michael moore and cnn legal analyst and former federal prosecutor, jennifer rodgers and michael, let me just start with you since all this is it's happening in your home state. what did you make of judge mcafee is rationale for dismissing these charges? >> well, i'm glad to be the both. i mean, what was filed by the defense's a very standard motion that's filed by the defendants in many cases in georgia, it's a demurrer. our challenge to the sufficiency of the indictment and the law says the defendant is entitled to an indictment it's basically perfect in form and substance. and so the judge simply looked at it. he said, look, you've got this these allegations and the indictment that who you're saying he tried to solicit people to violate their oath, but you need to tell me what part of their oath what part of the constitutional provisions whether it's a state constitution or federal constitution provisions as they take an oath to uphold both you've got to spell that out in the indictment so that the defendants have some knowledge before they go to trial of what they may have to prep

congressman adam kinzinger, who served on the house january 6 committee, also seen and legal analysts jennifer rodgers and maggie haberman, senior political correspondent for the new york times maggie, let's start out with you. i mean for some, what do you make of this latest filing? not a surprise. >> now it's a continuation of an argument that they've used several times, perhaps more emphatically right now, i think that the brett kavanaugh writing is very intentionally done. we know this is a former president who has talked repeatedly in private about being unhappy with the supreme court justices who he appointed because they haven't cited with him in his allies section lies previously. brett kavanaugh is somebody who came under a lot of scrutiny and a lot of attack during his confirmation process. and i don't think that that's a coincidence that they're using this. but look, they are looking toward oral argument and they are looking toward how the justices are going to respond to it. and it is not especially concerning to them that has ever noted, they are taking contradictory positions and one fil

much >> joining us now to talk about this is cnn legal analyst and former federal prosecutor, jennifer rodgers. the core question here what is the bar for disqualification? what do you see here? just to kind of like bring it home for everybody, what the judge is going to be considering right now. yeah. well, that's a big question. the question is whether there's an actual conflict of interest or just the appearance of a conflict of interest. prosecutors argued has to be an actual conflict of interests that's what most legal experts in georgia seems to say, is the law. but sometimes judges disqualified based on the appearance if a conflict of interest and that's what the defendants are arguing for. so it comes down to if it's an actual conflict of this financial interest issue, did fani willis financially benefit from nathan wade having the job and this goes back to the trips that they took together that he paid for and her testimony that she paid him back and whether or not the judge credits that if you're at home, not following this all the time. i continue to try to get back to it as well. w

. >> so what do you >> think the way jennifer rodgers i was talking to her yesterday, she was like this is just a really messy situation. this entire thing. do you think it is more likely that fani willis stays on the case and what does it do to the case? >> i think yeah, i think it's just messy no matter what. but if are a betting man, i think she's going to remain on the case. frankly, the risks, the recent dismissal of some counts actually gives you more confidence that the judge is going to keep her on interests and goals. he gives his giving her office, you opportunity to replete these counts, to go back to a grand jury or and secure additional indictments of these charges, which to me suggests that if he had a larger, more larger blockbuster ruling coming, he would have saved that he's now decided pretrial motions with suggest he sees this case is moving along and attract to trial. so i think she's actually going to pretty good position to stay on the case. and as far as what it does, i think frankly it's messy and i don't know that's any way around that she made the choices she m
