jenna: i'm jenna lee. osama bin laden's son-in-law pleading not guilty to conspiracy to kill americans, this a short time ago in a federal court in lower manhatten blocks from the warl world trade center site. suleiman abu ghaith is not just in osama bin laden's family, he's also al-qaida's spokesman and apparently the top prop grandist. he's appeared in videos and praising the 9/11 attacks and warning of new attacks in the future. we are getting new information on how and when his capture went down. david lee miller is live outside the u.s. district court in new york city. what did we learn about his arrest? >> reporter: we learned more about the timeline. we learned that suleiman abu ghaith has now been in the united states for exactly one week. prosecutors told the judge that he arrived in the united states march 1st at 12:30pm and they also revealed that he was arrested overseas shortly before midnight february 28th. when they give those times, they are speaking about east coast times. further details

jenna: i'm jenna lee. the agency is blaming the automatic sequester even though congress voted to maintain full funding to protect our borders. william la jeunesse live with the exclusive. >> the border patrol is losing 4,000 agents or 40% of its manpower because washing tan says budget cuts are forcing it to eliminate over time. large portions of the border will be unmanned, unattended, open for hours at a time and that means the border is not as secretary napolitano recently claimed as secure as its ever been. senior management told the agent's union yesterday effective april 7th there will be no over time or drive time, instead agents will work as little as five hours actually on the border. once they leave their spot on the border that area will be left unattended until the replacement agent arrives some two hours later leaving a huge gap in border security. >> this is no longer about border security for cbp, it's about the bottom line. this has become a corporate mentality. it's not about the mission.

jenna: hi, everybody, i'm jenna lee. north korea today ramping up its rhetoric again and reportedly readying its military. the leader there kim jong un says his rockets are ready to quote settle accounts with the united states. this comes one day after a powerful military message from us to them the pentagon sending two nuclear-capable stealth bombers on a fly over right around the korean peninsula to make sure they saw it. jennifer griffin is live at the pentagon with more on this continuing to develop story. so, jennifer, what is north korea specifically planning to do? what are they saying? >> reporter: well it's difficult to say, jenna, but right now kim jong un is backing himself into a corner and the pentagon is very worried that he may put himself in a position that if he doesn't do something he will lose face. shortly after midnight local time last night north korean state television reported that kim jong un signed orders to put the nation's rockets on combat ready status. the direct threat to the u.s. in the wa
