jesse is stuck 16 feet down. so the plan is to dig down 20 feet with heavy ground-breaking equipment and then cut across by hand. rescuers know they need to move cautiously. >> if there would have been any further collapse, of course, in the well above his head, yes, there's a risk. and that was one of our main concerns is vibration of the ground around the opening. they shut off all traffic, stopped all traffic within 500 feet. >> my role as a rescue was to help with the shoring and the trench. and my job was also to be one of the diggers down at the bottom that actually dug across from the trench over to the well where little jesse was. >> as the operation approaches its fifth hour, 17-month-old baby jesse seems to be hanging in there, but the question everyone is asking, how much longer can he last? >> my only thought was, he's getting tired. i was worried about him maybe giving up. and i was talking to him, you know, comforting him as well as myself. >> firefighter tim daneen is working with other rescuers in

jesse matthew is charged in her death nearly five months after she we want missing. they wrapped up a press conference 45 minutes ago. we'll get right to our northern virginia bureau chief jeff goldberg live in charlottesville with the latest on these charges. jeff? >> jummy, the investigators here saying that their case against jesse matthew has been wrapped up. they decided to pursue and charge matthew yesterday with first-degree murder charges in the case of hannah graham as well as charges of abduction with intent to defile. now, prosecutors making it very clear they are not charging jesse matthew with capital murder charges which would carry with it the death penalty. they said if they made that decision after very careful deliberation but would not explain exactly why that decision came to be. now, this press conference taking place at 11:00 this morning here authorities today not revealing any information on the evidence against jesse matthew. hannah graham was last seen in downtown charlottesville in september 13th in the early morning hours. a week later, ma

nbc 10's jesse gary is live there with the details. jesse? >> reporter: rosemary we switched our position a little bit from earlier in the morning, so you can get a better look at the damage from this tree falling on to this apartment building. i talked to the resident who was right in the lower unit right here, and her name is renee. we'll try to get her comments to you in just a little bit. but she tells me she heard a crack and then a boom. and so a portion of this tree has fallen on to the empress building one of the buildings in the complex that is the falls village apartments. the upstair residence was damaged. we talked to the lni commissioner who says the roof sustained minor damages and one of the branches penetrated the drywall and poked a hole into the unit. now, the commissioner also gives comment about why the residents were allowed to stay. he says there were no structural issues or concerns of collapse. tenants were able to stay in their apartments were able to just sleep in another room. so they have chosen to stay inside duri

we do have a first-degree murder charge against jesse matthew. we also have abduction with intent to defile. he had been charged with that in charlottesville. it's moved over here to albemarle county. he also faces reckless driving charges from the time he is said to have fled authorities when trying to question him about hannah graham's disappearance. let me take you back to that time. the second uva student -- second-year uva student, hannah was seen leaving a bar with jesse matthew. after intensive searching, her remains were found on an abandoned property in albemarle county on october 18. matthew is currently incarcerated in fairfax where he's facing attempted capital murder, rape of a fairfax woman in 2005. the commonwealth's attorney would not touch on why they are not burr suing capital charges, whether or not there's not enough evidence at this point or something else. here's what she did say about the first-degree murder charge. >> the charges that the jury will hear are the charges that the prosecutor feels comfortable and feels the pr

jesse, why are officials taking this step now? >> reporter: vai, a crime rate that has steadily risen with no signs of showing it's going back down. on average this year so far, more than one murder per week. an all too familiar reality for residents. >> i hear sirens and the ambulance every night. that's going on down the street. >> reporter: wilmington resident joy brown says she's watched the current violent trend since childhood. we did some digging and found the problem area in red. right from the first areas in the foremost of the city. they have seen two dozen homicides annually. in 2012 there were three dozen. >> we are turning up the temperature and the heat on these young kids that are the issue. >> tom gordon says county cops will supplement wilmington police on patrol. this comes on the heels of city leaders last year declaring violent crime a disease. they are asking for federal funds for programs. this week the governor's new public safety strategy commission meets for the first time. all steps on a long path that jo

