is from jesse matthew. taking a look at some video this morning of jesse matthew's family members walking in this morning. his father, mother, sister and girlfriend. during court today, the sister was overheard sighing and saying, i just want this over. the public defender made a motion to strike all three charges against jesse path through saying the commonwealth had not proved the attacker was him, that the entire case rested on a fingernail scraping. she said dogs were brought out to search for the attacker. nobody could be found. most notably jesse matthew because he wasn't there. the prosecutor countered. she said it's no credit to jesse matthew that the victim is alive today. it was nearly happennen stance that a man -- happenstance that a man named mark castro arrived and scared the attacker away. the defense is scheduled to be starting its case now. however, there's been a new development. we've seen jesse matthew's family go into a private room. the mother was crying. there is a lot of speculation

testimony continued today in jesse matthew's trial which is in fairfax. he is accused of sexually assaulting a woman in 2005. northern virginia bureau chief jeff goldberg has been in the courtroom for the past two days and has details on who stock the -- took the stand today. jeff? jeff: the trial moving faster than the prosecutors anticipated. the d.n.a. evidence is the focus of the case. the prosecutors trying to link the d.n.a. evidence found on the victim to jesse matthew. at this moment, the d.n.a. expert for the prosecution is testifying that the d.n.a. found underneath the fingernail of the victim would come from only one specific source. earlier this morning we heard from members of the city of fairfax police department who investigated the case. the victim r.g. was in shock. blood from her nose and grass in her hair. the victim told the attacker "leave me don't kill me." we heard from mary lamb williams the nurse who performed the sexual assault examination on r.g. following the attack which happened on september 24 2005 in a wooded area near the

losing consciousness at one point and said she was fighting back when the attacker alleged to be jesse matthew said "i'll kill you if you scream again. let me do this and i'll let you go." the victim saying that matthew tried to rape her but she successfully assisted. the attack stopped when someone nearby noticed something going on and a person encountered victim covered in blood and mud naked from the waist town. the victim testified she encountered matthew walking home from giant foods and said he asked her a few odd questions and she realized something was off. she walked quickly but she tried to get away and said he is was four steps from the townhouse in fairfax that matthew grabbed her. following the arrest in the hannah graham case, d.n.a. was taken from him that matched d.n.a. from the victim's fingernail after the attack in 2005. sitting in court today was the family of morgan harrington the virginia tech student who had been linked by d.n.a. to jesse matthew in her disappearance and death. also in the courtroom today, family members of jesse matthew. matthew was charged with abducti

now we also learned more about jesse matthew and why he suddenly pleaded guilty halfway through the trial. we learned that his defense team was split over the matter and that his two attorneys from the fairfax public defenders office were not on board with it and that it was his third attorney, james camblos, who has known the family for years in charville, he apparently -- charlottesville, he apparently convinced jesse matthew to plead guilty. >> it was very difficult for her. i think she expressed that on the stand, a lot of emotions going through her. >> reporter: the victim never looked at jesse matthew, but he did look at her, the woman he sexually assaulted and tried to kill 10 years ago in these woods. today the 36-year-old mother from india told the court how the attack made her feel utterly helpless. she thought she was going to die. when she healed from her wounds, she became depressed and trapped in a vicious cycle of anger and self-hatred but kept in contact with the detective. >> she never lost faith in the system. she kept detective boone's card in her wallet these 10 years

jesse matthew walked into the courtroom again this morning. he appeared more tired today more gloomy. he immediately looked at his father, who was sitting in the public gallery portion of the courtroom before he took his seat in front of the judge. elizabeth ballard, a forensic scientist from richmond, was the first witness today, the expert who developed the dna profile of jesse matthew and that evidence matched the dna found under the fingernails of the fairfax county woman who was sexually assaulted near the county 10 years ago. at one point the mathews defense team asked the judge to drop the charges, arguing that two and a half days in the commonwealth has not been able to prove that matthew was the perpetrator that night in 2005, saying that dna evidence is all they have and it is simply not enough. the description was off, the sketch look nothing like him, no eyewitnesses. the victim in this case testified earlier this week that the attacker told her -- i will kill you if you scream again. minutes ago after hearing that argument the jud

she says she lost confidence and she said jesse matthew said in her words "i'll kill you if you scream again. let me do this and i will let you go." the victim says the suspect matthew tried to rape her in that situation. at one point someone driving by, walking by heard faint screams. raul castro. he testified in court today and said he ran over, saw what was going on heard what was going on. allegedly the attacker in this case fled the scene. this man mr. castro helped out the victim. took her to get treatment at a rape treatment facility. and they scraped her fingernail and after jesse matthew in the hannah graham case in the fall of 2014 his d.n.a. was taken and it was matched to the d.n.a. of the victim in this case. that is the testimony we are hearing right now. the defense in its opening argument says we cannot necessarily trust the d.n.a. telling the jury you'll have reasonable doubt after you hear the evidence. the victim still on the stand. the testimony unfolding. i will go back to the courtroom and have an update at 5:00. back to you in the studio. alison: jeff thank you.

the match is said to be jesse matthew. this nurse walking out of fairfax court not wanting to comment but on the stand she spoke for nearly an hour. she did not remember the incident and had to read from her report. she was asking questions, tearful. the prosecutor asked would you expect those injuries to have been painful. the nurse replied yes. she read through a long list of injuries. scratches and brudss all over a woman's body. trauma to her genital area. if victim said he grabbed her, dragged her sexual assaulted her, choked her and tried to kill her. it was not until another abduction and death that jesse matthew emerged as a suspect. dna linked him. the lead detective took the stand today explaining how he got the mouth swab. it matched the dna found under the alleged victim's fingernail. he also matched the description. the defense ran through a list of several other suspects and persons of interest, all of them investigated over the course of the years. most of them also fit the description from the 2005 incident

defense attorneys wanted to suppress or block that moment at trial when the victim might point out jesse matthew as her attacker. defense attorneys charge that detectives guided the victim to media coverage on the internet after matthew was arrested last fall, enabling her to identify him. defense attorneys say in 2005, after the then-26-year-old was grabbed and raped while walking home from a fairfax grocery store, she had only a vague description of her attacker. but she testified it wasn't detectives who directed her online after matthew was indicted for her rape. she said it was her own curiosity that drew her to look in october and see one picture of matthew. asked the prosecutor, did you tell detective boone that the hair was different but the face was familiar? yes, she replied. the judge ruled there was not enough evidence to show police had tried to influence her ability to identify matthew. she will be able to answer that key question at trial. now, defense attorneys also made a last-ditch effort to continue the trial. that, too, was denied. trial begins here on monday of course, just

jesse matthew is accused of assaulting this woman in 2005. since the alleged incident she moved back to her home country of india. the judge said that she'd need to testify today in order to see whether she could id matthew in court. matthew was arrested last year. fairfax county detectives notified the victim in india there was an arrest and that there was a lot of media attention surrounding matthew because of other allegations, hannah graham, the uva student murdered, his ties to that. the victim says she found out an arrest was made and her curiosity took her online. she looked up the matthew stories and she did see a picture of him. the defense argued the detectives perhaps influenced her to go online, instructed her perhaps to go online and look at some of these pictures and that may have influenced her ability to id matthew in court. ultimately the judge did not agree saying she will be allowed to id matthew in court and ultimately it will be up to the jury to decide on the validity of that identification. trial begins on monday. live
