jim baker?well, it doesn't have to be a crime as defined by congress in a particular statute like in the campaign election law that i think he was referring to. that's just not what's at issue here. this is an issue that sounds in -- what i mean is it comes from the constitution itself, and so it's congress enforcing the constitution itself. that's what it has to think about. and what it needs to think about is whether the president has violated the constitution in some significant way. i agree this is a very big deal. i agree it shouldn't be done lightly or easily. but in a situation where the president has abused his power to try to stay in power by investigating or urging a foreign power to investigate his main -- his likely main political rival, that, to me, is certainly something that congress should consider as an impeachable offense and proceed accordingly to investigate it. >> susan, what is our understanding about how far-reaching these efforts may go in terms of what the congressional

analyst jim baker served as counsel of the fbi. go to have you with us. as we look at this one thing that stands out to me is the process. the nuts and bolts. we know what the federal law is. i.g. gets a complaint, deems it credible, urgent, the dni is supposed to then give it to congress. we learn now the white house and justice department stepped in here and advised that is not what should happen. can they override federal law in that manner? >> well, they can't override federal law, but what i think probably happened is that the acting director of national intelligence went to either his general counsel or/or department of justice and said what is the law here? help me understand what i'm supposed to do, and the justice department and general counsel presumably gave an answer. they gave him an answer that gives them, gives him the assessment, their assessment of the law. so, look, under the constitution and laws of the united states, it is possible that the i.g. cannot report this particular information. that's possible. it sort of depends what it is.