they do have evidence exactly linking hannah graham to jesse matthew. >> okay. we just may not know specifically what those pieces of evidence are. what about -- i mean there are so many other cases in virginia that people are wondering if they're linked to this man. there was that sex assault case from 2005 in fairfax, virginia. several other unsolved cases in the central virginia area. do we know, are there developments on any of those cases? >> well we do know that jesse matthew is charged with capital murder abduction with intent to defile in fairfax for a 2005 rape case which he's going to be on trial, it starts march 9th. he was charged with rape at liberty university. those charges were dropped. we also know he's been linked to the morgan harrington disappearance in 2009. that case is he forensically linked. he's currently a suspect. there's been no charges so far, but he is a suspect. forensically linked through dna. >> all right. thank you very much. >>> just ahead here on cnn, hunting for new hostages. intelligence reveals isis plans to target and kidn

nbc 10's jesse gary is live on the scene for us. jesse, what is the situation now? >> reporter: well, they are making progress removing the vehicle and debris from the northbound and southbound lanes of 495. you can see another truck pulling into the picture right now on the northbound side which is the side we're standing on, this is where the cab was. so they have been using brooms to sweep up debris. you just saw the video of the cab being uprighted and towed away. that was maybe an hour ago. and then on the southbound lanes, this is where the accident happened. the driver actually crashed on the southbound lanes. the trailer portion stayed on the southbound lanes and the cab portion crossed over to the northbound lanes. and thus the closure in both directions of 495 right at east 12th street here in wilmington. the driver taken to the hospital. we still don't have a condition update on him, although witnesses say he was alert and talking when he was pulled from that cab. as you see in the video, the cab landed on the passenger side. that may have helped protect

nbc 10 was the first on the scene and jesse gary is live on the scene. in the last half hour, he was given an update from the norristown fire chief. tell us more jesse. >> reporter: the chief says firefighters were able to pull this fatality out of the building. they were trying to do cpr and rushed that person to the hospital but were pronounced dead at the hospital you can see off in the background they are continuing to spray the back portion of this five-story apartment building here at norristown where the last of the flames were concentrated. as far as getting them under control, they are not out. this is video from earlier this morning. actually this is skyforce shoaling the much better view of the back of the building and the firefighting efforts going on. right now three people are injured, two residents, one firefighter. that firefighter was doing a search on the fourth floor of the building and suffered a cut to his hand. all three injuries are considered minor. we'll have an update again coming up in another 30 minutes about how the fire, eve

we're expecting to learn more about these charges coming against jesse matthew later this morning in a press conference out of charlottesville. sources with our sister station in richmond tell us jesse matthew will face murder charges in the death of uva student hannah graham. we don't know specifically what evidence led them to this charge but this is what we can tell you so far. matthew was first charged with abduction with intent to defy in graham's disappearance. is in fairfax county being held on a separate case facing attempted capital murder and sexual assault in the attack of a fairfax county woman back in 2005. his trial for that charge isn't until march. those charges again not related to the graham case. however, graham was last seen leaving a charlottesville bar with matthew in september of last year. her remains were later found in albemarle county just five miles away from where the remains of morgan harrington were found, the virginia tech student who disappeared from charlottesville in 2009. matthew's d.n.a. also linked him to that case. now, again a press conference

let's check in with jesse gary now. >> what are conditions like there, jesse? >> reporter: wet, wet and more wet. let me show you something real quick. we are on the entrance ramp to 76 westbound. you see where it merges right with the expressway. a couple minutes ago, two or three plows went down the entrance ramp. right where it merges standing water. they shot water, estimating 15 feet into the air and on to the left of the divider, on to the freeway. i say this because, if you are driving, there was a car coming along the westbound expressway the water is going to land on you. you have to be careful and pay attention to trucks, plows et cetera. when they hit areas of pooling water, they are going to knock it into you or it could come on the opposite side of the freeway and land on your vehicle. watch your spacing and your speed. watch for standing water. it continues to rain the roadway is wet and there are areas where the water is pooling. i'll show you how this rain is affecting the snow that is still around. jesse gary nbc 10 news. >> thanks. i very a ha

