let me bring back in our panel john miller, joey jackson with me. joey, let's go over a little bit of what we heard. so she's asking for immediate discovery. she says that her client is being treated like a ping pong between the different courts, and that she has concerns about him getting a fair trial. and she pointed out as one reason that the perp walk that was, in her words, highly choreographed, with lots of law enforcement, but also lots of press. your reaction? >> so in terms of immediate discovery, i think that's very important. we don't play hide the ball in new york state, nor should any state. the fact is, is that if there's information if there's evidence, it should be turned over to the defendant and the counsel immediately so that it could be reviewed, evaluated, scrutinized, and so that he can begin to get a fair trial on the issue of being a human ping pong ball. also a very important point to be made. i think what they were doing, not as a matter of justification, but observation, is that law enforcement was sending a message that, h

joey jackson is back with us to continue this analysis. joey, i just want to read from part of the report here. just because the language was so strong and forceful, the committee concluded there was, quote, substantial evidence that representative gaetz violated house rules, state and federal laws, and other standards of conduct prohibiting prostitution, statutory rape, illicit drug use, acceptance of impermissible gifts, the provision of special favors and privileges, and obstruction of congress. joey, as caitlin noted, the doj did decline to bring federal charges against gaetz a few years back. but do you think state charges are possible in florida after this report? >> so, danny, we're in a different world now. and here's what i mean by that. ordinarily, you'd ask me a legal question. i talked to you about the florida laws relating to statutory rape, relating to underage. et cetera. what does it mean? what is the elements? what's the sentence i talked to you about the federal statutes concerning trafficking and commercial sex and minor

cnn legal analyst, criminal defense attorney joey jackson. joey, good morning to you. let's start with that angry outburst from the suspect as he was being taken into that courthouse. what did you make of of what he said and the legal strategy that his team is taking at this point? >> yeah. >> casey, good morning to you. first, as to what he said, generally speaking, in prosecutions, the motivation as to why someone did something is not anything the prosecution needs to prove. now, inquiring minds always want to know. but motive you don't have to show. you just have to show you did it. in this case, i think motivation is going to be significant. significant in terms of evidentiary value. what do i mean? you see his rant there. you obviously see that he has an ax to grind. speaking about an insult to the american people. et cetera. clearly, he had issues with the health care system in the country. a lot of people do. don't take it to this extent. but what i make of that is that all of his issues. right. his manifesto, his thought process, his grievances will come out in

here with us now, cnn legal analyst joey jackson. joey, great to see you and happy holidays. so in this appeals court ruling, it is said quoting now, while we recognize that an appearance of impropriety generally is not enough to support disqualification, this is the rare case in which disqualification is mandated and no other remedy will suffice to restore public confidence in the integrity of these proceedings. so the court says, you know, just an appearance of impropriety doesn't support willis removal. but in the end, they did feel they needed to disqualify her. how do you interpret this? >> good to be with you, fredricka. >> i think it's an unusual ruling from a legal perspective. i think other people can debate the politics of it. but when you look at it from a legal perspective, it's unusual and potentially wrong. and here's why i say that. number one, what the court said, and that's the lower court. remember, this is an appeals court. the original court had a two and a half day hearing. you might remember an evidentiary hearing as to whether or not there was a conflic

talk a little bit more about what is ahead with cnn legal analyst and criminal defense attorney joey jackson. joey, some legal experts believe that new york prosecutors could have trouble proving a first degree murder charge against mangione. tell us about that. and tell us about whether you agree with it so any case is challenging. >> it's good to be with both of you. but the reality is, is that i think from a legal and practical perspective, it was the right call. why? from a legal perspective, what this allows you to do, brianna and boris, is it allows you to introduce mindset. generally speaking, you don't have to establish a motive in a case. you just have to establish that it occurred. if you introduce the notion of terrorism, this is going to allow prosecutors to go all in on the basis for which he committed this. talking about the manifesto, speaking about his hate of the health care process, potentially his operation, what he had against health care in general. right. maybe unitedhealthcare in particular, because it was the face of what he thought was all that was all wrong with ame

