cnn's legal analyst joey jackson here now. joey, good to have you here. >> good morning.pens is, for the short term, this particular ruling by judge alito just says we're going to stay the decision, all right? that means that we're not going to implement the decision until thursday. and that decision they're talking about is abortion law in louisiana set to go in effect that was passed in 2014 that limits the privileges of women. or i should say it requires doctors to have admitting privileges at hospitals within 30 miles of an actual place of the abortion being performed. so what happens is, you had a local justice, a district court justice at the time, and that district court justice says, hey, that's unconstitutional because you're burdening a woman's right to have an actual abortion. that is her right. and ultimately what happens is, that was appealed to the fifth circuit which is conservative i should say. 10 out of the 15 justices are republican. what they did, they struck down and said, no, the law can go in effect. and now you have the supreme court deciding. and

joey, good to see you. walk us through what you expect will happen at today's hearing. >> so, dana, good to see you as well. here's the reality. the reality is that today is about whether or not he will be detained or otherwise released. remember now he's a criminal defendant having been indicted and judge has to make a decision about custody. that decision could be that he remains and is remanded or it could be he's released with conditions. i would suspect he would be released with some conditions perhaps the sur sending of his passport but it's a bailable offense even though they asked for no bail. that is based on the severity and significance of it, prosecutors want to assure that he appears to fight the case. but, remember, sara cidside ders said, there is a presumption of evidence. so the judge may say you can go out but make sure you return to court. so the purpose of bail is to make sure you return to court. so i would suspect he would get bail later today. >> so joey, these allegations took place
