joining us is joey jackson.ctor. >> reporter: we had an interesting tease coming into this block of the show that you believe he will be released in early october by this parole board without question. why? >> i do believe that. and i think if the parole board is acting in good faith that there is no reason to believe why they would not be acting that way, i think he is sprung loose. and there is a basis for that. now, you know, when you look at and examine the underlying offense, i don't think there is anyone within reason who would say based upon what o.j. simpson did, you know, look. he break into a hotel room, he gets and retrieves his own sports memorabilia. he did it, yes. they had guns allegedly with them. well, i won't say allegedly. he was convicted with it and he takes his own equipment back. did people really believe he was going to execute or injure someone there? was it a crime of stupidity? absolutely. was it a crime of arrogance? without question. was it technical a crime under the law? it was. bu

. >> that's a law, and i see joey jackson riding around on his scooter without a helmet in new york. call 911 or someone going to prove whether i could see joey jackson on park avenue without his helmet. how do you do that? >> here's how you do it, you have a great deal of depression, right? there are those instances, of course, we're not our brother's keeper unfortunately, we don't have an affirmative duty to assist anyone, we can keep going, when there's something this egregious, i would suggest that a prosecutor use their discretion. deterrence is a very important part of the law. the reason a lot of cases are prosecuted is not only for the bunnishment value, but deter it happening in other instances, you saw the teens prosecuted, it would send a resounding message that this conduct is illegal, inappropriate and something would be done. what that does is save a life. if we could save a life, we as a society are doing the right thing. i do think there will be a legislative response to this issue. >> there should be. >> watch me go, if the teams had had the same video but said, oh,

joining me now, cnn legal analyst and criminal defense attorney, joey jackson, and criminal defense attorney, ann bremner. thank you both for being here. and joey, everything i read, every headline is, this is a lock for him, that he is going to get paroled, that he hasn't made one misstep in prison in these nine years. what is is it such a sure bet? >> well, let's talk about that. good morning, poppy. good morning, ann. you know, a lot of people, when they think of o.j., i shouldn't say a lot, everyone, right, they don't think, necessarily, about this particular robbery, they think about that other case we followed so much, right, poppy? the double murder, and he did it, and i'm sure he did it. and everyone has an opinion about it. but this is about not that case, this is about what he did in reno, right? and so, the issues will turn on that particular case. and there are many who believe that everyone but the judge says, you know, 9 to 33 years for trying to steal your own memorabilia is ridiculous and has a lot to do with payback. and so you assess whether or not the punishment fit the cr

with me to discuss, cnn legal analyst and criminal defense attorney joey jackson. has now served nine years. he was sentenced to 9 to 33 years. by all accounts, a model prisoner according to many there. so will there be a pretty good chance that he might be paroled out? >> good afternoon fredricka. i say, yes. i think if the parole board really acts in good faith and consider what they need to consider, which are a few things, of course. the offense, and what happened in the offense. they're look at that. there will be a report prepared for them. a parole report concerning how he behaved and acted in prison, as you mentioned. he's been a model prisoner. you know, and look at a risk assessment. his age, and how he has comported himself, what he plans to do upon his release. is he a risk for, for what we call a recidivism, to go back to jail? if they act in good faith they'll spring him and he'll go free. no reason not to. i'll add this, fredricka. you know what he did was horrifically, you could say, stupid and arrogant, but to think that it warrants 9 to 33 years in