let's bring in cnn legal analyst joey jackson. joey, good morning to you. so what really will this case hinge on today from a legal perspective yeah. >> casey good morning. >> it's going to hinge on the framing of the issue and what happens is, is that this is an equal protection case, right. it's based upon equal protection under the law. and who should be afforded equal protection but not so fast. maybe it's not. what do i mean? when you look at equal protection, the government certainly can make laws that relate to gender based classifications. and when you make laws based upon gender, it's subject to a heightened level of scrutiny. and what is that heightened level of scrutiny? whatever the law is has to be substantially related. right to an important governmental purpose here, the issue is whether or not minors should be getting this reaffirming surgery and really whether or not they're mature enough to get the reaffirming surgery that however, relates to minors. right. and i think they're going to frame the issue. if you're on the one side saying that

and for more, we're joined now by cnn legal analyst and criminal defense attorney joey jackson. joey, it's great to see you on this saturday. we have heard from new york's governor. we saw the attorney general there. what else can can be done to prevent something like this from happening again? >> yeah. >> jessica, good to be with you. i think there's going to be really three prongs legally that are going to really take place here. the first prong, and we have heard from the governor, and we should echo what the governor said, and that is that the vast majority of correctional officers do extraordinary job under very difficult circumstances. these did not, from the looks of it. and with respect to those three prongs, the first thing is in terms of their firing, there'll be a disciplinary process where that internal investigation will unearth their specific conduct. the nature of that conduct, what specifically they did, why they did it, who was involved, how it occurred, and that will deal with their jobs and whether or not they'll be fired or not. the second prong will be of the

here to discuss is cnn legal analyst and criminal defense attorney joey jackson. , so sean diddy combs is facing criminal sex trafficking and racketeering charges. he's denied all the allegations against him. he's currently in a new york city jail awaiting trial after his bail was denied not once, but three times. do you think that federal prosecutors are likely listening to what john doe has to say? could this impact the criminal case against combs? >> so jake has the answer. >> everything is relevant. everything is on the table. federal investigators are going to investigate this. they will vet it and they will do their due diligence. but they will have serious questions like, what did you file a complaint in october wherein you sat with your lawyers and gave them specific information? >> what specific information? we heard it in elizabeth's excellent reporting there. like for example, it happened in 2006, but you amended it several months later, right? or a couple of months later wherein you said it was 2007. was this not a traumatic event? did you not know the

but we also have with us cnn legal analyst and criminal defense attorney joey jackson. joey, i will start with you. so if the judge does waive extradition, when might we see mangione facing? because he has to face the official charges in new york. that has not yet happened. yes. >> so what happens in a court proceeding is that he has to voluntarily waive extradition, be advised of his right, and do a knowing and intelligent waiver. >> you have a right to contest it. you're not going to. >> and then of course, you move. >> so what will happen is, is that could be virtually immediate, right? >> not as in he's transported to new york, but ultimately he'll be brought to new york, i would assume, right away. and as early as tomorrow. right. he could be before a judge. and the purpose of that, we know he's indicted. he has a right as a defendant to be arraigned. that is apprized of the charges and now. right. due process. and what is due process? knowing and an opportunity to be heard. he'll enter a plea of not guilty which is standard protocol. and then it's game on. in terms

. >> joining us now, cnn legal analyst joey jackson. so joey, the judge was not mincing words, some pretty scathing language in terms of the decision here, specifically targeted at jay-z's attorney, basically paraphrasing, saying that his attorney is wasting the court's time not helping jay-z at all. how does this set the tone right for moving forward? >> so, erica, good to be with you and jessica. >> you know, judges have thick skin and they understand that attorneys represent clients. >> and i think this particular attorney and jay-z were put in a tough situation. how you're really given allegations by a litigant who is anonymous. the identity is not known. you have to fight against that. and then it's revealed that significant parts of her story have inconsistencies, like her father apparently picking her up at a gas station, the father being contacted saying, hey, i don't remember that. like her naming another celebrity that she spoke to that evening and representatives saying, hey, you know, he wasn't even in the state. he was on to

joining us now, cnn legal analyst and criminal defense attorney joey jackson, to discuss more about this. all right. first of all, this is a civil lawsuit. it is not part of the criminal prosecution. but in hearing this and now that he is coming out to speak, could it be so? >> we'll see. there's a lot that has to be unpacked, right? the first thing is, is remember, sarah, that this was an amended complaint. why do i say that and why is that significant? it's significant because initially when it was filed in october, there was the indication that it happened in 2007. right. learning, however, that p diddy was in saint tropez then, so it could not have happened then. so it was amended to include. right the year after. okay. that's a problem. there was also the indication initially that he wasn't married and now we're learning he is. why do i say that? because every case turns on its facts. so if you're going to determine right civil it's a civil case. it involves monetary damages. not not criminal. you're going to assess the credibility of it. now attorneys for of course p diddy are goin

