jim spellman has more for you. >> reporter: nearly eight months after the aurora theater shooting thatlled 12 and wounded 58, james holmes is expected to enter pleas to 166 counts of murder, attempted murder and related charges. >> 109, they need you hot to the front of the theater. >> reporter: court documents indicate that the defense is likely to file a plea of not guilty by reason of insanity. denver dillafficul beller, a de attorney. >> he will be examined by state doctors. any statements made by the state doctors are given to prosecutors. >> reporter: the defense sought to delay the arraignment and have parts of the statute regarding the insanity plea ruled unconstitutional. the judge denied those motions. once holmes enters a plea, the state has 63 days to decide whether to pursue the death penalty. they will take into account the severity of the crimes and other aggravating factors. far from a sure thing. >> a few reasons they wouldn't go for the death penalty, the most important, his mental state. the supreme court and really society has been very clear. we don't kill, we don'

our jim spellman is live for us in colorado, springs. high profile public officials in one place today. right? >> that's right. they're very reluctant to show too much detail. we expect tight security. the man suspected in this shooting, evan ebel, is a member of a white supremacist prison gang called the 211. investigators have been working inside the prison and outside talking to members of this gang trying to find out if there was somebody else involved, if there was a conspiracy, if someone had put out a hit on tom clements. that, of course, puts other public officials potentially in danger. they want to be sure that this is an absolutely safe event. we know top law enforcement officials including the people leading the investigations will be here at the memorial today. caught in all the middle of this is the governor of colorado. not only was he close friends with tom clements who was killed, as a pretty remarkable coincidence, close friends with the father of evan ebel. he really feels that he's kind of caught between all of this.

our jim spellman is live on location. he's in el paso county and joins us by telephone.any light on this, jim, the report that this man was shot as he opened the door to his home, which may, and i just say may, suggest that this could have been a targeted hit. >> reporter: right. here's what we know at this point. it was around 8:30 last night, knock comes at the door, mr. clements opens the door and is immediately shot in the chest. a family member called 911 and mr. clements was declared right there at his home. now, we know he's married, his wife's name is lisa and they have two daughters. we don't know what family members were home or who called 911 at this point. now, immediately the police started searching the area. it's a heavily wooded area, kind of an excerpt of colorado springs in a place called the plaque forest. they were not able to find anybody immediately, so as the investigation progressed, they almost immediately began focusing on somebody who may have had some connection to his work in the prison system, somehow, somebody recently patrolled, somebody w

jim spellman is going through the documents. jim, what have you learned?now you haven't had a lot of time. what have you learned? >> reporter: let me set the stage very quickly for you, erin. a couple of weeks ago james holmes was in court and expected to enter a plea. he said i'm not ready. we will not enter a plea. the judge entered a plea for them of not guilty. monday the prosecution in the hearing right behind me here will announce whether they're going for the death penalty or not. so yesterday the defense put out a document saying that we are ready to accept an offer that takes the death penalty off the table. so many of us read that and we thought something's cooking here. we could have an -- we could have a deal in the offing. the prosecution today filed a very nasty, very, very harshly worded document saying we are not in any way ready to accept a plea. we don't have any of the information we need. and this thing you did yesterday defense by filing this is really nothing more than a publicity stunt. it just blasts them saying not only is it impro

jim spellman joins us by phone, he's in colorado. jim, do you have any more information for us?. it was around 8:00 -- rather 8:30 last night local time when a knock came at the door of tom clements' home in an area called the black forest north of colorado springs. it's a pretty rural area, heavily wooded. and the initial information that the sheriff's office has is that he was shot in the chest as he answered the door. he was then declared dead on the scene. they immediately began a massive manhunt. it is again a heavily wooded area. they were not able to find anybody overnight in the initial parts of the investigation. now, kusa, our affiliate here, is reporting that the colorado bureau of investigation has been brought up. that's a significant ramping up of the investigation. they're a statewide agency that has a lot more resources that they can bring to bear on this manhunt. they don't have a suspect at this point. that's their main focus at this point. as you would imagine, the fact that he was director of corrections, they're going to be looking at that hard, if somebody
