joe biden. joe biden has always supported legal abortion. but nine years after the roe decision was handed down, he was willing to admit it was indefensible as a legal decision. pregnant women, biden explained in 1983 as a member of the nate judiciary committee should not have the sole right to say what should happen to their unborn children because nobody creates children alone. it takes two people. that is obvious. in fact, biden concluded that roe had gone "too far." of course, it had gone too far. that was obvious then and obvious now. then as now, many americans believe that abortion is murder. many other americans consider abortion a prerequisite to happiness. those are unreconcilable positions. in a democracy, we have a solution to quandaries like this and it's called voting. if we don't like something, we elect representatives to act on our behalf. if they do what we want, we re-elect them.if they don't, they're voted out. that's how the system works. for hundreds of years we've used that to solve complex and thorny moral issues. not just abortion. many others and worked well. that's why this has been a stable country because we get to rule ourselves. roe v. wade took that right away. in a single 1973 decision, the high court bans democracy from the debate over abortion. justices prohibited the states from enacting abortion restrictions that their own citizens strongly prefer. that meant going forward, alabama would be required to have the same abortion laws as massachusetts. some people love this. of course people in massachusetts loveded it. people in became became hated it. there was nothing that anybody could do about it because supreme court had cut voters out of the equation. as a result of that, the issue of abortion was never resolved. things are not resolved by fiat. only consent. it's the core of democracy and it's true. as a result of this short circuiting of democracy, demands from the left forced it. as a result of that, for nearly 50 years, this issue has festered. it's given americans another reason to dislike each other. it's divided the country. now finally after 49 years, voters might have the say over what to do about abortion as is their right. according to a piece last night in the blog politco, the majority of justices on the supreme court are ready to overturn row. justice alito said clearly in a draft opinion you can read yourself because it's circulates on the internet. we should be able to read it. it's not for the public. a final official decision is supposed to be months away. and yet an unnamed liberal objective short circuited this ancient process which has worked well for hundreds of years. this person leaked the opinion. not by accident. the point of leaking the opinion was to intimidate conservative justices in to reversing course. mob justice. if you're shocked by that, you shouldn't be. remember that it's not so different from what we saw this january when another unnamed liberal operative leaked the news that justice brier was planning on retirement and that forced him to retire which liberals wanted him to do because he was a white man. so that was in other words another op. one of many that we're seeing in our country. as if to prove that within moments of this story breaking last night, a mob formed a flash mob at the supreme court. watch. well, the upside is they're not telling you it's your body, your choice. even these people couldn't pull that off with a straight face after forcing manies to inject an experimental drug against their will or be fired. so they can't claim bodty autonomy anymore. so now they move to name calling. you're a fascist if you agree with them. they've been preparing for this moment for quite some time. the supreme court is debating the constitutionality of a mississippi law that bans abortion after 15 weeks. during oral arguments in this case in december, justice alito noted that "the fetus has an interest in having a life." that's true. but when he said that, plans for retaliation began. no one wanted sam alito to vote the wrong way. now those plans are underway. it's no exaggeration to say once the step gets going, you don't know where it winds up. people can get hurt because of this leak. you hate to think it could happen and you hate to think it could happen. people do. here they are. ada chavez works for the nation. she's some kind of reporter. she tweeted it's good that conservative justices and their families will have their lives threatened. she's in favor of that. over at vox.com, ian millheiser shouted f it, let's burn this place down. government by tantrum. and brian fallon, the executive director of the activist ground "demand justice" or else, said this quote, is a brave clerk taking the step of leaking a document warning the country in a last ditch hail mary to see the public response to make the court reconsider? like do what we want or we will hurt you? these are threats of violence. the ceo of planned parenthood is calling on activists to storm state capitol buildings. watch this. >> we know this decision will enrage people. we know, we've seen what has happened when people find out that when they found out what was happening in texas, they started filling state houses in florida, they started filling stale houses in other places because they know the fight right now is on the ground and in these states. so we're going to continue to capture that rage. >> tucker: we're going to capture that rage. people get angry and you wouldn't like us when we're angry. don't we have a system in democratic norms we're supposed to observe? any supreme court decision must remain in place forever or else you're committing an act of insurrection. legal scholars out there, are there any supreme court decisions throughout the ages that were overturned and happy we're overturned? time on this issue because we could be spending time on things that people want. i've been hearing the democrats speak for a year and a half about the necessity of getting prescription drug prices down and why couldn't we be talking about that instead of wasting time on this legislation that's made to make a political point instead of accomplishing something. i'd like to speak then about the very extreme legislation voiced by democrats, the women's health protection act. democrats are using a leaked supreme court draft, not even a final decision, as an excuse to push a very radical legislation that goes beyond public opinion, or even common sense on abortion. this bill goes much further than its stated position to coulded phi roe vs wade decisions. as ranking member of the senate judiciary committee i've raised many concerns about this legislation. the so-called women's health protect act would involume date hundreds of abortion-related laws in our very estate, such as clinic regulations, admitting privileges requirements, regulations on abortion-inducing drugs, reflection periods, conscience protections, sex selection bans, and limitations on the use of state funds and facilities for abortion. iowa and many other states have taken action on their own to enact common sense restrictions. i don't think this bill is common sense because it allows late term abortions which could be up even to the day of