let me bring in right now cnn legal analyst and criminal defense attorney joey jackson. before we get to what is really new gruesome details, first and foremost, merry christmas, joey. thank you for being here. >> of course, kate, thank you. and merry christmas to you and to all. >> thank you. what is your reaction to the new details coming out in this police testimony, and what it is going to mean for what is going to be a case building against this man? >> yeah, kate, it's quite disturbing, obviously. i mean, anyone who rides the new york city subways wants to be safe, wants to be secure, and doesn't want to be subjected to this. whether there's a full subway of car people or whether you're alone. and certainly as it relates to seeing a woman who's there intentionally lighting a fire. he, of course, was found allegedly with a lighter in his pocket when he was apprehended. but lighting that, now fanning the flames and then going and sitting and watching sort of the show is troubling. and so that is depraved, to say the least. what it will mean from a legal perspective is

joey jackson, cnn legal analyst and defense attorney. glad to have both of you here.oey, let me begin with you. can you first quickly explain to us why mangione has a second degree murder charge as opposed to a first degree charge in new york? >> yeah. >> laura, good to be with you. so what happens is, is that in new york state, first degree murder is reserved for the killing of a police officer, a peace officer, a judge, a correction officer, a first responder. you don't generally get first degree murder unless it pertains to one of those issues. the only other conceivable way that it could be first degree is if it's in furtherance of some act of terrorism, which could be a viable charge, depending upon, of course, what authorities continue to find with respect to his that his luigi mangione, uh, mind state of mind mindset as it relates to the actual crime murder in the second degree, however, is preserved for everything else, and that is intentional murder. and so generally, people who are charged in new york state with murder are charged with murder in the second d

cnn legal analyst joey jackson joins us live now. joey, good morning. always wonderful to see you. so the nypd commissioner, at that same press conference condemned what we are seeing in terms of the glorification of what mangione did that we are seeing online. let's watch what she said. >> we have seen a shocking and appalling celebration of cold blooded murder. social media has erupted with praise for this cowardly attack. we don't celebrate murders and we don't lionize the killing of anyone and any attempt to rationalize this is a vile, reckless and offensive to our deeply held principles of justice. >> joey, first of all, what do you make of the upgraded charges? and then, of course, what she discusses there? um, i'm honestly interested in how the way that this is manifesting, the way people are saying they feel about this is going to affect a jury or could play out in the context of a jury. >> yeah. casey. bingo. good morning to you. so in terms of the upgraded charges, i think they're appropriate. prosecutors generally charge in two ways. number one, the relevant conduct. wha

cnn legal analyst and criminal defense attorney joey jackson is with us now. joey, good morning. what do you make of this statement from jay-z, as well as the updating of this lawsuit yeah. >> casey, good morning to you i take it that he's swinging hard. he vehemently denies this, giving the indication that if this happened, then you know what i should be in jail. and so why not bring forward criminal charges and to the extent that the allegations in the complaint really do talk about what we've heard before, casey which is the drugging of someone this also indicates that he would have held her down and forcibly raped her, which would be rape in the first degree. doesn't have a statute of limitations in new york and so it should be investigated. but he really is saying that this is complete fiction. and the last point on this, casey, the lawsuit itself does give some indication of witnesses not only the fact that there was another celebrity present, but after the fact that this woman went to a gas station, she was then a girl of 13 and a gas station attendant noticed her distress

i want to go to joey jackson now for some legal analysis. joey are you surprised by this? what's your reaction? >> yeah. pamela, i'm not surprised by it. certainly we saw just last week that they were hung up on the reckless charge that was the manslaughter charge that carried the 15 years. and i think that there were concerns as to why they were hung up. i think when you look at this what does it tell us? first of all, we have to look at what negligent, criminally negligent homicide means. it means that the jury would conclude that he was negligent, that is, that he failed to perceive the risk that his activities could cause the death of jordan neely. however, i think that there are two issues that you look at that are critical. number one, was it self-defense? certainly. that's what the defense argued that he that his jordan neely represented an immediate threat. and as a result of representing that immediate threat of death or serious physical injury, that restraining him in the way that he did was reasonable and appropriate and so that was the one issue. i think the se

