there isn't even one degree of separation between if proud liberal o'donnell fan mark abrams and the glenn beck fan jimek and who next year might have kids sitting in the same classroom in malawi at the desks that they contributed. i for one prefer to think of that not as a christmas miracle but as the way we all really can work together for the greater good every day.

jim. we're going bring in dan abrams. it's not uncommon for them to waive. >> after all this bluster. about the defense team, we want to present our side, get them on the record. to come forward at the last minute to say, we're going the waive, that's the only part that makes it unusual. i think this is a defense team concerned about more negative p.r. why did they have sandusky go public? do interviews? they were hoping to change public opinion. now imagine that the accusers come forward and testify, we all report about it. what's going to happen to jerry sandusky? you could argue it couldn't get worse. i think with the testimony of these individuals, pointing the finger at him, sitting in court across from him, that would be devastating as matter of public relations. >> we saw sandusky. he addressed cameras again, speaking in sports terms. we plan to put together the defense to stay the course, fight for four quarters. we want the opportunity to present our side. >> and they will. they knew they were going to lose in the preliminary hearing. we talked about that earlier. the questio

jim. >>> we're going to bring in "gma" legal analyst, dan abrams now. dan, a crucial day. sandusky will be facing all of his alleged victims. we're told that this is going to be the first time that he's seeing them in court. you've been saying this is like a minitrial. what's the goal here for the prosecution? >> the goal is to make sure that this case moves forward to a trial. this is basically a very low standard hearing, a preliminary hearing, to demonstrate to a court there's enough evidence to move forward. they don't want to go overboard. they don't want to present too many witnesses. they don't want to lay out the entirety of their case. they want to present just enough to say to the judge, hey. on each and every one of the counts charged, we've got enough to go forward. >> is it true that the defense could have waived this and not had this hearing? >> and most of the time they do waive it. pennsylvania is one of the few states that requires both a grand jury, which serves as a fact-finder, and then, a preliminary hearing, where a judge rules, there's enough to move

jim, thank you. >>> joining us now is our legal analyst, dan abrams. and the attorney general says it shows a pattern with sandusky. and she went to say, it starts the relationships with gifts and football outings and physical contact. and escalated to sexual assault. >> and prosecutors would argue that that supports the allegations of the early accusers because you have the same grooming process. you have the gifts. you have to take them to the games. you have the way it starts with tickling. that's the way the physical begins. so, prosecutors will say that bolsters the credibility of the early ones. remember, the defense can come back and say, well, the only reason they're coming out and offering these kinds of accounts with this kind of consistency is because they heard about the news accounts of sandusky's previous arrest. so, the defense is going to have an argument to make, whether it will work. >> these two new accusers have come forward after his original arrest. and many people wonder, dan, if you are an alleged victim and you've heard these t
