cnn justice correspondent jessica schneider has the latest on this. jessica, what do we expect and when, a harder question, do we expect a ruling on this? >> sara, it could come at any point. we're probably talking a matter of weeks here because the justices understand the urgency. the primaries are well under way. you said super tuesday about a month away. and the calendar is barreling toward the general election. what's interesting is we have seen the supreme court move very rapidly in somewhat similar circumstances. it was back in the year 2000 the supreme court actually decided bush v. gore one day after hearing arguments. now, granted, that decision came during a very chaotic time with the recounts in florida, which they halted. and of course it was just weeks before the inauguration. so, there was a bit of a different circumstance there. but in this case, these nine justices also know that time is of the essence here, so we could see something really in a matter of weeks here when often these big decisions might take until june. it probably won't

administration went too far when it banned the device back in 2018 cnn, justice correspondent jessica schneider is when they hear we're watching all of this unfold, jessica, this is not a second amendment case. what's the argument from the plaintiffs? >> yeah, this is really a case wolf about statutory interpretation and that's what the justices have been trying to grapple with for just about the past 90 minutes plaintiffs here are arguing that bump stocks don't fall within the meaning of a statute first enacted in 1930. that was intended and did effectively banned machine guns. it's interesting, this statute actually was targeted at gangsters like al capone when they were increasingly using machine guns back at the turn of the 20th century. so it's this statue that the atf relied on to ban bump stocks in 2018, this law actually defines machine guns as a weapon, and this is crucial that fire is more than one round with a single function of a trigger. so atf is interpreting this to say that even with bump stock fox, you're still only pulling the trigger once, but the plaintiffs have stepped in t

senior justice correspondent jessica schneider is working the story for us. what are you learning, jessica? >> well, wolf tonight, both sides are really looking to get ahead of tomorrow's arguments. they're both proposing new trial start dates in this classified documents case. so the special counsel now proposing july 8, and also trump's team is proposing august 12th. they're actually saying that he can't have a fair trial before the election. but if he does, they wanted august 12 and, you these are significant time periods after this case was originally slated to go to go to trial here. and both of these sides are likely proposing these new dates, knowing that there was a very high likelihood that that initial may 20, date will get pushed back at tomorrow's hearing. looking at the legal calendar, you see that there is a lot going on between now and august. so these new dates are very important because any july or august start date, it could potentially upend any summer start date to the dc election case. that's currently on hold because of the supreme court

jessica schneider, very confusing for voters let's talk more about this now with former deputy assistant attorney general, tom dupree first on the timing tom of what the supreme court hearing this immunity issue is going to do how do you see this affecting things? considering the timeline that just just laid out there >> i think jessica laid it out very accurately. i think the supreme court, they're going to hear argument at the end of april. they will give us a decision, possibly in may, probably in june, but very possibly not until the end of june. keep in mind, this is actually lightning speed for the united states supreme in court compared to the way they hear normal cases. of course, this is anything but a normal case. and i think a court understands that it does need to expedite things that can't drag its heels too much. there's a very strong public urgency in getting decision, getting a clarity on this immunity question sooner rather than later. >> so they could technically still hear this case. but then what issues the federal election subversion case, what issues would that be r