. >> joining us now is joey jackson, cnn legal analyst, criminal defense attorney. orning to you. so apparently we're learning that neither mangione nor his mother were members of unitedhealthcar e. how do you read this piece of information and how will it help investigators understand his motive so i think, casey, the first thing to talk about. >> good morning to you is in terms of prosecutions, you don't have to establish motive generally. and what do i mean? >> all you have to establish is that a person committed a crime. >> now, that does not mean that a panel of 12 jurors do not want to know. inquiring minds always want to know how and why did you do this? right. what was the essence, the purpose, the basis for which you would engage in this activity? but in general terms, you do not have to establish what the purpose was or what your philosophy was. in this case, potentially, you could be looking at authorities wanting to know that, to see whether he committed an act of terrorism. right. whether you're coercing, coercing a civilian population for purposes of es

cnn's legal analyst joey jackson is here, and cnn's senior correspondent daniel sullivan, back with me. joey, you know, president elect going to the supreme court with this kind of a petition? one what does that look like? and two, do they now have to answer before january 19th? >> so it's a friend of the court brief. what that means in english is that the president to be is not a party to the litigation. he is merely put in a friend of the court brief, along with so many others, to try to influence what the court's decision is. look, at the end of the day, he's going to be the leader of the free world. and he could, in fact, have a lot to say about this case and controversy. how he could, of course, with congress, pass a law banning this right. ban on tiktok. he could take the position that i'm not going to enforce the ban on tiktok. and so he's very influential in that regard. so what's interesting to me, caitlin, is that the supreme court never likes to make decisions that they don't have to make. and so to the extent that there could be a negotiated resolution to this, maybe it's s

joey jackson is here with us to get your reaction. i mean, this they've been deliberating for several days. joey. and now a deadlock on this charge. >> yeah pamela, it's not a surprise. i think there's a lot to consider and remember in these cases, they're tough. >> they're two different narratives. on the one hand, you have the prosecution who's indicating that there was at the very least recklessness here. and what is recklessness? the standard is, is that you consciously disregard the risk of your behavior. what risk? if you have your hand or your arm around someone's neck, would it not be probable or possible that they would die? that's the one narrative. on the other hand, you have the defense saying it was certainly necessary that jordan neely represented a danger. the danger was immediate and that there needed to be activity taken. i think the other issue that's hanging them up is there's a causation issue. what does that mean in english? there was differing testimony from the medical examiner who the prosecution had that said,

cnn legal analyst joey jackson explains how public sentiment could affect the prosecution of this case. >> i've never seen social media reaction that is so on a person's side who committed just a blatant murder. this is a guy who's seen as a deity. they're calling him saint luigi, right? do you get a jury who buys into the notion of the health care industry being so disruptive to the common person that this person deserved this, right? i'm speaking about the ceo who died. so, you know, could you get a jury to nullify? could you get a jury that's hung? i mean, the evidence is really compelling, i doubt it. if you base it on the evidence and the facts alone, the question is no. at least to this point. he deserves the presumption of innocence. we're not at trial yet, but from the public disclosure of the evidence, i think it's pretty well, authorities say determining the motive for the deadly school shooting in madison, wisconsin, is a top priority. >> as of now, they say it appears to be a combination of factors. the investigation underway as a candlelight vigil was held to remember the

joey jackson joins me now. criminal defense attorney. so, joey, okay, i want to get your reaction to some of the details that danny had there. first, though, when he's talking about the charges, first degree murder. you know, to sum just you look at this and you go, a guy comes and assassinates someone on the street on video in the streets of new york. that's first degree, but it actually in new york state, things are different. it was second degree. yes, they get to they get to first degree because they say that this was intended to terrorize. yes. and so do you think this is a very, very high bar, right. i guess it means he can never life without parole. no way around. it. is the da going to get a conviction on that? >> so this is what they're doing. what da generally do is they charge number one, the conduct that's relevant to the offense. >> and number two, they charge what they can prove beyond a reasonable doubt. >> it's an open question as to a conviction. and i say that even notwithstanding the compelling evidence, this is a guy w

joining us right now is cnn legal analyst joey jackson to help us walk through this. let's start with the charges. joey, why federal charges? >> so i think a couple of reasons. >> first of all, if you look at the federal charges and distinguish that from the actual state complaint, wow. >> it sings of all the details. >> and generally speaking, in any case, you just have to establish really a facially sufficient complaint. you don't have to go into all the details. this talks about everything. but i think number one, there's a role for the federal government to the extent that you cross state lines, to engage in any offense, they have authority. and here. right, he certainly did that. and you see that with regard to him going from georgia to new york to do what he did, use of the internet qualifies. they have him as stalking. et cetera. and i think there's could potentially be another basis. and you hit on it. and that's the death penalty. new york state does not have the death penalty. the federal government does. and i think they certainly want to assure accountabili

