but those two words that are authorizing why does the statute even apply to it new jersey did? and it was entirely possible the majority of the court and new jersey would win their case but it would not apply to the partial repeal but still a significantly open question that prohibits any type of regulatory scheme. that is something to look for on the statutory question and not to get traction the united states takes a slightly different position to support sports leagues and they say it does apply but does not implicate a constitutional question but really it is an authorization because by doing an appeal only where the state has sponsored gambling so new jersey is cleverly channeling sports gambling into state-sponsored institutions so it isn't authorizing relicensing however if you read it that way the court doesn't have to reach the constitutional question because it just says this case says nothing of the full scale repeal would be constitutional if it prohibit such a repeal. so there are some complicated statutory questions at issue that may prevent theit court from reach
