joan is a biographer of antonin scalia.ion was on the nearly 30 years he served on the supreme court, the most important opinion he wrote? >> well, i would say, if you're talking about ones where he actually had the majority -- oh, good, you can hear me okay. wolf, i think it would have to be the 2008 heller case in which the supreme court for the first time said that the second amendment to the constitution does protect individual gun rights. justice scalia has written many, many opinions. some of his most colorful opinions have been dissents. the ones that charged up the right wing base have been dissents. when you're talking about majority opinions, he get a narrow five-justice group to landmark decision on gun rights. one of his early ones, though, that i'll just mention to you, in terms of dissents, was -- he came on in 1986, and in 1988 he was the lone dissent in a case that looked at a federal statute, he wanted to reject it when the majority wanted to uphold it. he had a memorable line that said, sometimes an issue

among the law clerks are two judges, paul clement, jeffrey sutton and joan larson who was just put on the supreme court of michigan last fall, but you see the former clerks there now lined up. eight supreme court police officers there just at the end of the plaza with the capital building on the other side of the street and it's through that column that the casket will be married up to the supreme court's great hall. this ceremony is something that was familiar to justice scalia because it in 2005 there was a similar lying in repose ceremony for chief justice william rehnquist and at that time he was present and escorted president and mrs. bush as they came to pay their respects. president obama as you know, chris, will be here later today. we don't know who will have the honor of escorting the president, but it's right up through those two columns of people that the court's great hall is the space between that ceremonial entrance to the

and i certainly see joan's point about cutting the president down to three years. but the politics of it, could this affect, impact turnout in this election this year, on either side or both? >> i think the president making this -- making his decision now, before the election, puts this in front of other issues, as a big election issue. obviously it becomes very critical for democrats to turn out to get a democratic president, and a democratic senate, if they can. to help their appointees get through right now we have i've lost count of how many judicial appointments are still in limbo. being stalled by the senate. one woman who had been a very capable supreme court nominee was just recently withdrew after having been delayed for two years. this is the kind of thing that is quite unprecedented but indicative of the kind of polarization that we've seen in the last few years during the obama administration. >> joan, let me go back to your point about the unprecedented state of denying or saying the president should make an appointment. the fact is that for the last h
