joining me now is legal analyst and criminal defense attorney, joey jackson. joey. good morning. this is very interesting. that cohen would say this. may be reads like someone's advising him to do this or that he acknowledges that it might end up you might end up in a situation where trump is no longer gagged and attacking him. what do you think is going on here? >> yeah good morning to you, casey, i think it's the right call i think that right now this has to be about the trial and nothing but the trial we know of course it cohen is a central witness. we know of course the pecker and giving his testimony as he has and as you will resume doing so today really corroborates a lotto i think is designed obviously to lay out the scheme and corroborate michael cohen that we look at their. and so i think he takes himself away from the being the central role, or at least the central focus of trump's ire. and provide hi, it's or takes away any excuse that trump might have for being in contempt of court or violating the court order. and i think he takes himself right off the table. and so

and federal florida classified documents, cases dismissed joining us now a cnn legal analyst, joey jackson, always good to have you joy. let's start with these major setbacks are talking about where trump is trying to get his cases thrown out first, the federal documents case. so you have judge aileen cannon who rejected trump's bid to dismiss the charges based on the presidential records act. but it seems that she and the special counsel, jack smith they're clashing. they're at odds, namely over this, the potential jury instructions she called his request unprecedented and unjust what's going on here >> yeah, i don't know about that good to be with you. listen, here's the reality. the reality is, is that i think number one, it was the right call amor with respect to her denying any motion to dismiss the basis for really dismissing a case in this particular case, certainly not even near meeting the standard. i think what the judges doing, amara, she's conflating two separate statutes. now on not dismissing the case, you have this presidential records act which prosecutors are saying, judge

this is done as election interference cnn legal analyst joey jackson is at the magic wall to break down the key moments in the prosecution and defense is opening statements. so joey, what stood out to you? >> so what is this case about? what stood out is the facts and the evidence& let start with the underlying theme of the case. the violation or no violation of new york penal law 175.10. that is falsifying business records right now falsifying business records, how do you get to that issue? in this case, you get to it because you have to have an intent to defraud, but it's not only that you have to have a further intent. right. not only to defraud, but because you're intending to commit another crime or aid or conceal in the commission thereof. that's significant. that's relevant because it gives the prosecution to burdens one that we have false documents in to why were they doing it to cover up the election. so let's start talking about what this is all about. prosecution's case in a nutshell, prosecution came out swinging, speaking to the issue of this being a conspiracy and a cover-

. >> so kara stay with us or want to bring in legal analyst joey jackson, also bestselling author and former federal prosecutor, geoff toobin. jeff, you surprised by any of this, you know, the technical legal term for this is whac-a-mole they he trump is is trying to skirt around all of these issues on the gag order. the family members were not covered under the previous one. a, rational person, would think you don't attack the family members, but testing, you want this gag or does he think it helps him politically to say, i'm being gagged? >> i think i mean, this whole defense is a political defense as much as it's, it's a legal defense that's why he goes to all the hearings. he doesn't have to go to the hearings. this idea that he's a martyr, that he is being the victim of a witch-hunt that is part of his campaign and, now being gagged is another way that he is saying i am a victim here, not a perpetrator >> and the trump filing basically says, well, if the judge had recused himself, then trump wouldn't have to have had to go after his daughter >> listen >> i'm not sure about that r

so joey jackson, let me start with you. opening statements are crucial. in some senses for many jurors, they'll say that's what made up their mind, right? they here at the beginning and then that becomes confirmation on what they heard when the witnesses go. so this matters a lot so let's start with the prosecution. they go first prosecution lawyer goes for 46 minutes. so i'm just going to pick one line, but it was 46 minutes. one operative line from the transcript, donald trump orchestrated a criminal scheme to corrupt the 2016 presidential election. then he covered up that criminal conspiracy by lying in his new york business records over and over and over again. >> did they do a good job? i thought so for a number of reasons. let's talk about that to your point, aaron, i think opening statements are simply a preview of what the evidence will show, but you have to maintain credibility and giving that indicate occasion to the jury. most good lawyers will do with the prosecution did do and the defense, in some measure, which is under promise and over deli
