job. i asked him how good he was, wolf, and he said, well,

let's dig deeper now with our cnn anchor don lemon, our cnn legal analyst jeffrey toobin. what a bunch of tough lawyers could potentially do with aggressive tactics, if you will. >> think about depositions. the issue is misconduct by the owner. one tact a lawyer representing don sterling could say, let's get all of the owners of the nba and put them all under oath and ask them what they have said in private conversations. and do they have mistresses as well? and do they have women who have tape recorded them? that would certainly give pause. now, i don't know if a judge would allow those depositions to take place. certainly lawyers for the nba would fight it but the best defense is usually a good offense and putting the nba and its owners on trial is certainly what one thing that would be on their minds. >> how ugly, don, do you think this legal battle could become? it could hurt the legal potentially tremendously? >> it's going to get ugly. i think the league is ready for it. they are selling t-shirts saying we are one with either the league logo on it are on the clippers

you can be insane and still legally understand what you're doing. >> jeffrey toobin, she has a long historyon and bipolar disorder. her defense attorney is going to say, and will repeat often in this case, that this mother is a former soldier who lost a battle with mental illness. this is critical in this defense. it is part of the legal statute that you have to have been sick and treated, but is it the entire defense? >> the legal system has struggled to come to a definition of legal insanity that fits what we want with this defense. the best i can come up with, in terms of sort of making sense of the insanity defense, is if you know that you are killing a person, even if you have a terrible, terrible reason to do it, you are not insane. but if you really believe that you are shooting a watermelon, not a person, you are legally insane. now, here it appears that she did not she was killing her children. she bought a gun. she talked about it. now, obviously, this is a very sick woman. but it certainly doesn't sound like she fits the legal definition. >> paul callen, she did not hide the gun.

let's bring in senior legal analyst jeffrey toobin and cnn anchor don lemon. his all say as far as shelly sterling is concerned? her 50% ownership, this legal move today by the nba, jeffrey? >> well, two things jump out at me about pierce o'donnell's statement. one is he refers to the voluminous charges. we've only seen a press release. a brief summary of what the nba has filed against the sterlings. so really don't know the full effect of it. the second thing is it is something less than a threat to sue. the lawyer says pierce o'donnell, miss sterling's lawyer says we think this is wrong, but it is not as much of a saber rattling statement as he's made in the past, so she certainly does seem to me, at least, to be someone who's open to a deal that would give her a great deal of money, but not let her own the clippers anymore. >> what do you think, don? should she be allowed to keep 0 50% of the team? >> i don't think so. i think that's a public sentiment, what the team says and what most people want. i think the -- if i were an attorney for the nba and i recei

l let's bring in senior legal analyst, jeffrey toobin, don lemon, suzanne malveaux, and our commentatorit, jeffrey, you're the legal analyst. is he admitting guilt? is he pleading guilty? there let me parse that like a lawyer. what his lawyer would say i'm certain -- >> here we go. >> -- is that he apologizes for generally offensive conduct. generally an offensive statement. but what he said is not a violation of the nba constitution and thus is not grounds to take his franchise away. that's certainly the way a lawyer would parse that. whether anybody believes that is a separate question, but that's certainly the way they're analyzing. >> argument made against them, don, i've heard this from sources close to the nba repeatedly, is that, yes, there is an nba constitution. and it stipulates part of the constitution that the owners have to agree to all the various agreements they've made in order to get that franchise. over the years, going back 30 years including within the last decade, donald sterling signed various agreements with the nba that includes those so-called morals clauses tha

rachel nichols is joining us along with cnn legal analyst jeffrey toobin and don lemon.ments made on this tape by donald sterling, how does this move the whole story forward? >> well, this is the most we've heard from donald sterling in terms of his intentions to fight this, him saying nobody can take his property away. but that's not a surprise to the in. ba. that's why they've been so careful in their legal maneuverings so far. they knew he would likely file lawsuits or try to slow them down to remind them who they are up against. i've been saying the bombshell wild card here is shelly sterling. she's saying that she's going to fight to keep this team. and remember, all of those parts of the constitution about impacting the nba, well, adam silver has already come out and said that doesn't apply to her. she's going to have a stake here. we're going to have to see how it plays out because, trust me, players on the league don't want her to have anything to do with this team, but she may have a case. >> you heard donald sterling on this alleged tape saying i'm a lawyer. yo

. >> brian todd joins me now with cnn legal analyst, jeffrey toobin.any scenario in which he could retain equity in the cl clippers? >> not really, there is no scenario in which either donald or shelly sterling can retain equity in the clippers. around the league they feel if shelly sterling is leading the effort to sell the clippers that is okay, but not a scenario where either of them would have equity in the clippers. >> what do you make of this? >> they're all out. this is the sterlings facing reality. the only issue is when they're out. either they leave now and sell the team or june third, they are forced out and then sell the team. they're facing reality. they don't want a messy fight and it looks like they're going to make one big pile of money. >> yeah, there are some reports today saying the clippers are looking at $1.8 billion, which is certainly not bad of an outcome, especially considering mr. sterling's initial investment of the team. >> which is somewhere between 12 and $13 million. it is hard to think of this as justice triumphing. he i