birth. some states have protected individuals from having to perform abortions against their own religious beliefs. we can't stand by as those common sense laws are under attack by the democrats and this legislation attacks those laws. the bill before us would involume date these state laws and would allow abortion providers to set the standard of care for their patients with no oversight from the states. it would allow health care workers to determine when a life is viable, which will lead them to inconsistent practices across the country. and endanger the lives of mothers everywhere, if the bill before us were to be signed into law, the federal government would send a message to states that enacting laws to protect patients and regulate the health and welfare of their citizens is not the right of the federal government. it would allow congress to include on state strikes and nullify life saving laws on the books. it would invalidate the police power of the state under the 10th amendment in regard to those police powers affecting the health of its citizens. in addition, this bill establishes no private right for women harmed by abortions. how can we, as congress, stand up and say that we're protecting women when really, this bill disregards any loss of life of babies, including full term infants and even some mothers. democrats claim this bill is a necessary and moderate step. how can a sweeping piece of legislation that would overrule dozens of state laws and establishing terminating pregnancy as the only option be classified as a moderate piece of legislation? no, this proposed legislation is an example of extreme extremism. it's unfortunate that the majority is using this issue to appear compassionate and concerned about women's rights when in reality, the bill disregards popular and common sense laws that protect women and children across the country, large majorities of americans support strong abortion restrictions. this bill would overturn. i understand and appreciate the robust debate around this subject, however, i'm uncomfortable with the rhetoric of some of my colleagues. they refuse to discuss the important priorities of what the american people want and only want to push one extreme option. let me be clear, abortion should not be promoted as a default contraception and family planning tool. let's have a protect-- productive discussion on what can be done for women and families. it's important to be open with our colleagues and our peers on our differences, but we must unite to protect life because every single life is precious. the women's health protection act is an extreme piece of legislation that completely disregards human life. i intend to vote against the motion to and end to the rights, so many women have lived with their entire life seems unthinkable. but this is real, this is happening and republicans have been preparing for this for decades. we're about to see a tidal wave of abortion bans across the country. so this vote today will force republicans to face up to the hurt and suffering they have caused and will cause. the lives that hang in the balance, and we all know that if roe falls, the heaviest burdens will land on those who already face the greatest challenges, mothers who are barely scraping by. it's black women who already face a severe maternity mortality crisis. it's indigenous women, especially those on tribal lands who suffer violence at unprecedented levels. it's women with disabilities who already face discrimination in medical care, it's women in rural communities who have less resources and who are often already forced to drive miles to get the care they need. it's immigrant women, especially undocumented women, and it's our gay and trans neighbors who republicans never seem an ability to scape g.o.a.t. or bull in my state new this will impact them too and many of scapegoat or bully and many of my colleagues know, i'm not one to grandstand to come before the senate. when i said this was a five-alarm fire, i meant it. we need to be clear-eyed that this will impact all of us. for one thing, we know the health care crisis caused by abortion bans, and that's what they are, crisis, will stretch across state lines. when texas passed a law letting people sue strangers for getting or providing an abortion, desperate patients rushed to oklahoma. only for that state to pass an extreme ban as well. meaning more patients travelling even further with fewer options to get the care they need. and we're seeing this firsthand in my home state of washington. after idaho passed a draconian abortion ban of its own, patients were surging into washington. there can be no question, if roe was struck down nationally, if individual cases ban the right to abortion, people in every single state will live with the painful consequences of that decision. and they will not forget republicans are the ones responsible for this. and madam president, let's also remember, republicans have been clear, they have been explicit, even that they are not going to stop at roe. they're not going to stop at the state level and they're not going to stop at abortion. i can't say this enough. republicans are already talking about passing a federal ban on abortion. republicans are already talking about how griswold, the case that struck down a ban on birth control, might have been wrongly decided. republicans are already talking about banning iud's, plan b. they even held a vote a few weeks ago to undermine our federal family planning program and make it harder for people to get birth control. madam president, it is clearer than ever that because of republican's extremism, not only is the right to abortion at risk, but other important rights are as well. that's why people are so scared and that's why they are so shocked. someone back home said to me last week, what can i tell women in our state so they don't worry. i said straight up, i'm not telling anyone not to worry. i'm scared and i am frightened for women in this country more than i ever have been before. i'm very fearful, madam president, but i'm also determined and i know people across the country do not want to go backwards. they do not want politicians planning their families for them. they do not want politicians forcing people to stay pregnant. they do not want this to be the first generation of women with fewer rights than their mothers, which is why today, we are now voting on the women's health protection act. what this bill does is simple. it follows the constitution and nearly half a century of precedent and gives the patient the right to get an abortion no matter where in america, that patient or doctor lives. and the question every single senator today is asked is simple as well. do you trust women? do you trust patients? do you trust doctors? do you believe every american should be able to make deeply personal decisions about pregnancy and parenting according to their own belief without government interference? if your answer is yes, then your vote on this bill should be as well. if your answer is no, if you think that women should have fewer rights. if you think it's okay for republican politicians to force someone else to stay pregnant or give birth when they don't want to, you'll
