jennifer rogers. jennifer, good to have you this evening. merrick garland saying that he made this call because trump had announced his 2024 run, and you also had president biden expressing a plan to run. but he has resisted doing this for months. so explain that to us. explain what you make of that. >> the special counsel regulations indicate when you need to appoint a special counsel are one it's desirable. it's really when there is a conflict of interest. what robert mueller was appointed, for example, you had donald trump's own justice department, you can't ask the president's justice department to investigate him, so that was an obvious conflict. here that was not the case. there was no reason why the justice department under president biden could not investigate a former president, who after all, is a private citizen at the time. it really only is when as merrick arland explained yesterday that you had the former president now a candidate for president, and the current president indicating he will run again, so they will run against each other. so can merrick garland's boss, can't he oversee a case involving his political opponent? that's where it got messy, and having thaw it through, he is right. it's still not technically legally required, but i think it's the prudent thing to do, and we know from all these months and years of watching merrick garland operate, he's nothing if not prudent and thoughtful. >> it's a very good point. we heard caitlin describing that he is not at the beginning of, this he's inheriting these mature investigations, and the mature east of the investigations really does involve the documents from mar-a-lago. how quickly do you think smith and his team could be getting to a decision on potential charges here? >> i think it could be fairly quick. jack smith will need to get up to speed, you want to take some time to familiarize himself with the evidence, especially since this is not his team. these are folks who have been working on this for a long time, and he will want to take his time to get to know them a little bit, as well as the case. but here is the one thing that may not be finished in terms of the investigation. merrick garland was so deliberate in talking about part of the special counsels agreement being obstruction related to the documents case, so that means that they are looking at charging obstruction not only for the year and a half or so of the back and forth and potential lying about having the documents and what they were turning over but remember the evidence that came out recently about what happened at mar-a-lago, surveillance camera footage, people moving things in an out of the storage room, where everything was supposed to be kept. getting to the bottom of that and getting that evidence together, including possibly putting witnesses into the grand jury may still be going on and may take a little more time. generally speaking, i do think that investigation must be getting towards its end stages. >> let's listen to what the former ag under donald trump, bill barr, said. this is before merrick garland made his announcement. this is what he said about the case involving the mishandling of classified documents at mar-a-lago. >> i personally think that they probably have the basis for legitimately indicting the president. i don't know, i'm speculating, but given what has gone on, i think they have the evidence that would check the box. they have the case. >> do you think they will? >> i think it's becoming increasingly more likely. >> you said that it could be pretty soon. when you talk about that, i talking several weeks, a few months, what is the soonest? because the way he talks about it, it's almost like it's a foregone conclusion. >> i think it could be a few weeks, a couple of months. they do need to move fairly quickly but as i said, any case that they would bring that relates to the documents themselves and the improper taking and storage retention and so on, they would want to bring any obstruction charges along with that as well so i think they will need to wrap that up. maybe a matter of six weeks, eight weeks, a couple to three months, somewhere in that neighborhood. >> that's interesting because we had harry lippman on last hour, and he said the same thing. we're surveying you guys to see if you concur about this. trump and his businesses are entangled in at least a dozen significant investigations and lawsuits, not including the ongoing january six probe on the hill, which could lead to its own criminal referral. how do these new special counsel investigations rank in terms of potential danger to the former president? how do they interact with these other cases? >> wow, it's so hard to say. listen, these are criminal charges so in that sense, they're deemed more serious and more dangerous because they can result in prison time. they are certainly overlapping between the case in fulton county and the january six investigation being conducted by the department of justice so we'll have to see what happens with that, if miss willis invites for us, we'll see what the doj does with their january six investigation. it is hard to say but one thing is for sure, with this many investigations targeting the former president and his companies, he's got a lot to think about. it's really hard to see someone juggling this number of cases and also a presidential candidacy. >> it's a lot of walls potentially closing in on him at this pivotal time. jennifer, thank you so much for your insights tonight. we appreciate that. >> thanks, breonna. >> in the meantime, house republicans are lining up to demand investigations of president biden, his administration and his son hunter. cnn's pamela brown sat down with kentucky congressman james comer, who is the likely next chairman of the powerful house oversight committee. she asked what his party has in mind. >> you mentioned the democrat investigations of trump, how much is this then settling the score because republicans felt like that was unfair so now we'll go after the biden family because of what the democrats did with trump? jennifer, vern you both opted to work in public service. can you tell us about your job on a daily basis, and why you think it is so important, jennifer if you want to start? ms. gerbi: i am happy to. i came from industry. it is an unusual place where on term limits. we come for three to five years and leave. they come because we are driven by the mission of the agency, and we want to make a difference. for me, the main reason why i came was freedom we have to pursue what is the right thing we should do? what is the right element to solve and have a very close to the impact of that and be able to make the decisions and have a portfolio. and have a personal impact on that. that level of freedom is important. i have to say it is the busiest i've ever been and the best job i had because i believe in the mission 100 it is very fulfilling. >> -- mr. sivaram: i joined from industry. i was former chief technology and -- officer. this is a once in a generation opportunity to reset how the united states viewed on the world stage on climate change. after four years of the trump administration and took and gentlemen biden -- president john -- president biden to get us in the game. i maybe following secretary kerry to a different country of the world. i leave in a couple days for egypt. where we will have this year's climate -- international climate congress. working with secretary kerry is an opportunity, not only for us to rejoin the pairs of court -- agreement which president biden did on the first day of administration, but to pursue and an initiative that is abroad, put us back in the game. some of the most, -- consequential legislation passed under this president. what we're doing at the international stage to help india, indonesia, africa, vietnam will lay the groundwork for clean energy all over the world. that is important to me. i spent time in india and the private sector. let jennifer i am a scientist. it is critical we start these perspectives and to refashion the world economy. >> jennifer, something you said you have so much freedom to explore and do new things. there is a stereotype that in government there is little innovation, there is a little experimentation. you are saying that is not the case. you have the ability to try new things and take risks. >> of the very foundation set up as are about allowed us to do that. you have to have the right structure and your organization to allow people to take that risk. you have to have people comfortable with doing that and energized by doing that. the way we are set up is we are a little bit separate and our own thing. we are off roadmap. we do communicate with other parts of the doe, but we do is generated internal. do not have roadmaps. we are very collaborative, we pressure test our ideas into workaround what should we do and why. we are very impact driven. to accept that level of risk. you have to have your orga