nbc 10's jesse gary is live on scene. jesse, what is the update? >> reporter: well, the update is they are working on the southbound lanes. if you take the trailer portion of the wreckage they are going to put it on a flatbed along with the cab portion there and take all of it off the freeway. but right now the d.o.t. says the engineers are out to come out to take a look at the east 12th overpass here that goes over i-495. because this accident happened they believe, when the truck struck the top of the bridge. and that is what sparked the crash. now the crash is of the cab section of the tractor-trailer, which actually made its way all the way across the freeway from the northbound lanes. the trailer portion stayed on the southbound lanes. that's why both sides of the freeway were closed but around 15 minutes ago, crews were able to get the wreckage and all the debris off the northbound lanes. so they have been reopened and traffic is moving quickly and normally along the northbound lanes. no backup there. we'll go to jillian mele now for an updat

a few minutes ago, i gout aft phone with jesse matthew's attorney.e has no comment on the murder charge. >> i suppose that would be what most attorneys would say at this point until they get their ducks in a row. stand by, brian todd, for a moment. jack ford, i want to bring you in on this as well, and joey jackson. five months before an actual murder charge. is that because you must have everything in order before you go that route? >> one of the things that prosecutors if they didn't know it before learned from the first o.j. simpson trial is, don't go rushing into a case. you'll remember in the o.j. simpson trial, the prosecutors were still getting evidence results back in the middle of the trial. part of that was a defense strategy where the defense pushed them. but if you're the prosecutor in a high-profile case such as this, it's a small community down there. i've been teaching at the university of virginia for the last two years. and this just did terrible things to the sense of that community. and you're the prosecutor, you want to make sure

nbc 10's jesse gary is live at city hall. jesse, is there any doubt that the bill before city council has the votes to pass? >> reporter: no doubt, really vai. the last time the supporters of bill were in this position the mayor vetoed it but now mayor nutter is planning a signing ceremony inside city hall this afternoon. use of tenacity by councilman at large bill greenlee have finally paid off. his bill that would be voted on today makes paid sick time mandatory for an estimated 180,000 people working in the city of philadelphia. workers would earn one hour of paid sick time for every 40 hours on the job for a total of five days per year. the greater philadelphia chamber of commerce has expressed concern the bill creates, in effect another business tax and a competitive disadvantage. >> we're seen as one of the highest locally taxed cities in the country. we think we can do better. >> i just don't think that the fears are reality. i think it's the fear of change. i understand that. >> reporter: bill greenlee says the smokin

jesse?>>> when the composite drawings and psychological profile of the arsonist were released to the media, this man, george keller, believed he knew the identity of the arsonist. he immediately went home and looked through his cell phone records and discovered that one of his business phones was used on the dates of the fires from locations near the fires. and his business credit card receipts showed that one of his cards was used to purchase gasoline in areas near the fires on the same dates. george keller faced a gut-wrenching choice. the person using these company credit cards was his son, paul, who bore a striking resemblance to the hypnotically enhanced composite drawing. >> i said there is a considerable resemblance between these pictures and my son paul. then i went through the profile and because i was looking for a significant personality trait or something that might disqualify paul. as i went through all the items of the profile, it -- i couldn't eliminate any. >> paul keller was

live in east falls this morning, jesse gary nbc 10 news. >> thank you, jesse. >>> nobody was hurt here when this tree fell on to a house in newtown square delaware county. firefighters rescued one person who was trapped inside the house. this was on spruce road. this happened around 12:15 this morning. the tree did damage the family's minivan, though. pico shut off power to the house so crews could remove the branches safely. we have been checking with pico this morning. the latest update they tell us there are about 2,200 outages right now. >> this morning, we are seeing some cancellations at philadelphia international airport. most are for flights going to and from new england, which has gotten about 1 to 2 feet of snow. they're expected to get some more. and actually i've been checking online to see what's going on at logan. and it looks like their operations really aren't going to pick up at the airport until 2:00 this afternoon. so again, they're dealing with those strong winds and dealing with that blowing snow. at philly international, there are some delays. they're about 15 min
