nbc's joe fryer starts us off tonight from sparks, nevada. joe, good evening. >> reporter: good evening, brian. police are still trying to figure out why a seventh grader showed up here at sparks middle school and started shooting. investigators want to figure out if there is any connection between the suspect and the victims. meanwhile, police say one of those victims, a popular math teacher, actually sacrificed his own life to save others. from beginning to end, police say the shooting spree lasted just three minutes. >> can you please send police out here? there's a kid with a gun. >> reporter: for the many witnesses who saw it unfold, it felt much longer. >> i have a victim on the basketball court, left side. >> reporter: students were arriving for class outside sparks middle school yesterday, when police say a 12-year-old boy started shooting. investigators say he got the .9 millimeter semiautomatic handgun from his home, but the motive remains a mystery. >> everybody wants to know why. that's the big question. the answer is, we don't kno

in sparks, nevada, i'm joe fryer, for nbc news. >> what a horrifying scene. thank you very much.nd the family closer to home, the family of a murdered berkeley man has resolved its wrongful death suit, the lawsuit against the city, after calling police for help. peter sekor was killed outside of his home last year allegedly by a mentally disturbed intruder. his widow and two adult sons, they say a police dispatcher falsely promised an officer would be responding to that call and without admitting any faults in connection with this lawsuit, the city has agreed to implement changes to its communications center to improve public safety. in addition, dispatchers will now be able to tell callers that officers may be delayed. >>> happening today, protesters are hoping to stop a new san francisco county jail from being built. tonight the city's board of supervisors is set to consider a grand am indication for $80 million in state funding to build the facility. opponents say they'll be at tonight's meeting to try to stop that resolution from moving forward. the $300 million facility woul

>> joe fryer, thank you. >>> what a horrible story. let's catch up on some of the other headlines from overnight. tom llamas is back. >> we start in the midwest. students at indiana university bloomington get the all clear after being on lockdown for hours this morning. police are still looking for two male suspects on campus, one possibly armed with a knife. students were told via the university's twitter page, to take shelter in the nearest room, lock the door, avoid windows and stay inside. three students got into a fight at an on campus building. they say one of the students pulled the knife and slashed another one. he was taken to the hospital with non-life-threatening injuries. police are looking for the two other students. >>> the mother of the teen accused of killing a high school teacher in massachusetts says her heart is broken over the tragedy. the attorney for diana chism released a statement that read in part, ms. chism would like you to know that her son was born in love and is dear to her, very dear. she's struggling to

joe fryer has the story. >> reporter: for shooting survivor mason -- >> i heard a gunshot. then another one. >> reporter: what makes monday's tragedy at sparks middle school harder to deal with is he considered the gunman a friend. >> i knew i wasn't being targeted. i never did anything to him. >> reporter: mason, a 7th grader whose family asked us not to use his last name, was standing outside the building when he heard gunshots. >> and that's when i saw michael lansbury on the ground. >> reporter: mason ran to help the heroic math teacher and came face to face with the shooter identified as 12-year-old jose reyes. >> i'm like, please don't shoot me. you need to get in the building. please don't shoot me. he raised the gun and shot me. >> reporter: though he was hit in the stomach, mason ran away from the shooter and met security guard lou bergarelo. >> he was the first one to me. i was like i'm shot. >> he was good. he kept talking to me. god bless him. good kid. polite kid. >> reporter: he made sure mason was quickly treated. mason is now mourning the loss of teacher mic

joe fryer caught up with his mother and mason. d he tell you. >> he is doing surprisingly well. he is out of the hospital. he was even up walking around yesterday. he tells us he is grateful to be alive but mourning the loss of two friends. the math teacher and he says the shooter. >> i know i wasn't being targeted. i never did anything to him. >> for 1-year-old mason it has been a week of loss and also luck. >> i'm feeling great. a little hurting. but it's a lot better than what happened on monday. >> like so many of his classmates, he was standing outside the building when the gunman started shooting first hitting another student in the shoulder before taking down math teacher mike lands berry trying to stop the gunfire. >> you heard the gunshots. and you saw mr. land wherry was down. your instinct was to run to him? >> run to him and help because i'm a very helpful person. >> in the chaos he came face to face with the gunman identified as 12-year-old jose reyes. >> i'm like please don't shoot me. you need to get in the building.

joe fryer with the latest. >> reporter: craig, the fbi is now investigate this case which stems fromfrontation last tuesday afternoon. officers say that they thought a boy was carrying an assault rifle only after shooting him did they realize it was in fact a toy replica. this has sparked protests throughout santa rosa california who have been protesting the shooting death of andy lopez. classmates even walked out of school this past week, marched to the sonoma county sheriff's office and scrolled messages in wet cement that just happened to be drying outside of the building. it all happened tuesday afternoon. investigators say two sheriff's deputies spotted lopez walking around with what they thought was an assault rifle. investigators say the deputies asked lopez to drop the gun. one of the deputies described it as the subject turning toward him, the barrel of the assault rifle rising up and turning in his direction. this all unfolded in a matter of seconds. one deputy opened fire. lopez was shot seven times, only afterwards did officers realize the gun was actually a replica. the

joe fryer has new details on the investigation. joe, good morning, what are we learning?> reporter: good morning, savannah. police are now trying to figure out what motivated a student to bring a gun to school and open fire, killing a teacher and injuring two students before shooting and killing himself. >> i'm calling from sparks middle school. we have a shooting at our school. >> reporter: when the sound of gunfire erupted outside of sparks middle school, mike landsberry quickly stepped forward. >> the teacher fell and everybody ran away. >> reporter: landsberry, a national guardsman and former marine, died at the scene. he was 45 years old. >> he loved everyone and wanted to protect everyone. it's hard on us to lose him. >> reporter: authorities say two students were also shot, including one who tried to helped teacher. both of those children are expected to survive. >> one was shot through the shoulder. the other shot in the abdomen. >> reporter: in all, police say 20 to 30 people witnessed the shooting, which took place as students were arriving for class. >> this is

nbc's joe fryer is in sparks again this morning following the investigation. joe, good morning to you. >> reporter: good morning, savannah. investigators say the seventh grader took a handgun from his home but it's still unclear why he opened fire before taking his own life. this morning, the school remains closed but out front there's a growing memorial paying tribute to a heroic victim. in the minutes following monday's shooting there was a desperate search for answers by anyone connected to sparks middle school. >> i drove through a barricade basically just to get some information. to have somebody talk to me. >> reporter: reggie landsberry was looking for his big brother mike. a math teacher at the school. he soon learned mike was the only gunshot victim that didn't survive. >> i'm still in shock, man. it's unbelievable. it's like a terrible dream. terrible. >> reporter: but as the hours passed he also learned how mike physically put himself between the 12-year-old shooter and students like jose cazares who spoke to us yesterday on today. >> he was telling
