nbc bay area's jody hernandez was feet away when it happened. jody and her photographer found themselves in the middle of a crime scene. here is the moment as it unfold and jody explains what happened next. >> we have shots fired. >> shots went off as we were getting ready to do our 5:00 live shot from occupy oakland. >> people started screaming and running and when we made our way to the west end of the plaza, we saw a young man on the ground wounded. police and emergency workers got here within minutes. i watched as they pumped his chest and tried desperately to save his life. it was very clear he was in grave condition. i pulled out my cell phone camera and began recording the scene. it was very chaotic. police were pushing us back as they cordoned off the area. >> the photographer was pushed around a bit by people in the crowd and at least one other photographer was beaten. our colleague at channel 7 took a blow to the head. like many of the occupiers, we too have been camped out here, covering the occupy oakland movement day after day. toni

jodi hernandez is live at the police department there with new details about that alleged shooter, jodi. >> reporter: jessica, people have been stopping by here all day long to drop off flowers. you can see the makeshift memorial, how big it is getting tonight. people we talked to today says officer capoot was a stellar cop who gave anything and everything to help his community and to lose him is devastating. >> we went through this not too long ago, ten years ago. >> reporter: officer jeffrey bassett had a tough time holding it together as he updated reporters on officer james capoot. >> it's tough for many of us and especially for his family. nobody's hurting more than them right now. >> reporter: today, police released the name and photo of the man they say is responsible, 37-year-old henry albert smith of fairfield. sources tell nbc bay area smith who recollects lives in this middle class neighborhood s a former parolee, a felon with a history of possessing guns. >> he is the only suspect in the bank robbery, the pursuit of the -- vehicle pursuit and the killing of officer capoot. >

of course jodi will be there and cheryl hurd is on the scene. they shut down the 12th street b.a.r.t. station for a short time but that has sips been reopened. >>> we talked about some of the news photographers and journalists being injured. is that still an active scene where you are? >> reporter: you know, it is very tense out here. before going live there was some tense moments and i witnessed somebody putting on a black mask. we heard a short time ago what sounded like some breaking glass. so i don't know what's happening on the other side of the plaza, but there has been a very hostile mood from a small portion of the camp, i've got to say, towards the media really from the start. and tonight two news photographers we understand were injured. i talked to actually the reporter of one of the photographers who told me that the kgo photographer was bleeding from the head and thought that he may have a concussion. she also told me that a ktvu photographer was actually wrestled to the ground. when my photographer ran down there, of course we were

reporting live in oakland, i'm jodi hernandez, nbc bay area news. >> okay, jodi, thank you. so jodi is where the francco gabl plaza is, right at city hall, still hundreds of protesters there. now a live look toward the port of oakland, one of the entryways there, and there are still hundreds of people making their way towards the port. around 4:00 this afternoon is when the large mass of people started walking, biking, and busing towards the port of oakland, and when there are now an estimated 3,000 to 4,000 people at that location. so really two locations of protest here at the port and at city hall. around 5:30, we were able to confirm that the port was shut down. and port officials, during a news conference a short while ago, estimated that each day the port of oakland is shut down, they would lose an estimated $8 million. so not quite clear of how much the port will lose tonight, but officials did say in a full day, the port of oakland would generate and lose up to $8 million. so the oakland police department now says it has asked for help from the chp to direct traffic

jodi hernandez joins us near the family home where the community is gathering. i imagine this is going to be an emotional night. >> reporter: it's been a very emotional evening here in danville. the fallen marine's family just returned home within the last half hour or so. they were in delaware attending a special ceremony. i'll tell you, the community's show of support here tonight clearly touched them. now, several hundred of the family neighbors and friends lined the streets leading up to the family home. they were holding signs and carrying flags to show their support. 19-year-old josh was killed last week in afghanistan. he was a member of the infantry and we're told he was always on the front line. his parents and three brothers returned home as they took part in a ceremony as their son's body arrived back to the u.s. from overseas. people came out in force to show the family how much they are hurting and how much they care. corral's parents say they appreciate all the love and support. >> thank you so much. it's truly overwhelming. >> this means a lot to

jodi hernandez joins us with the latest. i hate to say it, it sounds like a broken record, been there done this before. >> reporter: jessica, they are back. 12 hours after the city cleared out the encampment t protesters flooded back into frank a ogawa plaza. late this afternoon, hundreds of protesters gathered in front of the city library, it's about five blocks from city hall where they began to rally the troops. then, they took to the streets as you can see. they are promising to set up their occupation leaving some to wonder how long will this go on. as promised, the city reopened frank ogawa plaza just before 5:00. after spending the day cleaning it up and clearing it out. for the second time in three weeks, city workers dressed in hazmat suits and scrubs. earlier this morning, police raided the camp, arrested 32 people who peacefully resisted. hundreds more looked on from the street. >> eventually, they will learn they will keep clearing it out. >> we had repeated violence and this week a murder. we had to bring the ca

reporting live in oakland, i'm jodi hernandez, nbc "bay area news." >> okay. jodi, thank you. >>> a controversial crosswalk will get a second look tonight. the east palo alto city council will discuss safety measures at what some call a dangerous and deadly intersection. a second grader was killed at bay and gloria roads while walking to school in september. a consultant hired by the city said state guidelines require five deadly collisions within 12 months to justify new stop signs. this intersection has had four collisions in the past 12 months. tonight the city council will consider a number of new safety measures, including lighted crosswalks and perhaps more signs. neighbors say something must be done. >> like two days ago a lady was speeding really fast and i was like, hey, hey, hey, don't you see that little kid, and the cross guard was right there. they don't really care. >> in addition to the other measures, the council could still vote to install stop signs. we'll be at the meeting tonight and we'll bring you the outcome on our 11:00 newscast. >>> sa

he never got a chance to fully find his way. >> that was jodi hernandez reporting. whether they are part of the occupy movement or not, there are thousands of disenfranchised college students and teachers. today, many of them were on the picket line instead of the classroom. the faculty went on strike today for the first time in the school system. the walk out is just now wrapping up. we have seen the protests at uc berkeley and yesterday in long beach. is it the tuition? >> reporter: today, it was about the faculty salaries, but there were students here to accompany them and protest the tuition increases. yesterday in long beach, that was a very violent scene. a building was vandalized. several officers were injured. today, at this campus, it was a peaceful protest. administrators say they appreciate the more civilized approach but they still don't approve of this action. >> i decided to join my other faculty colleagues on the picket line. >> reporter: the hayward campus was empty. instead of teaching, she's fighting for the educational system and her livelihood. >
