joining us now, the former top lawyer at the fbi during the russia investigation, jim baker. thanks very much for coming in. nadler tells me he believes robert mueller the former special counsel is an honorable person, in his words. he says he doesn't think they'll need to issue a formal subpoena to get his. the testimony but if they do he can't imagine mueller defying the law. mueller made it clear he doesn't want to do this. do you believe he has an obligation to speak directly to the american people. >> i think if congress asks him he'll go -- >> subpoena or no subpoena. >> i doubt he would need a subpoena to come. he'll show up. he made it perfectly clear he really doesn't want to do this. that doesn't mean he wouldn't and doesn't mean there's not value from the american people to hear from him at least in summary form. >> most americans have not read the 484 page report because they would see him on television talking. >> exactly. i think members of congress would ask reasonable question of former director mueller to get a clear sense of what he was concerned about and he

that is not the diplomacy i learned working for jim baker. mary: the me challenge you.it sounds like you are describing -- there are two traps here. the decline perhaps in american diplomacy. and they decline perhaps in american influence overall. they are related but not the same thing. i have such a distinct memory of setting up the state department well before president trump. 2002, early 2003. colin powell was secretary of state. i'm taking notes on the state department briefing and have this moment where i'm not sure this is where the most impactful american policy is being formulated. that is being done at langley. considering perhaps america is conducting foreign policy with more leverage their policies that are not diplomatic? mr. burns: i disagree little bit. i think you are right that relatively speaking, american influence in the world is not the same as it was at the height of the unipolar moment when i was working for baker in the state department. through natural forces, the way the system works, powers rise over time like china. of course, their own unfor

the opinion lower court wentz against the baker who refused to serve the couple. >> jim, to a fine point what is the end result for gay couples in terms of lgtb rights here, what's the result from the court's decision here? >> there's still confusion, still remains that question as to whether or not business owners can refuse service because of same-sex couples because the business owner has religious beliefs they don't believe in gay marriage. it's still a question out there. all these decisions, including last year, ruled on very narrow grounds. this decision just sends it back to the supreme court and the supreme court has not ruled on that broader question. a lot of the lower courts have said you cannot do this. if you're a business in the public sphere, you cannot refuse service on the basis of your religious beliefs. the supreme court has yet to weigh in and that continues here. we'll wait to see what the highest court in the land will eventually say but it won't be this term. >> highly political questions coming before the court, there have been a couple of cases where the supreme