let's bring in jeffrey toobin, and lz granderson and don lemon. let's talk about this possible lawsuit. jeffrey first, a billion dollar lawsuit he's going to file against the nba? what dow think of that? >> well, the odd thing is it doesn't seem to be a lawsuit if it is a lawsuit at all designed to stop the sale. it may be simply suing the nba to recover the capital gapes tax he's going to have to pay because of this forced sale. that would be a sideshow irrelevant to who owns the clippers. i am not inclined to believe there is a lawsuit until i actually see a lawsuit. we've been hearing from mr. bleacher for a long time. i'm getting ready to sue, i'm going to sue any day. and nothing happens. >> you asked him yesterday, jeffrey. where is the suit? he kind of pack pedalled. yek i said vgts i'm skeptical. i said, i don't trust anything that comes out of their mouths until there's an actual sale. i won't believe it. and the interesting thing is, he's saying that he wants to be vindicated. well, he's not understanding it. imagine this scenario. if he

our jeffrey toobin is here.n expert on all things legal and the courts and the supreme court, which matters here quite a great deal. you look at that map and you see state after state after state now. is it inevitable that we will soon see a nationwide ruling? >> it is inevitable that the supreme court's going to have to deal with this sooner rather than later. i don't think it is inevitable what the result of that case will be. an amazing phenomenon. since the supreme court struck down doma, the defense of marriage act, last year, 14 judges have considered bans on same-sex marriage or recognizing same-sex marriages. all of them have struck down those bans. so clearly the federal judiciary is moving in the direction of strike down them all, but the supreme court has not spoken on the issue. i think the odds are at this point they will say same-sex marriage is constitutionally required but it's not a sure thing. >> the legal question still remaining, the infringeable right of gays to marry. give us an idea of all

joining me now senior legal analyst jeffrey toobin, criminal defense attorney mark geragos and former federal prosecutor sunny hostin. what do you make of the reports that the district attorney's office is looking into allegations this woman tried to extort money from sterling, mark? >> it wouldn't surprise me. l.a. seems to be ground zero for extortion of celebrities. so if it is, in fact, the case that she said i'm going to release other stuff if you don't pay me, that's kind of a black letter law for extortion. what would surprise me, however, is she saying she's not the one who leaked. the rumor mill here in los angeles is that she sent those tapes to a girlfriend and that the girlfriend then sold them to tmz who released them and to deadspin. if that's the case, then she doesn't have any problem in terms of the original taping. but if she said i'm going to release some other stuff, if you don't pay me off and if that's the reason that sterling was quoted as saying i should have just paid her off, then that could be some legal jeopardy for her. >> but what's odd about this whole t

and i'm glad that jeffrey toobin admitted all along that shelly sterling is a real player. and the fact she is 50% owner is a big deal. i don't think the nba will just be able to rip the team away from shelly sterling. and i actually still disagree with jeff, and now that you know i'm right on one thing i think you will agree with me on this, that the nba doesn't have a clear-cut way of ousting donald sterling. >> mark what about that? you doubted that shelly sterling would be able to sell her stake in the team. >> there is no way that shelly sterling will be able to sell her stake in the team. she has community property interest. they're not going to be able to do it. that community property interest is already in several cases in the past couple of years, with fraud allegations and creditors, it withstood that. they are going to say she will be a passive owner of 50%. they're probably going to be able to trying to marginalize donald. my guess will be shortly you will see they filed for divorce. when that happens the family law court will take jurisdiction over this. and w

a look at how it could play out with rachel nichols as well as jeffrey toobin and sunny hostin. jeff. adam silver says no more time. does sterling have any options here? >> he has one option out this point which is to go to court and persuade a judge to stop the sale for some reason but it seems entirely clear that if the process goes forward on june 3rd as the schedule now has it sterling -- adam silver will get well more than three quarters of the owners and it will all be over by then. >> sunny, if there's doubt about shelly sterling's standing in this, silver said without a doubt all the sterlings have to go. >> well, that's what silver's position is. that's no surprise. that's been the nba's position. but i don't think that that is actually so cut and dried, anderson. >> you think shelly has options? >> i do. i think that the nuclear option, of course, is filing for divorce. this entire thing will end up in a court somewhere in los angeles, some family law divorce court. i think that's a possibility. i disagree with jeff. bottom line the lawsuit that donald sterling is fili

cnn legal analyst sunny hostin and jeffrey toobin along with rachel nichols. just last week, donald sterling sends a letter authorizing shelly to sell the clippers then last week his attorneys send a letter promising to fight to the bitter end. is this just saber rattling? is this sterling land? >> there are two possibilities. one is they're just all nuts. the other is there is a rationale that they could both work in concert. donald sterling is going to have to sell this team. there is no doubt that there is going to have to be a sale here, whether it is forced or voluntarily. he needs to get the biggest price he wants. if his wife can be the good cop and say i really want to sell the team, he can be the bad cop and say, no way i'm selling. so shelly can then drive up the price saying, you know, don is crazy, you have to give another $100 million. i think that is what is probably going on here. it is all about driving up the price. >> it's interesting, though and, jeff, in the documents, yesterday sterling's attorney said the reason they couldn't strip him fr
