there was a pretty overt campaign, i would say, by jim clyburn to do that.of that? it seemed like there was a lindsey graham clyburn attempt to push her that i don't know, what do you make of it? >> i mean, we're democrats, right? democrats don't know how to do this any other way than having internal strife and battles. i try not to pay too much attention to the internal divisions. one of the things i'll say and i wrote about this from the nation is that while i do think that in general the supreme court and courts in general are not diverse enough in terms of professional backgrounds, in terms of educational backgrounds, i think that's a really strong point and a strong point in childs' favor in fact. however, for this appointment, i would not denigrate the women who did go to the elites ivy league school for this position than no other reason than going to elite ivy league school is a way as minority and black woman you protech yourself from the baseless attacks that we know conservatives will make about their intelligence andbrown-jac better on a test tha

jim clyburn. >> i just think it is time to diversify the court, not just as it relates to gender, but well. and, as it relates to backgrounds and experiences. correspondent: in any case, judge childs should be ready for a promotion. she was nominated to the court of appeals last year. confirmation is expected, if she is not nominated to the supreme court instead. judy: and, she joins us now. you have done some more reporting today on judge childs and her work history. what did you learn? correspondent: she is unique in this aspect that she is receiving open criticism from some progressives, questioning her time working as a private attorney for business clients, and also when she was a deputy director of the state labor department. i spoke today to the woman who headed the labor department at the time, rita mckinney, and she told me in her expense over two years with judge childs that judge childs was relentlessly open minded every case she heard, and the fact that workplace situations approved under her in the area she managed during that time. we did our research. it is true that in

that is a reference to south carolina's senator lindsey graham and congressman jim clyburn who are pushingjudge michelle childs. what can you tell us about that lobbying campaign and do you expect any republicans to support a biden nominee if it's not judge childs? >> so both clyburn and graham are obviously pushing very hard for this judge but they have different reasons for doing so. for clyburn, this is a kind of quintessential pick. the two go back a long time. clyburn has a lot of power and believes she's the right person for the job. for graham is seems to be that childs is the most moderate, the most centrist of the folks on the short list right now. she has a history of ruling against criminal defendants, of reeling against civil liberlibe, of ruling for management against labor. i think lindsey graham looks at that record and says, okay, this is someone i can work with and maybe someone who will go -- to the conservative time from time to time. he's setting this up quite nicely for himself. if biden nominating jackson or krueger or someone else, lindsey has the option of saying i
