i want to bring in cnn legal analyst and criminal attorney joey jackson and ron johnson, a veteran of the missouri state highway patrol. captain, what's your response to what we just saw on that video, the shooting of this 13-year-old adam toledo? >> my heart goes out to his family, a young man with a future ahead of him. but like his attorney said, we need to just see how this analyzes out. but it doesn't change anything. it's still a 13-year-old boy. we have to make sure in law enforcement that we're doing the best that we can and our training is the best to make sure these unfortunate incidents do not happen. >> you heard the lawyer for toledo's family saying that his hands were empty when he was shot. he never had a chance to comply with the police officer's orders. does the evidence you've seen so far support those assertions? what does it mean for this case? >> let me address that, wolf. good to be with you. here's the reality. we as hlawyers make analogies ad distinctions. this is tragic, it's heartbreaking, it crushes you. this is not george floyd where you have an instance wh

it's invaluable. >> joey, good to see you. i want you to take the role of defense counsel here, okay? you just need to raise doubt in the mind of one juror, right? how do you do that? >> yeah, don. good evening to you. good evening, laura. listen, this is about the rules of engagement, right? we have to understand that and recognize that you have a system where 12 jurors have to be in accord, right? and any one of those jurors who for perhaps any reason really is sympathetic to the police, thinks that police are not out there looking to do anything that's untoward, inappropriate, certainly illegal, you play for that audience of one. you get the audience of one, you have a mistrial. i think what the defense is doing here, and it's a stretch admittedly because the other rule of engagement is you have to just demonstrate that the neck compression is a substantial cause, not the sole cause. so you could have all these contributing factors. the defense is looking at fentanyl and they're making really headway with respect to the lev

joey, lovely to see you. let's talk about this.rosecution will question the minneapolis police chief this week, and how explosive is it for the police chief to testify against one of his own officers. ? >> it's compelling. we have already seen two officers testify, and one was a sergeant for 27 years and he gave the indication that this just should not have happened, that there was a time when there was control gained by chauvin of floyd and he should have stopped at that point, and that was lieutenant zimmerman, he indicated you cannot do this. so you follow it up, right, to your question with the chief himself saying not only can't you do this, but i fired him the next day and it really spells a lot of trouble for the defense. the defense is trying to paint this as a force that was appropriate, and it was necessary, and this is what you do, this is how it looks. but it just doesn't really pass the reasonableness test, right? if you examine it, the defense is making the argument, he, george floyd, could have come back out of uncon

so shaking your head in agreement with joey, but what is happening behind the scenes as well? >> absolutely. i think behind the scenes number one, they'ring getting ready for sentencing. the prosecutors are already moving. but, you know, you got three other officers that are also charged. and that trial is going to come up relatively soon, in a couple months, i think. those will be different standards and they're looking at that, but they're going to be ready for sentencing and i think there's going to be two things happening with the department of justice. number one a civil rights investigation that will involve the conduct of all of these officers. but also, i think the administration held back just a big on the law enforcement reform measures that i think president joe biden wants so badly to get accomplished in his administration. it certainly wouldn't have been the right thing to do in the middle of this trial. now that the trial is over, it's a way to reach out to both law enforcement, their unions, and others and people across this country. people are breathing a sigh

joey jackson, you've been involved in a lot of trials here. chauvin chose the judge rather than the jury to do this on the expectation that a judge would be potentially less emotional, right? follow those guidelines to a t. based on what we know about aggravating factors and how they influence sentences, for instance, the fact that children were present, that he abused his position of authority, these are among those aggravating factors. how do you see the math coming together here? >> good morning to you, jim, poppy and laura. i see the math coming together in a very compelling way. i think laura is right with regard to tempering expectations. however, in the event the judge does his duty, and i think he will. this jury spoke volumes as to what they believe. they spoke volumes as to what conduct they observed. and they punished that conduct. they punished the excessive force. we saw that with the assault they concluded which led to the death. they punished the lack of humanity that chauvin had with regard to dealing with george floyd. how cou

