allen who was a former adviser to george w. bush. let me pick up the new defense from john dowd that the president cannot obstruct justice because he's the president. ask richard nixon or bill clinton, but is that accurate? it seems generously rather controversial? >> yes. what happens is that it's possible that to argue that the president cannot obstruct justice or be prosecuted or indicted for it. that's different than saying he cannot discuss justice and be impeached for it. he may be saying, in effect, if there's a case or obstruction, it has to go to the house for impeachment and to the senate for prosecution. but it can't go to the federal courts. he he won't be sitting in a grand jury or a petit jury box while he's president because the constitution says as chief executive, he can't be in that position. that is the argument. >> okay. so you have been around the law for a long time, does that pass the smell test to you? >> well, if i use the smell test, we would have to be talking about a lot more than this. no, i think it is possible. yes, i think it is possible to a
