jodi hernandez is in court as the charges were outlined. she joins us live from sacramento with more. >> jessica, muller's attorney said he plans to plead not guilty in this case, but a federal prosecutor today in court described him as dangerous and unstable and says he should be treated that way, even inside the courtroom. so with arms and legs shackled, matthew muller appeared in a packed federal courtroom. he's been formally charged with kidnapping denise huskins from her home back in march. prosecutors now have 14 days to issue an indictment. that could include more charges. huskins claimed she was raped during her two-day ordeal. her boyfriend, aaron quinn, said he was bound and drugged. a family friend says the accusations are completely out of character. >> he was intense kid. a success. high achiever. always worked hard at whatever he did. you know, in the family, just outstanding. >> muller's parents, brother and friends attended the court hearing. a family friend said they are shocked and devastated by the allegations. muller wil

jodi hernandez is live along the river. you spoke to the owners of that dog. what did they have to say, jodi? >> reporter: jessica, they are absolutely heart broken. they were here at the russian river on saturday for their annual rafting trip, when a couple of hours in, their dog, posey, began having seizures. tonight the river's been closed off to pets. but not people. health warnings are going out tonight along the russian river. river goeers are being told not to drink the water. health officials say blue/green algae blooms forming along the water's edge may contain a potentially deadly toxin. >> we are advising people to take precautions. this is a health warning. we are telling people, do not go where there's algae. >> reporter: the warnings are being issued after a golden retriever that was out kayaking with its family on saturday died. tonight dog owners are being told not to let their pooches in or near the river. >> we're focusing on the dogs, because they are most likely to go out and be in the water, drink a lot of water, eat the algae. >> reporter

nbc bay area's jodi hernandez is in middletown this evening. this isn't a one-month process here. it will take more than a wrayea for a lot of people to get back on their feet. what happens now? >> reporter: it's going to take a long time. evacuees are transitioning today moving on to a new phase in the recovery and rebuilding process. now, in one hour from now, a special meeting will take place here at middletown high school to help guide them through that process, but for many, today was all about transitioning from a makeshift community in calistoga back here to middletown. ♪ after nearly two weeks camped out at the fairgrounds in calistoga, fire evacuees had to pack up and head out today. >> they took us in. gave us tents. put the tents up for us. >> reporter: calistoga evacuation center officially closed this morning, but the friendships and bonds made there aren't going anywhere. the determination to rebuild is strong. >> we're hanging in there. yes. you can't not be inspired to hang in there when you've got people around you that we have. so you're inspired to hang in there

jodi hernandez is in vallejo this evening with the latest twist. >> reporter: the victim's attorney say the way police treated the kidnapping victims was absolutely shameful. today they filed this claim against the city for the harm they say the pair suffered. >> the police took the al too common approach of blaming the victims. >> reporter: attorneys for kidnapping victims denise huskins and aaron quinn say that the vallejo police intentionally destroyed their lives and reputations. six months after their terrifying ordeal, attorneys filed a claim against the city of vallejo. >> they were innocent of their alleged crimes yet they were painted to the world as having been involved in a terrible hoax. >> reporter: investigators say that huskins and quinn were blindfolded and bound by an intruder as they slept in their home in march. the intruder kidnapped huskins for two days during which she says she was raped. but the vallejo police characterized the whole thing as a hoax. >> the statement that mr. quinn provided was such an incredible story we initially had a hard time believing it. >>
