mark haleprin and joe klein back at the table joining us from capitol hill.here with us today. >> good morning. >> you filed a friend of the court brief with the supreme court on prop 8. give us the filing. >> well, the gist of it is a legal procedural issue which is the issue of standing and essentially we are arguing that mr. hollingsworth who has said prop 8 is unconstitutional. we're saying he does not have standing to be before the united states supreme court since article 3 of the constitution requires that if you go before the supreme court, you've got to have something at stake. and he has nothing at stake. because, of course, allowing ms. perry marry her partner of 16 years is not going to harm him in any real way. >> not that long ago, your state voted to make gay marriage illegal. what would you say to the millions and millions of californians who don't want the law of the land to be the same-sex marriages legal in california. what would you say to that? >> first of all, that was five years ago that prop 8 was voted by 52% of californians. today an

my "time" magazine joe klein wrote a blog asking whether claims were processed in terms of severity.ith the lobbying power within veterans administrations and veterans associations, you know, on the part of older veterans, that perhaps younger veterans with more severe issues weren't getting the attention they need. what would you say to that? >> joe is a friend of mine. you know, i should have explained to him we do prioritize our claims. if you're homeless, if you're in financial difficulties, if you're a degree of medical medal of honor recipient and i brought up the issue of agent orange. for four decades, you know, administration after administration had looked at agent orange and said that is probably not related to the current conditions and it took this secretary, wounded vietnam veteran to say it's time for justice and time to get this right. so we did prioritize the vietnam vets after four decades of waiting. >> tommy sowers, you're a veteran and working hard for your fellow veterans today. we have to do better and i hope you'll come back and keep us posted on this. >> than

sandusky basically speak for joe paterno from jail and jerry sandusky is clearly not that credible at this point. >> sara, thanks for joining us. we want to bring in tom kleinvictim number five. he was present for the entire sandusky case from the preliminary hearing to the verdict and tom let me ask you right now what do you make of sandusky speaking from prison in these recordings that are being played this morning? >> well, to whom he's speaking is interesting. sandusky and a paterno advocate are certainly odd bedfellows. mr. paterno certainly was complicit, and there certainly were major problems with his conduct. mr. sandusky was the root of all of these problems, and mr. sandusky is now saying the same old thing that he has said over and over and over again. he is a convicted felon, and he's going to spend the rest of his life in jail. that's the reality here. >> so what's the motive behind sandusky cooperating with this documentary, and for allowing himself to be taped behind bars and allowing these conversations to be aired? what what does he gain? >> mr. sandusky has always looked for a friendly forum. most interesting part of the sandusky trial, a