joining me right now is cnn legal analyst and criminal defense attorney joey jackson. so these new allegations are similar to the dozens of others that we have already seen that have been filed. how do these add up or add into kind of what you see in what could be with all of these civil suits? >> so it always depends. right. and any suit turns on its facts. and what we're starting to see are facts that are very similar. so it begs the question as to whether or not one of two things is permissible or possible. number one, that this was simply right. these allegations represented his modus operandi. that's one way of looking at it. item number two, in looking at it, is saying that, hey, maybe these are copycats who are really creating fiction. and that is the narrative of p diddy, right? his people are saying these are pure lies. and so when you get other lawsuits which evidence a pattern of spiking drinks, of approaching, of drugging, of raping, and you've seen that, well, you have something to base it against. now the attorney has an obligation to vet, evaluate, revie

enforcement and intelligence analyst john miller, and cnn legal analyst and criminal defense attorney joey jackson. guys, thanks for being here. mr. miller, what are we going to see this morning? >> we're going to see the defendant produced the feds who have him in custody are going to hand him over to the new york city police department and the court there. he's going to go into a courtroom with judge gregory carro on the 13th floor, and they're going to have an arraignment, usually, and an arraignment, as joey will tell us, the key factor is going to be what are the conditions or possibilities of bail. that is not a factor here. it's not even going to be a question. so they'll read the charges. and basically the horse trading is going to be over. managing the schedules of how do we get this prisoner back from federal custody into state custody. how do we get this trial schedule underway? and when does the federal government get him back? >> that's a lot of that's a lot to be worked out, joey. i mean, yes, i'll call it pro forma. what is going to happen this morning? but it's a key step in trying

joey jackson, we heard karen friedman agnifilo, the lawyer for mangione, expressed concerns about vanones getting a fair trial because of last week's very publicized perp walk. as a criminal defense attorney yourself, do you agree with her? >> so i don't agree, wolf. although i think she's advocating mightily for her client. and the reason i don't is because, generally speaking, you are very concerned as a defense attorney with respect to a fair trial. in this case, it's rather unique. if you look at the sentiment on social media, it seems the more exposure he gets, the more people can relate to what he did, the more people inclined to excuse what he did, the more people clamoring and talking about how he's a saint and how the health care industry has run amok, and they're putting y skewering a defendant, yes, i'm concerned in this a jury would sympathize with him, wolf, buy into his narrative and potentially move to not find him culpable. so in this specific instance, i would not agree with that. >> john miller, on the law enforcement side of this, do you think the perp walk issue co

enforcement and intelligence analyst john miller and cnn legal analyst and criminal defense attorney joey jackson. john, let's start with this notebook that police now have. what's in it? >> so when police arrested him, of course, the focus became this three page document that we've loosely referred to as the manifesto, in that he talks about, you know, this wasn't so difficult. it just required some social engineering and some cad, which is computer aided design, which is an engineer's term. so it fits. but beyond those three pages, there's the notebook they appear to come out of, which is a spiral notebook. the way a student would work from and, you know, in the notebook and he mentions this in the note, kind of obliquely saying in the notebook, you'll see some, you know, to do lists and so on. my technology is mostly locked down. so he's telling them, you know, when you get into my computers or phones, you're not going to find much almost pointing them to the, the note itself and the notebook. but in the notebook there are the to do lists that talk about things he's going to need or things he'

judge george grasso, who was at the trial today and all this week in criminal defense attorney joey jackson you feel strongly about this case, that this is a miscarriage of justice going on, that this was a marine veteran who stood up and was trying to help people on this train. um, what's it been like at the trial? what do you think is going to happen well, it's been quite a week, and i do believe that. >> i mean, what's very unusual about this case, and in terms of cases i'm aware of from my 30 years with the police department and almost 13 years as a judge is both sides. >> the defense, obviously, and the district attorney agree that daniel penny was a good man, acting selflessly for the right reasons to protect others in that subway car. >> the man who who died was, you know violent or threatening people with scaring people. >> well, there's evidence that that he was basically, i'm ready to die today and i'm ready to kill today now, now. daniel penny we can say he would not have been the one who would have been directly threatened. there were all the people. there were one women. young
