we want to bring in cnn legal analyst danny and immigration attorney jessica stern as well. can you both hear us? >> yes. good morning. >> excellent. danny, help us understand where this goes from here. >> what happens now is that the parties will brief the issues, so they'll each be given the opportunity to submit legal briefs making their argument. remember the only thing they're asking for is the ninth sur kci or asking in a way for a restraining order on the restraining order when you think about it. so at this point it's going to be -- the parties will have to brief the issue. you know, with courts, you can make things go pretty quickly. this is pretty break neck speed. but you can't have immediate relief the way the white house administration seems to want. the issue has to be briefed and the ninth scircuit has to hear argument on it. >> what kind of timeline will we see on it? >> this is an amazing timeline so far. >> jessica, i wanted to ask you, what evidence do you think the department of justice and president trump need to prove their case? >> they're going to nee

. >> let's bing in david cevallos and jessica stern. david, with specific elements of the president's executive order, but what judge robart ordered is quite broad? >> it certainly is. and the judge even more interestingly uses a 5th circuit case which involved the previous administration, for the proposition that immigration law should be enforced not just in his district but in a uniform manner throughout the country. and the court uses its inherent power in little district court in the state of washington to strike down the policy nationwide. but meanwhile, back east in the first circuit, the administration might decide to say that, hey, we're going to follow this district court in another part of the country, and this is going to continue. we're going to keep getting this patchwork, as different courts decide this issue. it's something that will have to be resolved, first by the circuit court. and ultimately, very likely by the supreme court. >> so, jessica, last hour, when you were with us, you told us despite the pending appeal fr

department of justice to file briefings on the court, and we want to get an analysis on the ruling from jessica sternnal and immigration defense attorney, and danny, first of all, what has happened overnight, where does it stand -- where do things stand for people trying to get into this country right now? >> well, in the court, the stay on the travel ban stays exactly where it is. it seems if you are going to travel, now is the moment because things are changing by the hour. these briefs were filed and the motion was denied overnight, and people are waking up to find that significant developments have happened in the last few hours, so there's always the possibility that somebody could get on a plane and things could change while they are mid flight and the nation is in a different status when they land, and given the appellant court denied the motion for the immediate stay, and at least for the next few days or so the status quo will probably be maintained. >> jessica, do you see this expanding all the way to the supreme court when all is said and done? >> it most likely will. we are dealing with i

and here in the studio, immigration attorney jessica stern. good morning to both of you. ssica, i want to start with you, now that the judge, judge robart, has put an restrain on the executive order, do you adds vise people with valid visas to come to the u.s., or is the situation too volatile and suggest that they wait? >> i actually would advise that they get on a plane and come into the u.s., victor. box the court has said that will a likelihood of success on this lawsuit that has been filed by the state of washington and by minnesota. and so the likelihood of this reverting back to the ban being in place, anytime soon, seems to be low. gentlemen, the white house will be appealing the decision, but ultimately, the fact that this temporary restraining order was issued in the first place is a strong indication of where this is going to go. and where it's headed. >> okay, daniel, let me come to you, this applies nationwide. there have been other findings to the president's executive order that were limited in scope in the district to which the judge presides. judge robart
