jesse?yeah rosemary he was battling health problems and despite that still a lot of jock by the people and passengers here at the amtrak station in wilmington, delaware. we've come here because this was a familiar stop for both father vice president, joe biden would train to and from washington, d.c. back and forth from the capitol, as a member of the senate. he was diagnosed -- we're talking about beau biden, -- in 2010, first with a brain lesion and then in 2013 the diagnosis of brain cancer. back then biden and the family said that beau was a fighter, who would overcome the challenge. he seemed to do that getting a clean bill of health a few months after undergoing treatment, but a recurrence of the disease earlier this month and admittance to walter reed medical center beau biden succumbed to the disease late last night and reaction has been coming in ever since. >> we're really upset about it because, i've had cancer in my family, and it's really upsetting to know he was still young, he

what do you say about jesse jackson jr. who spent less than two years in jail and your brother who stole zero money and is in jail for 14 years? >> the question is clarifying in and of itself. as i mentioned, i thought congressman former congressman jesse jackson got away with a federal crime. i've been asked that question many times and my brother's sentence was disproportionately harsh and unfair. and when jesse jackson jr. pled in federal court in washington, d.c. he spoke to the media very briefly where he said i'm now taking responsibility, and i'm manning up for what i did. and i have said repeatedly in response to that, well jesse when are you going to man up more trying to buy the senate seat? and i don't expect that that will ever happen. but it speaks father, to the unfairness of the system. i believe this prosecution was an agenda-driven prosecution to bring down another sitting illinois governor and they used anyone that they could to bring him down including his brother who they knew had done nothing wrong. >>

nbc 10's jesse gary is live in wilmington, and jesse you've just learned that the state's top politician is honoring his former attorney general. tell us more about it. >> reporter: rosemary that's right. i've just learned from governor jack markell's office that all flags have been ordered to half-staff in tribute to beau biden. we've come to a regular stop in wilmington for joe biden. and condolences keep coming in for the biden family. now, health troubles first found him in 2010 with a brain lesion and he had surgery. back then they said he was a fighter and would overcome this challenge. he seemed to be doing that getting a clean bill of health a few months later undergoing treatment. but a recurrence of the disease earlier this month and an admittance to walter reed medical center. beau biden succumbed to the disease late last night and reaction has been coming in ever since. >> biden has to be heartbroken. for my parent to lose a child, has got to be absolutely devastating, and to know that your son is fighting a terminal disease has got to be has got to weigh heavy on anybody. i

in the past hours prosecutors have announced they will seek the death penalty against jesse matthew in case the case goes to trial. what can you tell us? >> it is certainly a decision that got the attention of everybody in court, not necessarily what we acted. but the commonwealth attorney saying that there was new evidence came to light, new forensic evidence that came to light in february that compelled her office to upgrade this for my first degree murder case to a capital murder case. she would not give any details as to what the evidence is, only saying that jesse matthew was served the indictment this morning, and this was evident that came forward. forensic evidence came and propel case to move forward. he had been facing first-degree murder charges after hannah graham's disappearance in charles phil. her remains were found five weeks later in october in a rural part of the county. he was arrested a few days after. he was arrested in galveston texas. talk about this new texas, if the question as to why this question decision was made. here's what she said went into the decision-

"nbc 10's" jesse gary just got to the scene a few minutes ago. jesse, what can you tell us? >> reporter: tracy, i'm standing on the overpass of franklinville road and you can see that the scene is still very active. the tractor trailer, at least one of them is still smoking underneath me and underneath that tractor-trailer there is the wreckage of a car. it's kind of pinned underneath the cab of the tractor trailer and the median of the new jersey turnpike. so firefighters are continuing to douse the first tractor-trailer with foam trying to put out the flames and the smoke completely. there is a bus that's behind that. the car, then a second tractor-trailer. northbound lanes, at least one has been restored, two are still closed. on the southbound side traffic is moving pretty freely. i'm he sorry, one northbound lane is closed, the other is open. they're getting people up on the shoulder. so they're using the shoulder to keep traffic moving. you can see how much smoke there is. it's just obscuring the view of traffic down the turnpike. we're going to try and get more inform
