cnn's omar jimenez is over at the courthouse in minneapolis for us.lection was set to begin today but there's been a holdup. what happened? >> reporter: that's right, wolf. essentially, things were delayed by a day. it all centers around whether a third-degree murder charge will be reinstated in this case. so just to give background on this, derek chauvin is charged with second-degree unintentional murder and second-degree manslaughter. initially when the criminal complaint was filed, prosecutors wanted to file a third-degree murder charge. it was dropped by the judge in october. this past friday, an appeals court ruled based on a separate case that now there's precedent to at least reconsider reinstating this third-degree murder charge and, right now, prosecutors say they don't want to proceed with jury selection until it is decided whether this third-degree murder charge will be reinstated. that is the stalemate we are at right now. it is why proceedings stopped or the jury selection process paused over the course of today and has been moved to resu

let's go to straight to cnn's omar jimenez in minneapolis. be ear just minutes away. tell us how today is going to play out. >> reporter: jim, in just a few minutes lawyers and the judge will file back into court. they're going to handle a few legal matters, not sure what those are going to be. we'll find out shortly. 30 minutes after that is when testimony will resume. it will resume with that firefighter and emt genevieve hanson. she was called by prosecutors and this was a chance for the defense attorney, for derek chauvin to ask her questions about what happened on may 25th, 2020. and when the defense attorney had the chance to cross examine not just her, but others, that's when things got a little more contentious. we'll watch for that over the course of today. she wasn't the only one that testified yesterday. we also haerld from donald williams who was feet away from george floyd as he was pinned under the knee of derek chauvin, an mma trainer, as he testified. also genevieve, but also four witnesses under 18 at the time of george floyd's death. so they were not

let's begin with omar jimenez in minneapolis as jury selection in derek chauvin's trial get sets to begin. this is a long time coming, as you know, omar. you were there in the immediate aftermath of this. a lot of anticipation for this trial. >> that's right, jim and poppy. a long time coming, plus a day. because, of course, we were supposed to be beginning jury selection yesterday. we went through that delay. and now this morning, in about an hour, we're expecting jury selection to officially move forward. lawyers for derek chauvin and for the state are filing into court right now to meet with judge peter cahill to take care of pretrial matters. this process is expected to move forward, mainly because the judge in this case said he wanted to proceed while we waited to hear what was going to come down from an appeals court potentially on whether a third-degree murder charge was going to be reinstated. while we wait on that we look at the charges of what chauvin is currently facing. he's currently facing second-degree unintentional murder charges. manslaughter in the second degree as well.

omar jimenez, thanks. >>> i'm joined by laura coats and elliott williams. have you both on this morning. laura, second day of the trial coming up here. watching the prosecution play out that video, it reminded me somewhat of the impeachment case, right, where they relied so much on showing what happened. just play the tape, and now we learned it's 9 minutes, 29 seconds, not 8:46. so long that the 911 dispatch, she thought the image had frozen. you have worked with juries before. tell us how impactful that kind of evidence is, in your experience? >> it's so impactful to set the scene appropriately. this is essentially the case. this is the one time that many prosecutors will ever have in their entire careers to have so many eyes on the actual crime scene. normally you have eyewitnesses who were relaying it. but now you have a video, you have even a longer video than the general public has seen, the entire globe. and, remember, the voir dire process here. some of these jurors, jim, never actually saw the entire video or even saw it once before. they had to be

>> omar jimenez, thank you so much.ant to bring in cnn senior legal analyst, laura coats, a federal prosecutor and host of the laura coats show. we'll be watching you all week long as well. we know this courtroom, you know, will have television cameras. but how does that potentially affect the tone of the attorneys' presentations, the use of evidence, and the demeanor, or even how the public and court might see this case and the defendant chauvin? >> start with the last of it, fred, the idea here that the court of public opinion is going to be watching is an understatement of the year. they're going to be watching to figure out how the presentation of evidence goes, whether, although former officer derek chauvin is the one on trial, whether it's somehow transforms to having george floyd on trial, the idea of the opening statements being an opportunity for the entire world to see what the burden of proof will be and how they intend to actually meet it and the defense an opportunity to figure out and preview for us what t

omar jimenez is outside the courthouse in minneapolis for us. right now we are in recess until early afternoon. this is scene outside the hen opinion county government center. you can see barricades are up, really throughout the entire circumference this property and windows are bored up as well because they don't want this to rev being breached in part because of what happened last may and also from officials in part because of what they saw happen at the u.s. capitol in january. the reason we are if recess is over a third-degree murder charge. chauvin is facing second degree unintentional murder charges. he's facing second degree manslaughter charges both of which he has pleaded not guilty to. but the third-degree murder charge is one that prosecutors initially wanted to file against chauvin but it was dropped by the district judge in this case, peter cahill, back in october. prosecutors tried the reinstate it by going to an appeals court judge. an appeals court judge ruled that the district court should reconsider reinstating that motion. the

let's go straight to cnn's omar jimenez, who is at the trial there in very snowy minneapolis.e delay? >> reporter: derek chauvin's attorneys are asking for the trial to be delayed or a venue change, mainly tied to the idea of unavoidable media exposexpoesure. to use their words, they are gravely concerned about the timing of the $27 million civil settlement between the city of minneapolis and george floyd's family that came out this past friday, mainly because part of the stipulations for the pr prospective jurors is to avoid news of this case. one proceed sprektive juror was already dismissed because she heard a significant amount about it. judge cahill has not made a decision. all he said is he would take this into consideration. he has said, however, he would call back the seven jurors seated prior to today to see if they had heard about the news and to see if any opinions had changed. but until then, week two of three slated for jury selection continues right now. they just got back from a lunch recess. two new jurors were seated today, which means we are well past the hal

omar jimenez is in minneapolis with new information from the city council. what can you tell us? >> reporter: that's right. just learned a few moments ago city council voted 13-0 unanimously for a $27 million settlement in the wrongful death civil lawsuit that george floyd's family filed against the city of minneapolis and against the four officers involved in his death. this is separate from the criminal trials already taking place for derek chauvin and the three others expected to take place later in the fall. attorney benjamin crump made the announcement the largest pretrial settlement in united states history for a wrongful civil lawsuit, and soiouso obvi this is big news. keeping an eye how this was moving forward and weren't exactly sure how it would come to the forefront. we knew there was a meeting from the minneapolis city council scheduled for this morning, but this morning's meeting was about a separate matter, dismantlings police department and replacing it with a more encompassed council. trying to figure what was happening in the closed session. knew it was involvin

omar jimenez outside of the courtroom, appreciate that. let's bring in our conversation, cedric alexander, the former president of the national organization of black law enforcement executives. cedric, it is good to see you. as we watched the testimony unfold laura coates was talking about a few moments ago the compelling point the prosecution is trying to build is that, you know, whatever happened before, yes the defense will say that mr. floyd tried to pass a counterfeit bill, that mr. floyd declined two opportunities to go back in and make amends, if you will, to pay in real cash, that mr. floyd, the defense said yesterday, was high, that mr. floyd struggled with the police officers before the nine minutes and 29 seconds where he is handcuffed, he is prone. officer chauvin is kneeling on his neck. the compelling point the prosecution is making now with witness after witness is that this crowd start today gather and that several members of this crowd asked, please help, take his pulse, do something, get up, he's in distress, and that the