joining me now joey jones, retired marine bomb technician, fox news contributor. served in afghanistan and i ask you today, joey, to bring in some of the elements to show us what it was like to serve and give us your response on what biden is about to do. >> first of all this is a continuation of something president trump started which was to use the narrative to capitalize on the fact that americans are sick and tired of a war. in 2010 there were 100,000 troops in afghanistan. when you broadcast a pull-out date with 100,000 troops scattered all over a country it is very dangerous to do and empowers your enemy and allows them to go and attack in places like where i was at and where i lost my legs i believe because the enemy felt empowered in a place we thought would be a relatively slow summer and not that much fighting. what president obama did was very dangerous. this is much different. we have a few thousand troops in afghanistan that are more secure places and there for a different mission than what i was there for. for that reason i don't know the date really

let's start there, joey. as i said, courteney, george floyd's girlfriend, gave us a window into what he was like as a person. how much fun they had going out to dinner. he loved food. she loved food. i mean, it was -- we use the word humanizing, but you really got a picture of what he was like. and she spoke plainly about their substance abuse. do you think that that ultimately hurts the case against derek chauvin or helps? >> good morning to you. what you have to do as a prosecutor is acknowledge every aspect of your case. it's not about hiding the ball. it's about being transparent and explaining. are you not going to put his girlfriend on and then you're going to have the defense bring her up and savage her? i think the prosecution did a very good job, not only as to that humanizing but also explaining why he was on the use of drugs. she talked about the issue of him having an injury. she talked about as a result of that injury, he developed a dependency upon opyoids. isn't that something the universe can

criminal legal analyst joey jackson with us now.end of that story where derek chauvin was deciding not to take the stand. based on conversations i've had with you in the past, i'm assuming you believe that to be the right choice? >> yes, there's no question. good morning to you, christi. listen in the event he took the stand. i know obviously people want to hear from the defendant. i think there's really analysis out there that would suggest, oh, the jury is going to be confused. or the jury wants to hear him or absent hearing from him there's going to be problems. the jury is instructed properly, and the instructions the jury gets that tells them you're not to consider that. he will have to account for his conduct. and sorry there came a time where mr. floyd was unresponsive, is that right? right. you have an opportunity to reassess, correct? yes. he was under control, right? yes. he was in handcuffs, right? yes. he was in fact no longer speaking to you? yes. people in the crowd said to check his pulse and you didn't do it. no. you

philando castile, 32 years old, joey jackson, the cop cleared of manslaughter charges.uess how many times he was pulled over, 32 years old? 46 times for traffic stops. george floyd, now daunte wright, pulled over for expired tags the middle of a pandemic with a 1-year-old son left behind. should our police be -- if this is what happens to black people in america when they get pulled over far too many times, should the cops be doing this? should they be the ones in charge of traffic stops? >> i mean, listen, poppy, you need police and you need policing out there, right? and just to be clear, my dad may he rest in peace was an officer and he always used to tell me in our conversations, you know, he said, son, of all the equipment that i have around me, my gun, my night stick, everything else, the most effective thing i have is my mouth. by speaking to people, treating them with courtesy, treating them with respect, by allowing them to know i value them, i appreciate them, we can work this out. and that goes to the larger issue of de-escalation. just to be clear, i recogni

joey nailed it in every aspect. coming from the top and it is something that every officer, every police chief, every organization must pay attention to, because it's saying we're not going to tolerate it. >> joey, let's go back to what's going on in north carolina, the police shooting there that stemmed from a warrant for cocaine possession. does that merit seven police officers arriving on the scene the way they did with the family attorney saying just four seconds passed from their arrival to the first shots? >> different law enforcement agencies have different protocols and directives with respect to who should arrive and what they should do. when you do arrive, you have to make an assessment as to the threat and as to whether or not you are fearful for your life and you have to act accordingly. i don't care if there's two officers or ten officers. if there's not an immediate threat and you act to shoot someone, you better have a reasonable belief that you're going to die or they're going to commit serious bodil
